1. Approve the enclosed Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities.

2. Recognize not subject to application:

the order of the Ministry of Education and Science of the Russian Federation of November 25, 2014 No. 1517 "About approval of Administrative regulations of provision by Federal Service for Supervision in Education and Science of the state service in licensing of educational activities" (registration No. 36401) is registered by the Ministry of Justice of the Russian Federation on March 11, 2015;

Item 8 of the order of the Ministry of Education and Science of the Russian Federation of June 9, 2016 No. 694 "About modification of administrative regulations of provision of the state services regarding providing conditions of availability of the state services to disabled people" (registration No. 43240) is registered by the Ministry of Justice of the Russian Federation on August 15, 2016;

Administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities

I. General provisions

Subject of regulation of Administrative regulations

1. The administrative regulations of Federal Service for Supervision in Education and Science on provision of the state service in licensing of educational activities (further respectively - Administrative regulations, the state service) establish terms and the sequence of ministerial procedures (actions) performed by Rosobrnadzor in the course of provision of the state service and also establish order of interaction between structural divisions of Rosobrnadzor, his federal government civil servants (further - officials), and also interactions of Rosobrnadzor with applicants, other public authorities and local government bodies, the organizations in the course of provision of the state service.

2. Applicants by provision of the state service (further - applicants) are:

1) the organizations performing educational activities for educational programs of the higher education;

2) the federal state professional educational organizations realizing educational programs of secondary professional education in spheres of defense, production by the defensive order, internal affairs, activities of troops of national guard of the Russian Federation, safety, nuclear power engineering, transport and communication, the knowledge-intensive production for specialties which list is approved by the order of the Government of the Russian Federation of May 24, 2013 No. 437 <1>;

3) the Russian educational organizations located outside the territory of the Russian Federation, the educational organizations created according to international treaties of the Russian Federation, and also performing educational activities diplomatic representations and consular establishments of the Russian Federation, representation of the Russian Federation in case of international (interstate, intergovernmental) the organizations (further - foreign institutions);

4) the foreign educational organizations performing educational activities for the branch location in the territory of the Russian Federation (further together - license applicants, licensees);

5) the physical persons and legal entities which addressed for provision of data on the specific license for implementation of educational activities (further - the license) and other information on provision of the state service.

3. Informing on procedure for provision of the state service is performed:

on the official site of Rosobrnadzor on the Internet (further respectively - the official site of Rosobrnadzor, Internet network);

on the official site in the federal state information system "Single Portal of the State and Municipal Services (Functions)" (further - the Single portal);

in the federal state information system "Federal Register of the State Services (Functions)" (further - the federal register);

at information stands in places of provision of the state service (further - information stands);

on phone numbers for reference.

4. Reference information concerning provision of the state service is placed:

on the official site of Rosobrnadzor;

on the Single portal;

in the federal register;

at information stands.

5. Reference information is provided by officials by phone, on personal acceptance of the applicant or in writing the mailing or the electronic message to the address specified by the applicant.

Reference information includes data on the location, the working schedule, telephone numbers for enquiries, on the address of the official site, on e-mail addresses and (or) forms of feedback of Rosobrnadzor in Internet networks.

6. On the official site of Rosobrnadzor, information stands, on the Single portal the following information is placed:

procedure for receipt of information by applicants concerning provision of the state service;

data on the course of provision of the state service;

the list of the regulatory legal acts of the Russian Federation regulating provision of the state service;

text of Administrative regulations;

forms of statements (notifications, references) used by service provision.

7. Information on the Single portal and the official site of Rosobrnadzor on procedure and terms of provision of the state service based on the data containing in the federal register is provided to the applicant on a grant basis.

The refusal in the acceptance of request and other documents necessary for provision of the state service, and also refusal in provision of the state service is not allowed if the request and documents necessary for provision of the state service are given according to information on terms and procedure for provision of the service published on the Single portal.

10. Description of result of provision of the state service

11. Results of provision of the state service are:

1) provision of the license (refusal in provision of the license);

2) provision of the temporary license;

3) renewal (refusal in renewal) licenses (the temporary license) and (or) applications (appendices) to the license (the temporary license) (further - renewal (refusal in renewal) licenses);

4) cancellation of the license according to the statement of the licensee;

5) provision of the duplicate of the license and (or) appendix (appendices) to the license (further - provision of the duplicate of the license);

6) provision of the copy of the license and (or) appendix (appendices) to the license (further - provision of the copy of the license);

7) provision of data from the unified register of licenses which maintaining performs Rosobrnadzor (further - the unified register of licenses).

1) decision making about provision (about refusal in provision) licenses - 45 working days from receipt date in Rosobrnadzor of properly issued application for provision of the license for implementation of educational activities (further - the statement for provision of the license) (appendix No. 1 to Administrative regulations) and documents (data) provided by Items 15, of 16, 23 Administrative regulations;

2) decision making about provision of the temporary license - 10 working days from receipt date in Rosobrnadzor of properly issued application for provision of the temporary license for implementation of educational activities (further - the statement for provision of the temporary license) <3> and documents (data) provided by Items 17, 23 Administrative regulations;

5) registration and licensing (the temporary license) and (or) applications (appendices) to the license (the temporary license) - 3 working days from signature date of the license (the temporary license) and (or) applications (appendices) to the license (the temporary license) and registration of information about them in the unified register of licenses;

6) decision making about cancellation of the license - 10 working days from receipt date in Rosobrnadzor of properly issued application for the termination of implementation of educational activities (appendix No. 9 to Administrative regulations), stipulated in Item 24 Administrative regulations;

7) provision of the duplicate of the license - 3 working days from receipt date in Rosobrnadzor of properly issued application for provision of the duplicate of the license and documents (data), stipulated in Item 25 Administrative regulations;

8) provision of the copy of the license - 3 working days from receipt date in Rosobrnadzor of properly issued application for provision of the copy of the license, stipulated in Item 26 Administrative regulations;

9) provision of data from the unified register of licenses - 5 working days from receipt date in Rosobrnadzor of the statement for provision of data on the license, stipulated in Item 27 Administrative regulations.

13. The term of suspension of provision of the state service - 30 calendar days from the date of receipt by the applicant of the notification on need of elimination of the revealed violations and (or) submission of documents which are absent:

1) in case of filing of application about provision of the license, drawn up with violation of Items 15, of 16, 23 Administrative regulations, and (or) submission of documents not in full;

2) in case of filing of application about provision of the temporary license, the Item which is drawn up with violation 17, 23 Administrative regulations, and (or) submission of documents not in full;

3) in case of filing of application about renewal of the license, drawn up with violation of Items 18 - 23 Administrative regulations, and (or) submission of documents not in full;

4) in case of filing of application about the termination of the implementation of educational activities which is drawn up with violation of Item 24 of Administrative regulations;

5) in case of filing of application about provision of the duplicate of the license which is drawn up with violation of Item 25 of Administrative regulations and (or) submission of documents not in full.

14. The list of the regulatory legal acts regulating provision of the state service is posted on the official site of Rosobrnadzor, in the federal register and on the Single portal.

Rosobrnadzor provides placement and updating of the list of the regulatory legal acts regulating provision of the state service on the official site of Rosobrnadzor, and also in appropriate section of the federal register.

15. For receipt of the license the license applicant represents (sends) the following documents (data) to Rosobrnadzor:

1) statement for provision of the license;

2) details of the documents confirming availability at the license applicant on the property right or other legal cause of buildings, structures, constructions, rooms and the territories in each of places of implementation of educational activities, and also the copy of documents of title if the rights to the specified buildings, structures, constructions, rooms and the territories and transactions with them are not subject to obligatory state registration in accordance with the legislation of the Russian Federation;

3) the signed head of the organization performing educational activities, the certificate of material logistics of educational activities for educational programs (appendix No. 2 to Administrative regulations);

4) the signed head of the organization performing educational activities, the certificate of availability the developed and approved organization performing educational activities, educational programs (appendix No. 3 to Administrative regulations);

5) details of the sanitary and epidemiologic conclusion about compliance to health regulations of the buildings, structures, constructions, rooms, equipment and other property necessary for implementation of educational activities;

6) details of the conclusion about compliance of subject to protection to mandatory requirements of fire safety when implementing educational activities (if license applicant is the educational organization);

7) the signed head of the organization performing educational activities, the certificate of availability at the professional educational organization, the educational organization of the higher education, the organization performing educational activities for the main programs of professional training, special conditions for education by students with limited opportunities of health (appendix No. 4 to Administrative regulations);

8) the signed head of the organization performing educational activities, the certificate of availability of conditions for functioning of the electronic information and education circle in the presence of educational programs using exclusively electronic training, remote educational technologies (appendix No. 5 to Administrative regulations);

9) details of the license for work with use of the data which are the state secret according to the educational programs containing the data which are the state secret (in the presence of educational programs);

10) the copy of the agreement signed by the license applicant according to part 5 of article 82 of the Federal Law No. 273-FZ confirming availability of conditions for realization of practical training of students on professional educational programs of medical education and pharmaceutical education (in the presence of educational programs);

11) the information about the citizens who are founders of the organizations planning to perform educational activities for the main programs of professional training for work as private detectives, private security guards and to additional professional programs of heads of the private security organizations, and also the citizens who are founders (participants) of the organizations acting as founders of the organizations planning to perform educational activities for the main programs of professional training for work as private detectives, private security guards and to additional professional programs of heads of the private security organizations, confirming their compliance to requirements the stipulated in Article 15.2 Laws of the Russian Federation of March 11, 1992 No. 2487-1 "About private detective and security activities in the Russian Federation" <5> (further - the Law No. 2487-1) (in the presence of educational programs);

15) representation of the religious organizations - founders of the educational organizations (if such religious organizations are included into structure of the centralized religious organizations, - representations of the relevant centralized religious organizations), data on qualification of pedagogical employees of the spiritual educational organizations having theological degrees and theological ranks (if the spiritual educational organization), and also copies of the documents confirming placement of the spiritual educational organization in the rooms which are on the property right or other legal cause at her founder for implementation of educational activities for educational programs (in the presence of such rooms acts as the license applicant);

17) the copy of regulations on structural division (if the organization performing training which structural division enables the realization of educational programs acts as the license applicant);

16. For receipt of the license the educational organizations planning to realize the educational programs containing the data which are the state secret, and being under authority of federal executive body in the field of safety, the federal executive body performing functions on development of state policy, normative legal regulation, control and supervision in the sphere of the state protection, the federal executive body performing functions on development and realization of state policy and normative legal regulation in the field of defense, the federal executive body performing functions on development and realization of state policy and normative legal regulation in the sphere of internal affairs, federal executive body performing functions on development and realization of state policy and normative legal regulation in field of activity of troops of national guard of the Russian Federation, in the sphere of traffic in weapons, in the sphere of private security activities and in the sphere of private security, represent (direct) to Rosobrnadzor the application for provision of the license, documents (the copy of documents) and the data specified in subitems 3, of 9, of 10, of 12, of 13, of the 16 and 18 Item 15 of Administrative regulations.

The copies of documents provided by subitems 10, of the 16th Item 15 of Administrative regulations are represented to Rosobrnadzor notarized or with presentation of the original.
