ORDER OF THE MINISTER OF AGRICULTURE OF THE REPUBLIC OF KAZAKHSTAN

About approval of the standard agreement of purchase and sale of the parcel of land

(as amended of the Order of the Minister of Agriculture of the Republic of Kazakhstan of 30.03.2021 No. 96)

According to subitem 2-10) of Item 1 of Article 14 of the Land code of the Republic of Kazakhstan of June 20, 2003 PRIKAZYVAYU:

1. Approve the enclosed standard agreement of purchase and sale of the parcel of land.

2. To provide to management committee with land resources of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

3) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

acting on the basis of the ______________________ hereinafter referred to as "Buyer", on the other hand, signed this agreement (further - the Agreement) as follows:

Chapter 1. Subject of the agreement

1. Based on the decision of local executive body ____________ from _____ 20 ___ ________ the Seller sells years No., and the Buyer acquires the right of private property to the parcel of land.

2. Location of the parcel of land and its data:

Chapter 2. Price of the parcel of land

3. The cadastral (estimative) cost of the parcel of land, is determined according to the act of determination of cadastral (estimative) cost of the parcel of land from _____ 20 ___ years No. ___________ and constitutes _______ (copy-book) of tenge.

4. The cadastral (estimative) cost of the parcel of land is subject to payment by the Buyer within 30 calendar days from the date of the signature of this agreement.

In case of realization of the parcel of land by installments for a period of up to ten years according to the written application of the buyer the item 4 is stated in the following edition:

4. The buyer within ten working days from the date of the conclusion of this Agreement contributes advance payment in the amount of, constituting at least five percent from the cost of the parcel of land specified in Item 3 of this Agreement.

In subsequent payment for the parcel of land is brought by the Buyer monthly according to the payment schedule according to appendix 1 to the this Agreement which is integral part of this Agreement.

The cadastral (estimative) cost of the parcel of land, in case of its realization by installments is not subject to change, in case of change of base rate of payment for the parcels of land in the territory ______________.".

5. Payment of cost for the parcel of land can be performed by both cash, and non-cash method on individual identification code of ____________________________________________, __________________________________________, the name of body of state revenues _____________________________, the _______ code, business and identification number _______________________.

Chapter 3. Rights and obligations of the Parties

6. The buyer has the right:

Independently to manage 1) on the earth, using it for the purpose of, following from purpose of the parcel of land;

2) on indemnification in full in case of compulsory acquisition of the parcel of land for the state needs;

3) on use in accordance with the established procedure without intention of the subsequent transactions for the needs of the economy which are available on the parcel of land or in subsoil under the parcels of land of popular minerals, plantings, surface and underground water belonging to them and also on operation of other useful properties of the earth;
