Some questions of implementation of the state monitoring in the field of protection of atmospheric air

According to part two of article 32 of the Law of Ukraine "About protection of atmospheric air" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure of the state monitoring in the field of protection of atmospheric air which is applied.

2. Bring in the Regulations on the state monitoring system of the environment approved by the resolution of the Cabinet of Ministers of Ukraine of March 30, 1998 No. 391 (The Official Bulletin of Ukraine, 1998, No. 13, Art. 495; 2001, No. 55, Art. 2213, No. 81, Art. 3283; 2018, No. 76, the Art. 2537), changes which are applied.

3. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

4. To the regional public administrations and executive bodies of the Autonomous Republic of Crimea concerning protection of the surrounding environment performing the executive authority in the territory of the corresponding zone, the Kiev city public administration, to city councils which perform functions and powers of local self-government in the corresponding territory of agglomeration:

1) in three-months time from the date of entry into force of this resolution:

determine in the structure structural division or executive body which will perform functions of governing body of quality of atmospheric air according to this resolution;

submit information on certain governing bodies of quality of atmospheric air to the Ministry of environment protection and natural resources;

publish information on certain governing bodies of quality of atmospheric air in local mass media;

2) in six-months time from the date of entry into force of this resolution to provide formation of the commissions on questions of implementation of the state monitoring in the field of protection of atmospheric air and quality management of atmospheric air;

To provide 3) till July 1, 2021 for review to the Ministry of environment protection and natural resources of the program of the state monitoring in the field of protection of atmospheric air.

5. This resolution becomes effective from the date of its publication, except Item 1, which becomes effective in one year after entry into force of this resolution.

Procedure of the state monitoring in the field of protection of atmospheric air

1. This Procedure determines the mechanism of the organization and implementation of the state monitoring in the field of protection of atmospheric air, interaction central and local executive bodies and executive body of the Autonomous Republic of Crimea concerning environmental protection, local government bodies in the course of implementation of such monitoring and providing the specified bodies with information for decision making connected with condition of atmospheric air and informing the population on such condition.

2. In this Procedure terms are used in such value:

1) agglomeration - the territory with the population over 250 thousand people determined for the purposes of monitoring and quality management of atmospheric air;

2) upper limit of estimation - the level of pollutant below which for quality evaluation of atmospheric air the combination of the fixed measurements and methods of modeling or indicative measurements is used;

2-1) emissions from natural sources emissions of pollutants which are not caused directly or indirectly by anthropogenous activities, in particular owing to such natural phenomena as eruptions of volcanoes, seismic activity, geothermal activity, the fires of natural origin, strong winds, spraying of sea water, repeated suspending or transfer of natural particles from deserts and semi-deserts;

Limiting 3) size - the pollutant level determined in Item 3 appendices 2, established for the purpose of avoidance, the prevention or reduction of harmful effects on health of the person and/or the surrounding environment in general which shall be reached within the term determined by the legislation and shall not be exceeded after its achievement;

4) long-term goal - the level of ozone (pollutant) determined in appendix item 4 2, which shall be reached in the long term, for the purpose of ensuring protection of health of the person and the surrounding environment;

4-1) total amount of mercury in gaseous condition vapors of elemental mercury (Hg-0) and chemically active mercury in gaseous state, that is kinds of mercury, soluble in water, with rather high pressure of couple to have capability to exist in gaseous state;

4-2) general deposit - the lump of pollutants which settles from atmospheric air on surface in certain territory during certain time;

5) zone - the part of the territory of the state determined for the purposes of monitoring and quality management of atmospheric air;

5-1) index of quality of air in Ukraine indicator used within carrying out monitoring of atmospheric air for display of information on complex influence of levels of the main pollutants to health of the population in the format adapted for the user;

6) indicative measurements - measurements which conform to requirements for quality of data which are less strict, than requirements to the fixed measurements;

7) No. 513 Is excluded according to the Resolution of the Cabinet of Ministers of Ukraine of 07.05.2024

8) information threshold - the pollutant level determined in appendix item 4 2, exceeding of which it is connected with risk for health of the person from short-term impact on vulnerable national groups and immediate informing the population about which it is provided according to this Procedure;

9) critical level - the pollutant level determined in appendix item 4 2, in case of exceeding of which there can be direct adverse effects on some objects of the surrounding environment (trees, other plants or natural ecosystems, but not per capita);

10) laboratory of observation of condition of atmospheric air - the company, organization, the organization, their isolated or structural division which performs laboratory researches of atmospheric air and/or atmospheric precipitation;

10-1) flying organic connections - organic compounds origin from anthropogenous and natural sources, except methane which are determined in the list of Item 1 of appendix 2 and/or can form derivative connections by photochemical reaction with nitrogen oxide under the influence of sunlight;

11) lower limit of estimation - the level of pollutant below which for quality evaluation of atmospheric air methods of modeling or objective assessment are used;

11-1) nitrogen oxides (NOx) - the amount of volume ratio of concentration of nitrogen oxide and nitrogen dioxide (quantity on 1 billion particles on amount) expressed in terms of mass concentration of nitrogen dioxide (mkg / cubic meters);

12) governing body of quality of atmospheric air - the Regional State Administration, the Council of Ministers of the Autonomous Republic of Crimea performing the executive authority in the territory of the corresponding zone and also the Kiev and Sevastopol city state administration, the executive body of city council performing functions and powers of local government body in the territory of the corresponding agglomeration;
