About some questions of realization of pilot project on application of the insurance contract of responsibility of the supplier, as type of providing advance payment in case of the conclusion of agreements on public procurements

1. Realize the Pilot project on application of the insurance contract of responsibility of the supplier as type of providing advance payment in case of the conclusion of contracts on public procurements of works on construction with persons determined by the Government of the Republic of Kazakhstan within city building of Turkestan.

2. Bring in the order of the Minister of Finance of the Republic of Kazakhstan of December 11, 2015 No. 648 "About approval of Rules of implementation of public procurements" (it is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan at No. 12590, it is published on December 31, 2015 in information system of law of Ad_let) the following changes and amendments:

in Rules of implementation of the public procurements approved by the specified order:

add with Item 379-1 in the following edition:

"379-1. When implementing public procurements within the Pilot project on application of the insurance contract of responsibility of the supplier as type of providing advance payment in case of the conclusion of agreements on public procurements of works on city building of Turkestan, the customer sends to the potential supplier the draft agreement certified by the digital signature by means of the web portal according to the standard agreement about public procurements of works in the sphere of construction according to appendix 20-3 to these rules.";

add with Item 398-1 in the following edition:

"398-1. Persons at whom the works on city building of Turkestan determined by the Government of the Republic of Kazakhstan are acquired bring providing advance payment at the choice of the specified person in the form of guarantee money contribution or the bank guarantee or the insurance contract of civil responsibility of the supplier.

The insurance contract of civil responsibility of the supplier shall provide the insured events of civil responsibility of the supplier which are the facts of the approach of civil responsibility on indemnification caused to valuable interests of the customer owing to the accidental, not depending on the supplier events, and also the property harm done to the customer as a result of non-execution or improper execution of its agreement obligations about public procurements.

Draft agreements about public procurements of works on city building of Turkestan on compliance to these rules, and also insurance contracts of civil responsibility of the supplier regarding compliance to insured events, are considered by authorized body.";

add with appendix 20-3 to Rules according to appendix 2 to this order.

3. To provide to department of the legislation of public procurements of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan;
