About enforcement of the Penal Code of the Russian Federation

Article 1. Enact the Penal Code of the Russian Federation since July 1, 1997, except for provisions for which other terms of enforcement are established by this Federal Law.

Article 2. Recognize voided since July 1, 1997:

1) the Corrective labor code RSFSR approved by the Law RSFSR of December 18, 1970 "About approval of the Corrective labor code RSFSR" (Sheets of the Supreme Council of RSFSR, 1970, N 51, Art. 1220; 1973, N 22, Art. 491; 1977, N 12, Art. 258; 1983, N 10, Art. 319; N 40, of Art. 1429; 1985, N 39, Art. 1353; 1987, N 29, Art. 1060; N 43, of Art. 1501; 1988, N 31, Art. 1006; 1989, N 22, Art. 550; Sheets of the Congress of People's Deputies of the Russian Federation and Supreme Council of the Russian Federation, 1992, N 29, Art. 1687; 1993, N 10, Art. 360; N 22, of Art. 789; N 32, of Art. 1234; The Russian Federation Code, 1996, N 25, the Art. 2964), and also all legal acts of RSFSR and the Russian Federation accepted during the period from December 18, 1970 to July 1, 1997 regarding modification and amendments of the Corrective labor code RSFSR;

4) the Decree of Presidium of the Supreme Council of RSFSR of July 16, 1984 "About approval of the Regulations on procedure and conditions of execution in RSFSR of the criminal penalties which are not connected with measures of corrective-labor impact on convicts" and the Regulations on procedure and conditions of execution in RSFSR of the criminal penalties which are not connected with measures of corrective-labor impact on convicts approved by this Decree (Sheets of the Supreme Council of RSFSR, 1984, N 29, the Art. 991);

5) the Law RSFSR of December 6, 1984 "About approval of Decrees of Presidium of the Supreme Council of RSFSR on modification and amendments in some legal acts of RSFSR" (Sheets of the Supreme Council of RSFSR, 1984, N 50, the Art. 1758) regarding approval of the Decree of Presidium of the Supreme Council of RSFSR of July 16, 1984 "About approval of the Regulations on procedure and conditions of execution in RSFSR of the criminal penalties which are not connected with measures of corrective-labor impact on convicts".

Article 3. Recognize not acting in the territory of the Russian Federation since July 1, 1997:

1) the Bases of the corrective-labor legislation of USSR and federal republics approved by the Law USSR of July 11, 1969 (The sheet of the Supreme Council of the USSR, 1969, N 29, the Art. 247), with subsequent changes and amendments;

2) the Decree of Presidium of the Supreme Council of the USSR of October 6, 1969 "About procedure for enforcement of Bases of the corrective-labor legislation of USSR and federal republics" (Sheets of the Supreme Council of the USSR, 1969, N 41, the Art. 365);

3) the Decree of Presidium of the Supreme Council of the USSR of March 15, 1983 "About approval of the Regulations on procedure and conditions of execution of the criminal penalties which are not connected with measures of corrective-labor impact on convicts" and the Regulations on procedure and conditions of execution of the criminal penalties which are not connected with measures of corrective-labor impact on convicts, approved by this Decree (Sheets of the Supreme Council of the USSR, 1983, N 12, the Art. 175);

4) the Law USSR of June 17, 1983 "About approval of Decrees of Presidium of the Supreme Council of the USSR on modification and amendments in some legal acts of the USSR" (Sheets of the Supreme Council of the USSR, 1983, N 25, the Art. 387) regarding approval of the Decree of Presidium of the Supreme Council of the USSR of March 15, 1983 "About approval of the Regulations on procedure and conditions of execution of the criminal penalties which are not connected with measures of corrective-labor impact on convicts";

5) the Decree of Presidium of the Supreme Council of the USSR of April 21, 1983 "About approval of the Regulations on disciplinary battalion in Armed Forces of the USSR" and the Regulations on disciplinary battalion in Armed Forces of the USSR approved by this Decree (The minutes of Presidium of the Supreme Council of the USSR, 1983, N 73, the item 135).

Article 4. Other laws and other regulatory legal acts operating in the territory of the Russian Federation are subject to reduction in compliance with the Penal Code of the Russian Federation.

Until reduction in compliance with the Penal Code of the Russian Federation the specified laws and other regulatory legal acts are applied in the part which is not contradicting the Penal Code of the Russian Federation.

Article 5. Article 6. Charge to the Government of the Russian Federation:

1) in three-months time:

adopt necessary regulatory legal acts on realization of provisions of the Penal Code of the Russian Federation;

provide review and cancellation by the ministries and other federal executive bodies of the regulatory legal acts contradicting the Penal Code of the Russian Federation;

prepare and approve Regulations on criminal and executive inspections and the standard rate of their number of staff and Regulations on disciplinary military unit;

introduce in the State Duma of Federal Assembly of the Russian Federation the federal law draft about introduction of amendments to article 60 of the Housing code of RSFSR, concerning preserving premises for persons condemned to imprisonment for the term of over six months;

2) during 1997 to prepare and approve Regulations on arestny houses and the standard rate of their number of staff and Regulations on correction centers and the standard rate of their number of staff.

Article 7. Determine that the convicts serving custodial sanction can be transferred to strict conditions of keeping for the violations of established procedure of serving sentence made after enforcement of the Penal Code of the Russian Federation, that is after July 1, 1997.

Article 8. Determine that the provisions provided by the Penal Code of the Russian Federation for the convicts who are in the facilitated serving sentence conditions are applied to the convicts transferred by July 1, 1997 to the improved conditions of keeping.
