About approval of Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan

According to subitem 41-22) of Item 1 of article 14 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:

1. Approve the enclosed Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan.

2. To committee of civil aviation of the Ministry for Investments and Development of the Republic of Kazakhstan (Seydakhmetov B. K.) provide:

1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it the copy on official publication in periodic printing editions and information system of law of Ad_let of the republican state company on the right of economic maintaining "The republican center of legal information of the Ministry of Justice of the Republic of Kazakhstan";

3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.

3. I reserve control of execution of this order.

4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of certification and issue of the certificate of the flight validity of civil aircrafts of the Republic of Kazakhstan (further - Rules) are developed according to subitem 41-22) of Item 1 of Article 14, articles 38 and 47 of the Law of the Republic of Kazakhstan of July 15, 2010 "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further - the Law), the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" (further - the Law on the state services) and requirements of International Civil Aviation Organization (further - ICAO).

2. These rules determine procedure for certification and issue of the certificate of the flight validity of the civil aircraft of the Republic of Kazakhstan (further - Rules) and rendering the state services "Issue of the Certificate of the Flight Validity of the Civil Aircraft", "Issue of the Certificate of the Aircraft on Noise", "Issue of the Decision on Recognition of the Certificate of the Flight Validity of the Civil Aircrafts Issued by Foreign State", "Issue of Permission to Accomplishment of Special Flight", "Issue of Permission to Use of the Radio-transmitting Equipment" and "Issue of the Export Certificate of the Flight Validity" (further - the state services in the sphere of maintenance of the flight validity).

3. The following effective period on the below-specified documents is established from the moment of their issue:

1) the certificate of the flight validity – one year;

2) the certificate on noise – termless;

3) the export certificate – twenty two working days;

4) permission to accomplishment of special flight (the special certificate of the flight validity) – no more than thirty calendar days;

5) permission to use the radio-transmitting equipment – termless;

6) the decision on recognition valid the certificate of the flight validity of the civil aircraft issued by foreign state (further – the decision on recognition of the certificate) – the term specified on the certificate of the flight validity of the civil aircrafts issued by foreign state.

4. The aircrafts occupied in production of flights have the certificates of the flight validity issued or recognized by authorized organization of the state in which this aircraft is registered. Without the existing certificate of the flight validity the aircraft is not allowed to operation.

5. In these rules the following terms and determinations are used:

1) authorized organization in the sphere of civil aviation (further - authorized organization) - the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, safety of flights and aviation safety;

2) permission to use of the radio-transmitting equipment established on civil aircrafts - the document issued by the authorized organization established on civil aircrafts to airworthiness standards;

3) operational documentation of aircrafts - documentation regulating flight and technical operation of aircrafts, including its maintenance and repair, and also containing operating conditions and operational restrictions;

4) the form of the aircraft, engines and main aggregates - the main documents for accounting of operating time (calendar resource, hour resource, resource on landings) the aircraft equipment and its technical condition;

5) the certificate of the flight validity of the civil aircraft - the document issued by authorized organization (or authorized body in the sphere of civil aviation), certifying compliance of the civil aircraft to airworthiness standards;

6) the request - the appeal of the applicant to authorized organization for receipt of the certificate of the flight validity, the export certificate, the certificate for noise, permissions to special flight (the special certificate of the flight validity), permissions to use of the radio-transmitting equipment and the Decision on recognition of the certificate;

7) the applicant - the physical person or legal entity which addressed to authorized organization for receipt of the certificate of the flight validity, the export certificate, the certificate for noise, permissions to special flight (the special certificate of the flight validity), permissions to the radio-transmitting equipment and the Decision on recognition of the certificate;

8) the flight validity - the technical condition of the aircraft corresponding to flight technical characteristics which ensure its safety and flight quality;

9) the directive on the flight validity - information directed to maintenance of the flight validity of the aircraft including engines and air screws, ensuring safe operation of the aircraft, and also the requirement for modification, replacement of accessories or in conducting check of the aircraft and (or) amending its operational restrictions and the operation manual;

10) airworthiness standards - requirements to design, parameters and flight qualities of the aircrafts and their components aimed at safety of flights;

11) the export certificate of the flight validity - the document issued by authorized organization (or authorized body in the sphere of civil aviation), intended for export of the aircraft excluded from the State register of civil aircrafts of the Republic of Kazakhstan;

12) the decision on recognition valid the certificate of the flight validity (further – the Decision) – the document of the established sample issued by authorized organization, in the sphere of civil aviation, confirming compliance of the civil aircraft to the requirements and ICAO standards and airworthiness standards established by the Republic of Kazakhstan;

13) the certificate of type - the document confirming compliance with airworthiness standards of design like the civil aircraft;

14) the certificate on noise – the document issued by authorized organization, certifying compliance of the civil aircraft on noise on the area;

15) RNAV (Area navigation) - zone navigation;

16) Cat. III (CATEGORY) - conditions of limited visibility;

17) MNPS (minimum navigation performance specification) - the minimum requirements to characteristics of navigation equipment.

6. For issue of the certificate of the flight validity of the civil aircraft (primary receipt of the certificate of the flight validity of the civil aircraft, issue of the certificate of the flight validity of the civil aircraft which earlier had the certificate of the flight validity, issue of the certificate of the flight validity of the civil aircraft which does not have the approved standard design, prolongation of the certificate of the flight validity of the civil aircraft) the payment according to the procedure, by certain order of the acting minister of the industry and infrastructure development of the Republic of Kazakhstan of March 24, 2023 No. 177 "About approval of Rules of collection of payments in the sphere of civil aviation of the Republic of Kazakhstan" is levied (it is registered in the Register of state registration of regulatory legal acts No. 32120) (further – Rules of collection of payments in the sphere of civil aviation).

Certification of the flight validity of civil aircrafts is performed after receipt of payment in the budget of authorized organization.

For receipt of the certificate of the flight validity of the civil aircraft the applicant sends to authorized organization through the web portal of "the electronic government" (further – the portal) the request, in form according to appendix 1 to these rules and document package according to the list provided in the list of the main requirements to rendering the state service "Issue of the Certificate of the Flight Validity of the Civil Aircraft" (further – the List of the main requirements to rendering the state service in issue of the certificate of the flight validity) according to appendix 1-1 to these rules.
