About features of introduction of separate personal data and their updating in the register of the population

Based on part two of Item 1 of article 12 of the Law of the Republic of Belarus of July 21, 2008 "About the register of the population" the Council of Ministers of the Republic of Belarus DECIDES: No. 418-Z

1. Determine that introduction of separate personal data and their updating in the register of the population is performed:

1.1. The Ministry of Internal Affairs – personal data about registration at the place of residence and (or) the place of stay of citizens of the Republic of Belarus, the foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus in change cases according to the legislation of the administrative-territorial device, address information based on the data arriving from the research and production state republican unitary enterprise "National Cadastral Agency";

1.2. The Ministry of Foreign Affairs – personal data about the death of citizens of the Republic of Belarus which records of acts of death are made by consular establishments and also diplomatic representations of the Republic of Belarus in case of accomplishment of consular functions by them (further – foreign institutions), based on the written notice of law-enforcement body in which surname, own name, middle name (if that is available), birth date, identification number of the died person, date and number of the death statement, the name of the foreign institution which made it are entered. In case of impossibility of introduction and (or) updating in the register of the population of the relevant personal data the Ministry of Foreign Affairs in writing notifies law-enforcement body with indication of the reason;

1.3. departments of civil registration of district, city executive committees and local administrations of areas in the cities, Houses (Palaces) of civil ceremonies of city executive committees (further – departments of registry office) – personal data of citizens of the Republic of Belarus, the foreign citizens and persons without citizenship who are constantly living in the Republic of Belarus from the civil registrations made before entry into force of the Law of the Republic of Belarus "About the register of the population" and which are stored in departments of registry office:

about annulment of marriage which registration is made by bodies of registry office which competence according to parts one and third article 198 of the Code of the Republic of Belarus about scrap and family it treats based on the written notice of law-enforcement body in which surnames are entered, own names, middle names (if those are available), birth dates of persons which dissolved marriage, their identification numbers, date and number of record of the act of annulment of marriage, the name of body of the registry office which made it.

surname, own name, middle name (if that is available), floor, birth date and identification number of the minor child, date and number of the birth statement, the name of body of the registry office which made it;

the surname, own name, middle name (if that is available) the father of the minor child specified in the certificate of birth, its birth date and identification number (in the presence);

If in the course of introduction and (or) updating in the register of the population of the personal data specified in paragraph three of part one of this subitem it is determined that in record of the act of marriage of persons specified in the written notice of law-enforcement bodies the mark about annulment of marriage is made, then data on registration of annulment of marriage (number and date of record of the act of annulment of marriage, body of registry office, it made) are subject to introduction and (or) updating in the register of the population in case of finding of record of the act of annulment of marriage stored in this department of registry office. In this case the department of registry office in writing notifies law-enforcement body on introduction and (or) updating in the register of the population of data on registration of annulment of marriage.

If in record of the act of marriage of persons specified in the written notice of law-enforcement bodies the mark about registration of annulment of marriage by other body of registry office or that marriage is dissolved, nullified based on the judgment which took legal effect is made, the department of registry office in writing notifies law-enforcement body on availability of these data with indication of number and date of record of the act of annulment of marriage, the name of body of the registry office which made it or the name of court and date of decision about annulment of marriage, scrap recognition invalid.

Departments of registry office within 10 working days from the date of receipt of written notices from law-enforcement bodies of introduction and (or) updating in the register of the population of the personal data provided in paragraphs the second or fourth part one, part two of this subitem enter personal data in case of complete coincidence to the personal data containing in record of the act of civil status.

About introduction and (or) updating of personal data in the register of the population by the department of registry office in the column "For Other Marks" of record of the act of civil status makes record about date of introduction and (or) updating of personal data in the register of the population based on the written notice of law-enforcement body with indication of date and registration number. When entering into the register of the population of the personal data provided in part two of this subitem, department of registry office in the column "For Other Marks" of the birth statement also identification number of the minor child is specified. The department of registry office no later than one working day following behind day of entering into the register of the population of the personal data provided in part two of this subitem sends information on it to the relevant archive of the bodies registering acts of civil status, head department of justice of regional executive committee, the Minsk Gorispolkom for entering into the second copy of the birth statement of the child of the data determined in this part.

In case of impossibility of introduction and (or) updating in the register of the population of the relevant personal data the department of registry office in time established in part five of this subitem in writing notifies law-enforcement body with indication of the reason.

Written notices of department of registry office are signed by the head of department of registry office with indication of surname and initials (in its absence – person, it replacing) and sealed department of registry office with the image of the State Emblem of the Republic of Belarus.
