About approval of the Regulations on the central commission on development of fields of uranium of the Republic of Kazakhstan

1. Approve the enclosed Regulations on the central commission on development of fields of uranium of the Republic of Kazakhstan.

2. To provide to department of subsurface use of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Regulations on the central commission on development of fields of uranium of the Republic of Kazakhstan

Chapter 1. General provisions

1. This Regulations on the central commission on development of fields of uranium of the Republic of Kazakhstan (further - the Provision) are developed according to Item 3 of article 183-1 of the Code of the Republic of Kazakhstan "About subsoil and subsurface use" (further - the Code) and determine the organization of activities, structure, the regulations of work and record keeping of the central commission on development of fields of uranium of the Republic of Kazakhstan (further - the central commission).

2. The main objective of the central commission is implementation of state examination of project documents in the field of production of uranium with involvement of the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination.

According to Item 1 of article 182 of the Code, project documents for carrying out transactions on production of uranium are the project of trial production of uranium, the project of mining of uranium and the project of mitigation of consequences of production of uranium.

Chapter 2. Organization of activities of the central commission on development of fields of uranium of the Republic of Kazakhstan

Paragraph 1. Structure of the central commission on development of fields of uranium of the Republic of Kazakhstan

3. The structure of the central commission affirms the head of authorized body in the field of uranium production, in case of its absence, the acting as the head of authorized body in the field of uranium production.

4. In number of at least 5 (five) persons are part of the central commission: representatives of the interested state bodies, representatives of National chamber of entrepreneurs of the Republic of Kazakhstan, specialists of the research, project organizations, the organizations specializing in geology, geophysics, hydrogeology, development of fields, in the economic and legal issues of subsurface use and which are not interested in results of examination.

Paragraph 2. Functions of the central commission on development of fields of uranium of the Republic of Kazakhstan

5. The central commission performs the following functions:

1) considers project documents and performs state examination according to the project documents (changes and (or) amendments to them) submitted by subsoil users or analyses of development of fields of uranium;

2) is provided by application in project documents of the most effective and rational methods and technologies of production of uranium and development of fields of uranium;

3) considers developments and reports of the research, project organizations, subsoil users on subsurface use, to rational and complex use of fields of uranium;

4) requests from the research, project organizations, the national company in the field of uranium and subsoil users reference, information materials and reports on questions of subsurface use, rational and complex use of fields of production of uranium;

5) if necessary recommends to authorized body to create working groups in the field of production of uranium;

6) issues recommendations about completion of the project document;

7) attracts the independent experts having special knowledge in the field of geology and subsurface use and who are not interested in results of examination.

6. The chairman of the central commission, and in case of its absence - the vice-chairman:

1) performs the common directorship of activities of the central commission;

2) plans work of the central commission;

3) presides over meetings of the central commission.

7. Secretary of the central commission:

1) checks completeness of the submitted documents according to Item 9 of this provision;

2) in 7 (seven) working days prior to date of meeting of the central commission in writing or by e-mail notifies members of the central commission on date and the venue of meeting;

3) performs preparation of materials for holding meeting of the central commission;

4) is drawn up by the state expert opinion in any form by results of meeting of the central commission;

5) is not member of the central commission.

8. The clerical work, collection and storage of materials and documents of the central commission is performed by the relevant structural division of authorized body in the field of uranium production.
