About approval of Rules of implementation of ground handling operations at the airports

(as amended on 24-05-2023)

According to Item 2 of article 65 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" PRIKAZYVAYU:

1. Approve the enclosed Rules of implementation of ground handling operations at the airports.

2. To provide to committee of civil aviation of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of implementation of ground handling operations at the airports

Chapter 1. General provisions

1. These rules of implementation of ground handling operations at the airports (further – Rules) are developed according to Item 2 of article 65 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" (further – the Law) and determine procedure of services of ground handling operations at the airports.

2. The main determinations and terms used in these rules:

1) airport activities – the activities performed by physical and (or) legal entities at the airports, connected with ensuring airborne transportations, aerial works, aviation safety and aviation safety;

2) management on servicing at the airport (Airport Handling Manual) – the recommendation of IATA about the standards and the equipment used in case of accomplishment of technological transactions in the course of ground handling operations of the air vehicle;

3) the operator of the airport – the legal entity of the Republic of Kazakhstan, and also foreign state according to the international treaties ratified by the Republic of Kazakhstan which uses the airport on the property right or other legal causes;

4) the user manual of the airport – the document accepted by the operator of the airport for the purpose of safety increase of flights, improvement of quality land and maintenance, and also ensuring smooth functioning of the airport;

5) services in collection and product transmission about air passengers – services in provision in authorized body and (or) law enforcement and special state bodies of data on the drawn-up and (or) booked tickets for the air transport following international flights;

6) airline – the legal entity having the air operator certificate of civil air vehicles;

7) authorized body in the field of civil aviation – the central actuator performing management in the field of use of airspace of the Republic of Kazakhstan and activities of civil and experimental aviation (further – authorized body);

8) authorized organization in the field of civil aviation – the joint-stock company with absolute participation of the state in the authorized capital performing the activities aimed at providing sustainable development of industry of civil aviation of the Republic of Kazakhstan, aviation safety and aviation safety;

9) ground handling operations – the type of airport activities performed by the operator of the airport and (or) the supplier of ground handling operations and also the airline which is independently servicing the air vehicles, passengers, baggage, load and mail;

10) the service provider of ground handling operations – the physical person or legal entity rendering services of ground handling operations on airport site, except for the operator of the airport and the airline which is independently servicing the air vehicles, passengers, baggage, load and mail;

11) independent ground handling operations (self-service) – implementation of one or several types of service of ground handling operations by airline for own needs without the conclusion of the contract with the third parties;

12) the passenger - the physical person which is not part of crew and transported on the air vehicle according to the air transport agreement or on other legal causes;

13) infrastructure facility – the property of the airport intended for rendering airport activities, including for provision of services of ground handling operations on airport site;
