Chapter 1. General provisions

Article 1. Subject of regulation of this Federal Law

1. This Federal Law establishes bases of regulation of rates of the organizations of municipal complex providing utilization (burial) of municipal solid waste, and also allowances to the prices (rates) for consumers and allowances to rates for services of the organizations of municipal complex.

2. According to this Federal Law are subject to regulation:

1)  rates for the services in utilization, neutralization and burial of municipal solid waste rendered by the organizations of municipal complex;

2) ceased to be valid with the Federal Law of the Russian Federation of 30.12.2012 No. 289-FZ;

3) ceased to be valid with the Federal Law of the Russian Federation of 30.12.2012 No. 289-FZ;

4) allowances to the prices (rates) for consumers of services of the organizations of municipal complex;

5) allowances to rates for services of the organizations of municipal complex.

Article 2. The basic concepts used in this Federal Law

In this Federal Law the following basic concepts are used:

1) the organization of municipal complex - the legal entity irrespective of its form of business or the individual entrepreneur, performing operation of the objects used for utilization, neutralization and burial of municipal solid waste;

2) ceased to be valid with the Federal Law of the Russian Federation of 30.12.2012 No. 289-FZ;

3) the objects used for utilization, neutralization and burial of municipal solid waste - the objects which are directly used for utilization, neutralization and burial of municipal solid waste;

4) the production program of the organization of municipal complex - the program of activities of the specified organization for ensuring rendering services in the sphere of utilization, neutralization and burial of municipal solid waste (further also - the production program);

5) ceased to be valid with the Federal Law of the Russian Federation of 30.12.2012 No. 289-FZ;

6) investing program of the organization of municipal complex - the program developed by the organization of municipal complex and determining actions for construction, reconstruction and (or) upgrade of the objects used for utilization, neutralization and burial of municipal solid waste (further also - investing program);

7) rates for services of the organizations of municipal complex - price rates at which calculations with the organizations of municipal complex for the services rendered by them are perfromed and which join in the prices (rates) for consumers, without allowances to rates for services of the organizations of municipal complex;

8) the prices (rates) for consumers - price rates which include rates for services of the organizations of municipal complex providing rendering services for the purpose of utilization, neutralizations and burials of municipal solid waste without allowances to the prices (rates) for consumers;

9) - 11) voided with the Federal Law of the Russian Federation of 30.12.2012 No. 289-FZ;

12) price increment (rate) for consumers - the price rate which is considered when settlings consumers with the organizations of municipal complex is established for the purpose of financing of investing programs of the organizations of municipal complex and which general size corresponds to the amount of allowances to rates for services of the organizations of municipal complex realizing investing programs (further also - the allowance for consumers);

13) the allowance to rates for services of the organization of municipal complex - the price rate which is established for the organization of municipal complex on the basis of price increment (rate) for consumers is considered when settlings with the specified organization for the services rendered by it and used for financing of investing program of the organization of municipal complex;

14) rates and allowances - rates for services of the organizations of municipal complex, and also the allowance to rates for the goods and services of the organizations of municipal complex and the allowance to the prices (rates) for consumers which are subject to regulation according to this Federal Law and rules approved by the Government of the Russian Federation;

15) monitoring of accomplishment of the production program and investing program of the organization of municipal complex - periodic collection and information analysis about accomplishment of the production program and investing program of the organization of municipal complex, and also information on condition and development of the objects used for utilization (burial) of municipal solid waste;

16) availability to consumers of services of the organizations of municipal complex - availability of acquisition and payment by consumers of the corresponding goods and services of the organizations of municipal complex taking into account the prices (rates) for consumers and allowances to the prices (rates) for consumers;

17) consumers of services of the organizations of municipal complex for utilization, neutralization and burial of municipal solid waste - persons acquiring under the agreement of service in utilization, neutralization and burial of municipal solid waste for the economic and household and (or) production needs (further - consumers). In the relations connected with content of housing stock, consumers are condominiums, housing cooperatives, housing cooperatives and other specialized consumer cooperatives, management companies which acquire the specified services for the purpose of content and repair of premises, or directly owners of rooms in apartment houses in the cases provided by the housing legislation;

18) financial requirements of the organization of municipal complex - calculated values of amount of money from rendering services of the organization of municipal complex for rates and allowances which is necessary for accomplishment of the production program and (or) investing program of the organization of municipal complex for development of the objects used for utilization, neutralization and burial of municipal solid waste;

19) the objective change of conditions of organization activity of municipal complex influencing the cost of the services rendered by it - change of the legislation of the Russian Federation, the inflation growth exceeding the rate of inflation considered in calculations in case of the approval of rates, the change of rates for fuel and energy resources exceeding the sizes established by regulatory legal acts of the Russian Federation, and also change of other conditions determined according to the procedure established by the Government of the Russian Federation.

Limiting 20) indexes - established on average on subjects of the Russian Federation and (or) on average on municipalities for the term at least than three years and no more than five years expressed as a percentage indexes of maximum and minimum possible change of the established rates for services of the organizations of municipal complex taking into account allowances to rates for goods and services of the organizations of municipal complex operating for the end of previous period of regulation.

Article 3. General principles of regulation of rates and allowances

1. The general principles of regulation of rates and allowances are:

1) achievement of balance of consumer interests of services of the organizations of the municipal complex and interests of the specified organizations providing availability of these goods and services to consumers and effective functioning of the organizations of municipal complex;
