About application of the Law of the Azerbaijan Republic "About power industry"

Due to the entry into force of the Law of the Azerbaijan Republic "About power industry" for the purpose of ensuring application of this Law I decide:

1. To the Cabinet of Ministers of the Azerbaijan Republic within two months:

prepare and provide to the President of the Azerbaijan Republic offers on approval of the existing legal acts of the Law of the Azerbaijan Republic "About power industry";

provide approval of regulatory legal acts of the Cabinet of Ministers of the Azerbaijan Republic and the relevant central executive bodies of the specified Law and report on it on the President of the Azerbaijan Republic;

resolve other issues following from the Law of the Azerbaijan Republic "About power industry" within the powers.

2. Determine that:

powers of the relevant organ of the executive authority provided by the name, the first and second (in the first case) offers of Article 4-1, the second offer of part one of Article 11, the fifth part of article 22 of the Law of the Azerbaijan Republic "About power industry", are performed by the President of the Azerbaijan Republic;

powers of the relevant organ of the executive authority provided by the second offer of part three of article 3 of the specified Law, concerning connection of the construction objects of entrepreneurs existing or planned to construction to electric utility power grid capacity to 150 kilowatts (150 kilowatts inclusive from the existing 0,4 of kV - oh networks) or issues of specifications for receipt of additional energy (force) the President of the Azerbaijan Republic, in other cases performs the Cabinet of Ministers of the Azerbaijan Republic;

powers of the "relevant organ of the executive authority" provided in the fifth paragraph the fourth and sixth parts of Article 8, in the third part of Article 21 and in article 24 of the specified Law, are performed by the Cabinet of Ministers of the Azerbaijan Republic;

in the second offer of the first part of article 11 of this Law "the body (structure)" is meant as the Cabinet of Ministers of the Azerbaijan Republic;

powers of the relevant organ of the executive authority provided by the second (in the second case) the offer of article 4-1 of the specified Law, are performed by the Department of Energy of the Azerbaijan Republic;

powers of the "relevant organ of the executive authority" provided in the first part of article 8 of the specified Law of the Azerbaijan Republic "About power industry" are performed by the local executive authorities;

powers stipulated in Article 4 concerning the second, fifth and sixth paragraphs, parts three (in coordination with the Cabinet of Ministers of the Azerbaijan Republic), the fourth and fifth Article 5, Article part two 6, Article part six 8, article 9 of the specified Law of "relevant organ of the executive authority" are performed by the Department of Energy of the Azerbaijan Republic;

powers provided by the fifth paragraph of article 10 of the specified Law of "relevant organs of the executive authority" perform the Department of Energy of the Azerbaijan Republic, the Ministry of Economics  of the Azerbaijan Republic and the Ministry of Finance of the Azerbaijan Republic according to the joint arrangement;

powers stipulated in Article 4 concerning the fourth paragraph of the specified Law of "relevant organ of the executive authority" are performed by Tariff (price) council of the Azerbaijan Republic;

powers stipulated in Article 13 specified the Law of "relevant organ of the executive authority" perform the Department of Energy of the Azerbaijan Republic, the Ministry of Emergency Situations of the Azerbaijan Republic and Open joint stock company of melioration and water economy of Azerbaijan within the powers;

powers stipulated in Article 4 specified the Law of "relevant organs of the executive authority" in the agreements noted in the third paragraph concerning the conclusion granting the right to transportation and distribution of electrical and heat energy within certain territory (including agreements in the field of alternative and renewable energy), are performed by the Department of Energy of the Azerbaijan Republic, concerning price regulation (rates) for electrical and heat energy jointly approve the Ministry of Economics of the Azerbaijan Republic, the Ministry of Finance of the Azerbaijan Republic, the Department of Energy of the Azerbaijan Republic, and performs Tariff (price) council of the Azerbaijan Republic;

powers stipulated in Article 4 specified the Law of "relevant organs of the executive authority" concerning the seventh paragraph are performed by the Department of Energy of the Azerbaijan Republic, in the field of observance of safety requirements - the Ministry of Emergency Situations of the Azerbaijan Republic;

powers of the "relevant organ of the executive authority" provided by the second offer of part eight of article 8 of the specified Law in the part determining procedure are performed by the Cabinet of Ministers of the Azerbaijan Republic, in the part determining payment performs Tariff (price) council of the Azerbaijan Republic;

under "structure" the Agency on regulation of energy questions is provided in the name, the first offer of article 4-1 of the specified Law;
