About procedure of actions technical (technological, testing) nature

Based on subitem 9.4 of Item 9 of the Regulations on the Ministry of Internal Affairs of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 4, 2007 No. 611, and in pursuance of Item 2 of the resolution of Council of Ministers of the Republic of Belarus of November 30, 2012 No. 1105 "About approval of the list of actions technical (technological, testing) nature" the Ministry of Internal Affairs of the Republic of Belarus DECIDES:

1. Determine that:

1.1. inspection of objects on which activities for designing, installation, adjustment and maintenance of means and systems of protection are performed regarding compliance of such activities to requirements of technical regulatory legal acts (further if other is not established, - TNPA), inspection of technical reinforcement of objects of protection, including equipment of their equipment technical remedies, regarding compliance to requirements of TNPA, assessment of observance by the organizations, their separate divisions (further - the organizations) conditions and rules of implementation of security activities, restrictions in the field of security activities (except for subject to licensed control) (further if other is not established, - actions) are performed by employees and government employees (further - officials) Department of protection of the Ministry of Internal Affairs (further - Department of protection), regional, Minsk city managements, departments (departments) of Department of protection in areas, the cities, areas in the cities, other settlements (further if other is not established, - divisions of Department of protection) based on the instruction on holding actions technical (technological, testing) nature in form according to appendix 1, the head of the department of protection, the regional, Minsk municipal government of Department of protection signed respectively or his deputy (further - the authorized person).

Under approval the staff of territorial authorities of internal affairs can participate in actions;

1.2. when carrying out inspection of objects on which activities for designing, installation, adjustment and maintenance of means and systems of protection are performed regarding compliance of such activities to requirements of TNPA it is established:

design estimates availability with necessary marks about approval and approval, its effective period and compliance to technical solutions, requirements of TNPA, technical documentation;

compliance construction, commissioning, the applied materials, products and technical means and systems of protection to requirements of TNPA, the design estimates;

timeliness of detection of defects and violations, elimination of the revealed shortcomings;

1.3. when carrying out inspection of technical reinforcement of objects of protection, including equipment of their equipment technical remedies, regarding compliance to requirements of TNPA it is studied:

technical reinforcement of object;

need of the equipment, including in addition, technical remedies, means and systems of protection;

protection methods;

1.4. in case of assessment of observance by the organizations of conditions and rules of implementation of security activities, restrictions in the field of security activities (except for subject to licensed control) it is studied:

accomplishment by the organization of requirements of the legislation on security activities when implementing protection of the workers, protection of the objects (property) belonging to the organization;

observance by the organization and its workers of the restrictions established by the Law of the Republic of Belarus of November 8, 2006 No. 175-Z "About security activities in the Republic of Belarus";

1.5. officials perform actions for place of registration of the organization, arrangement of the inspected objects;

1.6. when holding action officials have the right, including for collection and fixing of the proofs confirming the facts of violations:

enter on objects (the territory, rooms, buildings, constructions) the organizations;

use technical means, including the equipment performing zvuko-and video film and photographing, photocopying, devices for scanning of documents;

study the design estimates, special permissions (licenses) for the works right, the certificates of conformity and other documents certifying quality of the equipment and materials, passports of technical means and systems of protection, documents (their copy) regulating procedure and confirming observance of conditions and rules of implementation of security activities by the organization;

use available means of the global computer Internet;

perform poll of employees of the organization (from their consent), visual survey of objects regarding security measures and methods of protection, technical reinforcement and so forth;

1.7. by results of holding actions the statement of holding action technical (technological, testing) nature in form according to appendix 2 is drawn up (further - the act).

The act is drawn up in duplicate and signed by the official no later than five working days from the date of the end of action with indication of signature date in time. Date of its signing is considered date of creation of the act.

The act within two working days from the date of signing is handed under the signature to the head (representative) of the organization or goes the registered mail with the assurance of receipt.

In case of the direction of the act the organization is considered the registered mail with the assurance of receipt informed properly of the act, and the act - received after three days from the date of such direction.

In case of identification of violations by the authorized person the instruction about elimination of violations at the scheduled time in form according to appendix 3 (further - the instruction) which is drawn up in duplicate is taken out.

The first copy of the instruction is handed under the signature to the head (representative) of the organization or goes the registered mail with the assurance of receipt.

In case of the direction of the instruction the organization is considered the registered mail with the assurance of receipt informed properly of the instruction, and the instruction - received after three days from the date of such direction.

Upon pronouncement of the instruction the log entry of accounting of the held events technical (technological, testing) nature, drawn up in form according to appendix 4, which is conducted including in electronic form is made.

2. This resolution becomes effective after its official publication.
