About approval of rules of realization of pilot project on marking of jewelry

(as amended of the Resolution of the Ministry of Finance of the Republic of Belarus of 05.04.2021 No. 27)

Based on part one of subitem 5.6 of Item 5 of the Regulations on features of implementation of Internet trade in the jewelry and other household products made in the Republic of Belarus and marked by codes of identification, the Council of Ministers of the Republic of Belarus approved by the resolution of April 5, 2021 No. 193, of Item 3, of Item part two 4, of the paragraph of the fifth Item 5 and Item 6 of the resolution of Council of Ministers of the Republic of Belarus of July 29, 2019 No. 492 "About realization of pilot project on marking of jewelry" of Item 10 of the Regulations on the Ministry of Finance of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1585, the Ministry of Finance of the Republic of Belarus DECIDES:

1. Approve Rules of realization of pilot project on marking by codes of identification of jewelry and other household products (are applied).

2. This resolution becomes effective after its official publication and is effective before the termination of pilot project on marking with codes of identification of jewelry and other household products.

Rules of realization of pilot project on marking by codes of identification of jewelry and other household products

Chapter 1. General provisions

1. These rules establish procedure for realization of pilot project on marking of jewelry and other household products (further - jewelry) identification codes (further - pilot project).

2. For the purposes of these rules terms and their determinations in the values established by the Law of the Republic of Belarus of June 21, 2002 No. 110-Z "About precious metals and gemstones" and the resolution of Council of Ministers of the Republic of Belarus of July 29, 2019 No. 492, and also the following terms and their determinations are used:

commodity label (label) of jewel (further – the label) – the carrier of data on goods and its producer attached to commodity unit;

the commodity label (label) of jewel containing elements (means) of protection against counterfeit and intended for drawing code of identification (further – the protected label), – the document with certain degree of protection which is the carrier of data on goods and its producer, attached to commodity unit;

the protection sign containing identification code (further – protection sign), – the document with certain degree of protection intended for marking of jewelry by identification codes;

the marked goods – goods on which identification codes with methods, stipulated by the legislation are applied, and about which reliable information (including, information on the identification codes applied on them) is entered into the automated information system of marking of jewelry of the Republic of Belarus (further – AIS);

goods – the jewelry marked by identification codes according to the list according to appendix to the resolution of Council of Ministers of the Republic of Belarus of July 29, 2019 No. 492;

the owner of goods – the legal person or the individual entrepreneur who belong on the property right or other legal cause the marked goods intended for realization (sale);

authorized bodies – the republican state bodies subordinated to the Government of the Republic of Belarus, authorized on ensuring realization of pilot project;

participants of pilot project – the legal entities and individual entrepreneurs who are performing the goods circulation and registered by AIS.

Chapter 2. Identification code. Methods and terms of marking of goods

3. The code of identification is generated by the operator of AIS - the republican unitary enterprise "Belblankavyd Publishing house (further - the operator), consists of thirty two alphanumeric symbols and is the reference in AIS to information on goods.

Within pilot project the code of identification is presented in the form of two-dimensional bar code of DataMatrix suitable for machine reading.

4. Uniqueness of code of identification is provided with the operator.

5. During realization of pilot project marking of goods codes of identification by participants of pilot project is performed by drawing on:

5.1. label of sign of protection. The sign of protection shall be applied on the empty field of the label and shall not interfere with reading of the data specified on it;

5.2. the protected label of code of identification. The code of identification shall be applied on blank space of the white field of the protected label.

6. Marking of goods codes of identification is performed by participants of pilot project after carrying out assay works of assay supervision of the Ministry of Finance as the State inspection (further - the Gosprobnadzor) and prior to the beginning of their offer for realization (sale) and (or) exposure in the place of realization (sale). Marking is performed in places of their production, packaging (repacking) and storage.

7. Marking of goods, available at participants of pilot project for date of their registration in pilot project, is not performed. The participants of pilot project who are producers of goods, having the right to mark the goods made by them, available at them as for date of their registration in pilot project, and in the course of its realization.

Chapter 3. The equipment used for drawing and reading of codes of identification

8. As the range of the sizes of the separate dot symbols constituting DataMatrix two-dimensional bar code dot symbols with sizes in mm 0,255 limits - mm 0,615 are used.
