According to subitem 8-8) of article 37-1 of the Water code of the Republic of Kazakhstan of July 9, 2003 and subitem 5-5) of article 5-1 of the Law of the Republic of Kazakhstan of July 9, 2004 "About power industry" PRIKAZYVAYU:

1. Approve the enclosed Rules of subsidizing of costs of the organizations of water supply and water disposal, and the organizations in the sphere of transfer and supply of electrical energy, transfer and supply with heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements.

2. To provide to committee on cases of construction and housing and communal services of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the established legislative procedure:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of subsidizing of costs of the organizations of water supply and water disposal, and the organizations in the sphere of transfer and supply of electrical energy, transfer and supply with heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements (further – Rules) are developed according to subitem 8-8) of article 37-1 of the Water code of the Republic of Kazakhstan and subitem 5-5) of article 5-1 of the Law of the Republic of Kazakhstan "About power industry" and determine procedure:

subsidizings of costs of the organizations of water supply and water disposal on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements for the account and within the means provided in republican and local budgets for the corresponding financial year;

subsidizings of costs of the organizations in the sphere of transfer and supply of electrical energy, transfer and supply with heat energy on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets.

2. In these rules the following concepts are used:

1) the administrator of local budget programs – the public institution authorized by akimat of area, the cities of republican value and the capital on the implementation of separate functions in the field of water supply and water disposal, transfer and supply with electrical and heat energy financed from local budgets;

2) working group – advisory advisory body, on development of offers and recommendations about provision of budgetary funds for subsidizing of costs of the organizations of water supply and water disposal, and the organizations in the sphere of transfer and supply of electrical energy, transfer and supply with heat energy, on repayment and servicing of loans of the international financial institutions attracted to projects implementation on expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets in settlements;

3) investing program – the actions plan on investment and return of the funds allocated for expansion, upgrade, reconstruction, updating, maintenance of the existing assets and creation of new assets of the subject of natural monopoly for the purpose of receipt of the technical and economic and (or) ecological effects expressed in achievement of target indicators of investing program or preserving indicators of activities of the subject of natural monopoly at the existing level;

4) the credit agreement – the contract on implementation of the investment project between international financial institution and the receiver of subsidy;

5) the request – set of the documents constituted for reasons for amounts of expenses;
