About approval of Rules of creation and functioning of small industrial zones

1. Approve the enclosed Rules of creation and functioning of small industrial zones.

2. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of creation and functioning of small industrial zones

Chapter 1. General provisions

1. These rules of creation and functioning of small industrial zones (further – Rules) are developed according to the subitem 20) of article 11 of the Law of the Republic of Kazakhstan "About special economic and industrial zones in the Republic of Kazakhstan" (further – the Law) and determine procedure for creation and functioning of small industrial zones.

2. In Rules the following basic concepts are used:

1) social business corporation (further – regional institute) – the regional institute of development in the form of joint-stock company created according to the decision of local executive bodies of areas, cities of republican value, the capital which controlling stock the state owns performing assistance to development of economy of the region;

2) local executive body (akimat) – the collegiate executive body headed by the akim of area, city of republican value and the capital, area (city of regional value), exercising within the competence local public administration and self-government in the corresponding territory;

3) the commission – the commission on creation and functioning of small industrial zones approved and functioning the decision of the relevant local executive body based on regional coordination council, as advisory advisory body;

4) small industrial zone – the territory provided with engineering and communication infrastructure and production and other rooms (small industrial zones) put into operation for arrangement of subjects of small and medium entrepreneurship;

5) the applicant on creation of the small industrial zone (further – the applicant) – the subject of entrepreneurship performing creation of the small industrial zone;

6) resident of the small industrial zone – being the subject of small or medium business performing business activity in processing industry in the territory of the small industrial zone.

3. Small industrial zones are created on the sites put into operation of ready production rooms (small industrial zones) which are transferred to subjects of small and medium entrepreneurship according to the legislation of the Republic of Kazakhstan.

Chapter 2. Procedure for creation of small industrial zones

4. The offer on creation of small industrial zone is made in local executive body by regional chamber of entrepreneurs either the state or non-state legal entity with appendix of the concept of creation of small industrial zone.

5. The concept of creation of small industrial zone includes the following:

1) purposes of creation of small industrial zone;

2) list of selection criteria of projects of small industrial zone;

3) expected financial and economic and social effects;

4) scheme of arrangement of small industrial zone;

5) calculations of the amount of financing on implementation of actions by each component and possibility of achievement of direct and final results;

6) draft of the development plan for small industrial zone.

6. The regional coordination council (further – RKS) within 10 (ten) working days from the date of registration of the offer takes out the recommendation of feasibility of creation of small industrial zone based on consideration of the concept.

7. The decision on creation of small industrial zone is made by local executive body after the positive decision of RKS.

8. Financing of creation of small industrial zone is performed due to financing of construction of small industrial zones.

9. The local executive body within 10 (ten) working days from the moment of creation of small industrial zone informs on it the single coordination center.

10. Provision of the parcels of land for creation of small industrial zone is performed according to the regulations of the Land Code of the Republic of Kazakhstan regulating procedure for provision of the parcels of land for creation of industrial zones.

Chapter 3. Procedure for functioning of small industrial zones

11. The parcels of land which are in state-owned property on which the small industrial zone is created are provided in temporary paid land use (lease) of managing company by small industrial zone, according to the land legislation of the Republic of Kazakhstan.

12. The parcels of land on which the small industrial zone is created are provided with infrastructure facilities at the expense of the local budget and (or) other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

13. The procedure for financing of construction or reconstruction of ready production rooms are regulated by Chapter 4 of these rules.

Chapter 4. Procedure for creation of factory and other buildings (rooms) for subjects of small and medium entrepreneurship

14. Small industrial zones being factory and other buildings (rooms) for subjects of small and medium entrepreneurship are part of small industrial zones and are created in the following purposes:

1) infrastructure support of subjects of small and medium business, creation of the optimum circle for development of mass entrepreneurship;

2) creations and developments based on small industrial zones of competitive industrial productions;

3) employment and increase in the income of local population;
