About approval of Rules of physical protection of sources of ionizing radiation and Items of storage

1. Approve the enclosed Rules of physical protection of sources of ionizing radiation and Items of storage.

2. To provide to committee of atomic and energy supervision and control of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after its state registration of this order in the Ministry of Justice of the Republic of Kazakhstan of the direction it the copy on official publication in periodic printing editions and in information system of law of Ad_let, and also in the Republican state company on the right of economic maintaining "The republican center of legal information" of the Ministry of Justice of the Republic of Kazakhstan for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on official Internet resource of the Department of Energy of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of physical protection of sources of ionizing radiation and Items of storage

1. General provisions

1. These rules of physical protection of sources of ionizing radiation and Items of storage (further - Rules) are developed according to the subitem 7) of article 6 of the Law of the Republic of Kazakhstan of January 12, 2016 "About use of atomic energy" (further - the Law) and determine procedure for physical protection of sources of ionizing radiation (further - III) and storage Items (further - PH).

2. These rules extend on the legal entities having the corresponding license for the address with III it is higher than the level of withdrawal, and/or the operating PH.

3. In these rules the following concepts and determinations are used:

1) engineering means - engineering and construction constructions, including the physical barriers intended for increase in efficiency in case of the solution of tasks of physical protection;

2) the plan of physical protection - the document establishing and describing elements of system of physical protection, management system organizational, technical components and procedures of physical protection of subjects to use of atomic energy;

3) the rule of two (three) persons - the principle of group work (including opening and rental of premises for protection) based on the requirement of simultaneous presence on workplace or in one room at least two (three) persons for decrease in possibility of making of unauthorized actions;

4) authorized body in the field of use of atomic energy (further - authorized body) - the central executive body performing management in the field of use of atomic energy;

5) the level of physical protection - set died, sources of ionizing radiation, Items of storage of certain category, necessary for ensuring physical protection, taking into account standard project threats and category of potential radiation hazard of radio nuclide sources.

Other determinations used in these rules are applied according to the Law.

4. The operating organization within the activities informs authorized body on condition of ensuring physical protection of III and PH.

5. Physical protection of III and PH provides:

1) protection against unauthorized withdrawal, plunder or illegal capture;

2) protection against diversion;

3) mitigation or minimizing of radiological effects of possible diversion.

2. Procedure for physical protection of III and PH

6. Physical protection of III and PH is determined differentially, considering set of indicators of radiation hazard and feature of the striking factors of III, and represents set of organizational and technical measures.

7. For the purpose of ensuring physical protection of III and PH three levels of physical protection are established:

1) the level of physical protection "And" (further - UFZ "A") - provides prevention of unauthorized withdrawal of III;

2) the level of physical protection "In" (further - UFZ "B") - provides reduction to minimum of possibility of unauthorized withdrawal of III;

3) the level of physical protection "With" (further - UFZ "C") - provides reduction of possibility of unauthorized withdrawal of III.

8. III of 1 category of radiation hazard belong to UFZ "A", III 2 categories of radiation hazard treat UFZ "V", and III 3 categories of radiation hazard treat UFZ "S".

Measures of physical protection for UFZ "A", "In" and "With" are given in appendix 1 to these rules.

9. Conditions for establishment of level of physical protection (further - UFZ):

1) for several III which placement is compact (it is concentrated within one room, compartment, packaging), it is determined taking into account total activity of all III;

2) for several geographically distributed single stationary III which owing to specifics of production are placed in several places in the territory of object it is determined for each III separately;
