Regulations on procedure for distribution of the export quota of sugar from the Republic of Moldova to Romania

I. General provisions

1. This Provision is developed according to the agreements reached within the intergovernmental moldo-Romanian commission on economic cooperation and European integration which consist in provision of the export quota of sugar to Romania in prefential treatment of 14 thousand tons.

2. This Provision establishes procedure for distribution of the corresponding quota to economic agents of the Republic of Moldova, being producers of sugar.

II. General principles of distribution of quota

3. The export quota from the Republic of Moldova to Romania is distributed only to economic agents - producers of sugar, proceeding from amount of the sugar made from harvest of 2005.

4. According to the arrangements established between the parties, this quota will be distributed to economic agents - producers of sugar till September 31, 2006. Supply of sugar will be quarterly made in the set limits.

5. The quota will be quarterly distributed by the commission created by the order of the Minister of Economy and Trade. The structure of the commission will include two representatives of the Ministry of Economy and Trade, including the deputy minister of economy and trade as the commission chairman, on one representative of the Ministry of Agriculture and the food industry, Customs Service, Chamber of Commerce and Industry and the Union of sakharoproizvoditel of Moldova.

6. The decision of the commission on distribution of quota of sugar for export to Romania is reflected in the protocol which is constituted in one copy and is signed by each member of the commission.

III. Procedure for issue of permissions

7. For receipt of the export quota of sugar to Romania in prefential treatment economic agents are producers of sugar, persons interested to export it according to the quota provided by Romania the commissions submit the following documents:

statement for allocation of the export quota;

monthly reports on amounts of the sugar made from harvest of 2005 and sugar amounts in warehouse for date of filing of application;

the monthly sales plan and export of sugar prior to conversion of sugar beet of harvest of 2006, and also sugar sales volumes in the domestic market on months in 2005.

8. The certificate on the size of allocated quota is issued by the Ministry of Economy and Trade free of charge, according to the decision of the commission, for each batch.

9. The quota allocated to one economic agent - to the producer of sugar, can be transferred to other economic agentuproizvoditel of sugar in case of force majeur circumstances, with the consent of the commission.

IV. Accounting and control of implementation of export

10. The Customs Service records export of sugar and monthly, to the 5th, represents to the Ministry of Economy and Trade, the Ministry of Agriculture and the food industry and Chamber of Commerce and Industry operational data on export of sugar to Romania.

11. The economic agent having the export quota of sugar to Romania shall represent quarterly to the Ministry of Economy and Trade and Chamber of Commerce and Industry data on amounts of the sugar exported last quarter.

V. Final provisions

12. This Provision is effective only in 2006.
