1. Approve the enclosed Rules of subsidizing of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply.

2. To provide to department of realization of state policy in the field of power industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of subsidizing of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply

Chapter 1. General provisions

1. These rules of subsidizing of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply (further - Rules), are developed according to subitem 70-36) of article 5 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" and determine procedure:

subsidizings of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply.

2. In these rules the following concepts are used:

1) the administrator of the distributed budget program - the central authorized body on state planning;

2) the administrator of the local budget program - akimat of area, the cities of republican value, the capital;

3) working group - advisory advisory body, on development of offers and recommendations about provision of budgetary funds to administrators of local budget programs on subsidizing of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply;

4) the loan agreement - the agreement on implementation of the investment project between international financial institution and the receiver of subsidy;

5) the request - set of the documents constituted by the administrator of budget programs for reasons for amounts of expenses;

6) the administrator of the republican budget program - the state body performing management in the field of power industry;

7) subsidizing - provision of irrevocable payments from the republican budget to the receiver of subsidies for repayment of interest rate of remuneration for principal debt of loans of international financial institutions;

8) the receiver of subsidy - the organization in the field of production of heat energy which is the subject of natural monopoly being in utility property;

9) the tripartite agreement (agreement) - the agreement (agreement) signed by the administrator of the republican budget program with the administrator of the local budget program or the receiver of subsidy and international financial institution about projects implementation on expansion, upgrade, reconstruction, updating, maintenance of systems of power supply;

10) international financial institution (further - IFI) - the international financial institution performing provision of financial aid to legal entities in the form of loan and (or) the credit;

11) the tariff estimate - the list of the income, expenses and amounts of the provided regulated service in the form approved by the authorized body exercising state regulation and control in spheres of natural monopolies (further - authorized body);

12) investing program - the actions plan on attachment and return of the funds allocated for expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets of the subject of natural monopoly for the purpose of receipt of the technical and economic and (or) ecological effects expressed in achievement of target indicators of investing program or preserving indicators of activities of the subject of natural monopoly at the existing level.

3. For provision of subsidy the administrator of the republican budget program creates the working group which structure joins representatives of the administrator of the distributed budget program, structural divisions of the administrator of the republican budget program, the administrators of the local budget program interested state bodies and IFI.

Chapter 2. Procedure for subsidizing of costs of the organizations in the field of production of heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on upgrade of systems of power supply

Paragraph 1. Conditions for receipt of subsidies

4. Subsidizing is performed by provision of target transfers to administrators of local budget programs for the subsequent subsidizing of costs of receivers of subsidies for repayment of interest rate of remuneration for principal debt of loans of IFI.
