1. Approve the enclosed Rules of use of the prices (rates) for obligatory services of seaport.

2. To provide to committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of use of the prices (rates) for obligatory services of seaport

Chapter 1. General provisions

1. These rules of use of the prices (rates) for obligatory services of seaport are developed according to subitem 55-42) of Item 3 of article 4 of the Law of the Republic of Kazakhstan of January 17, 2002 "About merchant shipping" and determine procedure for use of the prices (rates) for obligatory services of seaport.

2. The list of obligatory services of seaport, is approved by the order of the Minister of investments and development of the Republic of Kazakhstan of January 30, 2015 No. 77 "About approval of the List of obligatory services of seaport" (it is registered in the Register of state registration of regulatory legal acts for No. 10906) (further - the List of obligatory services).

3. Rates for obligatory services of seaport for tankers are regulated by the authorized body performing management in spheres of natural monopolies.

4. In these rules the following concepts are used:

authorized body - the central actuator performing management in the field of merchant shipping and also in limits, stipulated by the legislation the Republic of Kazakhstan, - cross-industry;

risk coefficient - additional percent to rates for services of seaport in connection with probability of emergence of emergency incident and the allowance for additional efforts when servicing the old vessel.

Chapter 2. Procedure for use of the prices (rates) for obligatory services of seaport

1) the Price (rate) for ship services is applied in case of each port entry and exit of the vessel from port and established for each gross-register ton of the vessel.

2) Use of services of the navigation center is performed on paid basis at the prices (rates) approved by authorized body according to Item 1 of article 156 of the Law of the Republic of Kazakhstan "About state-owned property".

The procedure for rendering navigation services with use of traffic control system of courts is performed according to Rules of swimming and the parking of courts in seaports of the Republic of Kazakhstan and on approaches to them, approved by the order of the acting minister on investments and development of the Republic of Kazakhstan of February 24, 2015 No. 162 (it is registered in the Register of state registration of regulatory legal acts for No. 12193).

The price (rate) for use of services of the navigation center is established for unit of the gross tonnage of the vessel specified in the certificate of measurement of the vessel and applied for calling of the vessel the action area of traffic control system of courts and separately for vessel exit from the action area of traffic control system of courts.

Calculation of the price (rate) for use of services of the navigation center is made for the courts which do not have the certificate of measurement on the conditional amount of the vessel calculated in cubic meters by the work of three sizes of the vessel – the extreme length, the extreme breadth and the extreme wave height of board of the vessel specified in ship's papers using 0,35 coefficient.

Gross tonnage of barge trains, caravans and other compound floating objects (including rafts) when calculating amount of services of the navigation center is determined as the amount of gross tonnages of all elements of compound floating objects. In the absence of gross tonnage at floating objects calculation is made on conditional amount of the floating object calculated in cubic meters by the work of three sizes – the extreme length, the extreme breadth and the extreme wave height of floating object specified in ship's papers or other documents of floating object using 0,35 coefficient.

The prices (rates) for navigation services of Aktau port (use of means of navigation situation) are applied in case of each port entry and exit of the vessel from port and established for each gross-register ton of the vessel.

The price (rate) for services of the navigation center is not applied to warships and vessels of Naval forces of Armed Forces of the Republic of Kazakhstan and the Border service of Committee of homeland security of the Republic of Kazakhstan, and also the courts attracted by state bodies to taking measures to the prevention and (or) liquidation of emergency situations of natural and technogenic nature, participation in actions for increase in LOC ARM by it (doctrines, trainings).

3) the Price (rate) for pass by the channel is applied in case of each passing of the channel one way and established for each gross-register ton of the vessel.

4) the Price (rate) for use of the mooring under cargo operations is applied for the parking of the vessel at the mooring under cargo operations and established on each gross-register ton of the vessel and made from the courts which are lying alongside (excepting mooring berth).
