1. Approve the enclosed Administrative regulations of the Federal Service of troops of national guard of the Russian Federation on provision of the state service in licensing of private detective activities <5>.

Administrative regulations of the Federal Service of troops of national guard of the Russian Federation on provision of the state service in licensing of private detective activities

I. General provisions

Subject of regulation of regulations

1. These Administrative regulations of the Federal Service of troops of national guard of the Russian Federation determine terms and the sequence of ministerial procedures (actions) of officials of territorial authorities of Rosgvardiya for provision of the state service in licensing of private detective activities by provision of the state service in licensing of private detective activities <1> <2>.

2. Applicants on receipt of the state service <3> are:

2.1. The citizens of the Russian Federation registered as the individual entrepreneur, applying for receipt of the license for implementation of private detective activities <4>.

Requirements to procedure for informing on provision of the state service

3. The procedure for receipt by applicants of information on questions of provision of the state service includes:

3.1. Informing concerning provision of the state service, including data on the course of its provision (it is performed directly in premises of territorial authorities of Rosgvardiya <1> (the centers of licensed and allowing work of <2> licensing authorities), and also on the telephone number for enquiries (phone answerphone), with use of mass media and in the federal state information system "Single Portal of the State and Municipal Services (Functions)" <3>;

informing on working hours of the licensing body, the address of its location, addresses of the Single portal and the official site of Rosgvardiya on the Internet <4> (it is performed by means of phone answerphone which works round the clock);

informing on procedure for accomplishment of ministerial procedures and the course of provision of the state service (it is performed by the employee of the licensing body to whom implementation of ministerial procedures on provision of the state service <5> is assigned, in case of the personal address of the applicant, and also with use of Internet network, mail service or by phone).

In case of the response to phone call the employee shall call the name of the licensing body, surname, name, middle name (the last - in the presence) and position.

Time of conversation shall not exceed 10 minutes.

In case of impossibility to answer independently the questions posed the employee shall report telephone number according to which it is possible to obtain necessary information.

3.2. Reference information <6> which is posted on the official site of Rosgvardiya in Internet network, in the federal state information system "Federal Register of the State Services and Municipal Services (Functions)" <1>, on the Single portal, and also at information stands in premises of TsLRR of licensing authorities.

5. The state service is provided by territorial authorities of Rosgvardiya.

6. It is forbidden to demand from the applicant of implementation of actions the, including coordination necessary for receipt of the state service and connected with the appeal to other state bodies and the organizations, except for receipts of the services included in the list of services which are federal executive bodies, State Atomic Energy Corporation "Rosatom" of the state services, necessary and obligatory for provision, and are provided by the organizations participating in provision of the state services, No. 352 <2> approved by the order of the Government of the Russian Federation of May 6, 2011.

7. Is result of provision of the state service:

provision/refusal in provision of the license for private detective activities <1>;

renewal/refusal in renewal of the license;

issue of the duplicate and (or) copy of the license;

cancellation of the license according to the statement of the licensee;

provision of data on the specific license.

Along with provision of the license (prolongation of effective period of the license, renewal of the license, issue of the duplicate of the license) for the term of her (his) action the certificate of the private detective <2>, the stipulated in Item 52 presents of Administrative regulations is issued.

8. Terms of provision (suspension) of the state service and issue (direction) of the documents which are result of provision of the state service:

8.1. Decision making about provision / about refusal in provision of the license is performed no more than 45 calendar days from the date of receipt in the licensing body of properly issued application and documents provided by subitem 10.1 of Item 10 of these Administrative regulations in time>.

8.2. Decision making about prolongation / about refusal in prolongation of effective period of the license or about renewal / about refusal in renewal of the license is performed no more than 30 calendar days from the date of receipt in the licensing body of properly issued application and documents provided by subitems 10.2 or 10.3 of Item 10 of these Administrative regulations <1> in time.

8.3. Suspension of provision of the state service in the bases, stipulated in Item the 16th these Administrative regulations, is performed for the term of no more than 30 calendar days <2>.

8.4. Decision making about cancellation of the license is accepted by the licensing body within 10 working days from the date of the registration of a statement and documents provided by subitem 10.5 of Item 10 of these Administrative regulations.

8.5. Issue (direction) of the license or the notification on refusal provided by subitem 51.2 of Item of 51 presents of Administrative regulations is performed within 3 working days from the date of adoption of such decision.

8.6. Issue (direction) of the duplicate and (or) copy of the license is performed within 3 working days from the date of the registration of a statement and documents provided by subitem 10.4 of Item 10 of these Administrative regulations.

8.7. Issue (direction) of the termination letter of action of the license, the stipulated in Item 123 presents of Administrative regulations, is performed within 3 working days from the date of decision making about the cancellation of the license, according to the procedure, provided by Items 124 - the 126th these Administrative regulations.

8.8. Issue (direction) of data on the specific license in the form of the statement from the register of licenses, the stipulated in Item 134 presents of Administrative regulations, or copy of the act of the licensing body of the made decision, or certificates of lack of required data is performed within 5 working days from the date of registration of a statement, the Item 10 of these Administrative regulations provided by subitem 10.6.

10. For provision of the state service are represented:

10.1. For receipt of the license:

statement for provision of the license (appendix No. 1 to these Administrative regulations);

identity document of the citizen of the Russian Federation in the territory of the Russian Federation <1>;

2 photos of 4 x 6 cm in size;

the medical certificate about lack of medical contraindications to implementation of private detective activities including chemical and toxicological researches of availability in human body of drugs, psychotropic substances and their metabolites <2>;

the documents confirming availability of secondary professional legal education or the higher legal education or passing of professional training for work as the private detective or length of service in operational or investigative divisions at least three years.

10.2. For prolongation of effective period of the license:

statement for prolongation of effective period of the license (appendix No. 3 to these Administrative regulations);

identity document;

2 photos of 4 x 6 cm in size;

medical certificate;

original of the license.

10.3. For renewal of the license:

statement for renewal of the license (appendix No. 4 to these Administrative regulations);

identity document;

2 photos of 4 x 6 cm in size;

original of the license.

10.4. For provision of the duplicate and (or) the copy of the license:

statement for issue of the duplicate and (or) copy of the license (appendix No. 5 to these Administrative regulations);

identity document;

2 photos of 4 x 6 cm in size (for provision of the duplicate of the license);

the damaged form of the license (the document confirming license availability) in case of its spoil and the certificate of the private detective (for provision of the duplicate of the license).

10.5. For cancellation of the license:

the statement for the termination of the licensed type of activity (appendix No. 6 to these Administrative regulations);

identity document.

10.6. For receipt of data on the specific license:

statement for provision of data on the specific license (appendix No. 7 to these Administrative regulations);

identity document;

identity documents and powers of the representative who addressed to the licensing body on behalf of the interested person wishing to receive data on the specific license (in case of the address of the representative).

11. Copies of documents, stipulated in Item the 10th these Administrative regulations, not certified in accordance with the established procedure, are represented together with originals.

If the documents provided by subitems 10.1 - 10.5 Items 10 of these Administrative regulations, were submitted earlier by the licensee to the licensing body, documents are valid and the data reflected in them did not change, repeated submission of such documents is not required.

12. Applicants have the right to submit in the licensing body applications, stipulated in Item the 10th these Administrative regulations, both on paper, and electronically with use of the Single portal, taking into account requirements, the stipulated in Item 32 presents of Administrative regulations.

The exhaustive list of the documents necessary according to regulatory legal acts for provision of the state service which are at the disposal of the state bodies, local government bodies and other bodies participating in provision of the state or municipal services and which the applicant has the right to provide, and also methods of their obtaining by applicants, including electronically, procedure for their representation

13. The license applicant (licensee) has the right to provide to the licensing body on own initiative:

the documents confirming payment of the state fee <1> for provision of the state service <2>;

14. It is forbidden to demand from applicants:

submission of documents and information or implementation of actions, representation or implementation of which is not provided by the regulatory legal acts governing the relations arising in connection with provision of the state service;

submissions of documents and information which according to regulatory legal acts of the Russian Federation, regulatory legal acts of subjects of the Russian Federation and municipal legal acts are at the disposal of the licensing body, other state bodies, local government bodies and (or) subordinated to state bodies and local government bodies of the organizations participating in provision of the state or municipal services, except for documents, specified in part 6 of article 7 of the Federal Law of July 27, 2010 to No. 210 "About the organization of provision of the state and municipal services" <4>;
