About payment terms of work of employees of cultural institutions, arts and information

For the purpose of streamlining of payment terms of work of employees of cultural institutions, art and information, according to articles 10 and 17   of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Approve:

- Regulations on payment terms of work of employees of cultural institutions, arts and information according to appendix 1;

- official pay rates of employees of republican, regional, district, city and rural libraries according to appendix 2;

- official pay rates of employees of the republican, regional, district, city and rural museums according to appendix 3;

- official pay rates of employees of club organizations according to appendix 4;

- official pay rates of employees of the Kyrgyz national academic opera and ballet theater of A. Maldybayev, philharmonic halls, the Kyrgyz state circus of Abubakir Izibayev and Kyrgyz state academic symphonic orchestra of A. Dzhumakhmatov according to appendix 5;

- official pay rates of employees of drama and musical and drama theaters, the Kyrgyz state Theatre for Young Audience of the name Kydykeeva's Beacon and Puppet Theatres according to appendix 6;

- official pay rates of employees of the regional media centers and Public regional broadcasting company "Yntymak" according to appendix 7;

- official pay rates of employees of the editorial offices of the children's magazine "Baychechekey", the Zhetkinchek newspaper and Kyrchyn magazine according to appendix 8;

- official pay rates of employees of centralized accounts departments under organizations and the organizations of culture, art and information according to appendix 9;

- official pay rates of workers of the National film studio Kyrgyzfilm of T. Okeev according to appendix 10;

- official pay rates of workers of the Republican state filmofond and Directorate of the Republican house of cinema of Chinghiz Aitmatov according to appendix 11;

- official pay rates of employees of regional, city and district film directorates according to appendix 12.

2. Establish the frequency rate coefficient to official pay rates applied in case of determination of the sizes of official pay rates of employees of the Kyrgyz national academic opera and ballet theater of A. Maldybayev, the Kyrgyz national philharmonic hall of T. Satylganov, Kyrgyz state academic symphonic orchestra of A. Dzhumakhmatov, the Kyrgyz national academic drama theater of T. Abdumomunov, the State national Russian drama theater of Chinghiz Aitmatov, the Osh national drama theater of S. Ibraimov, the National historical museum of the Kyrgyz Republic, the Kyrgyz national museum of Fine Arts of G. Aytiyev, the National historical and archaeological museum Sulaiman-Too complex, the National film studio Kyrgyzfilm of T. Okeev Departament of cinematography under the Ministry of Culture, information and tourism of the Kyrgyz Republic - in the amount of 1,8.

-  the order of the Government of the Kyrgyz Republic "About entering of amendments and changes into  the order of the Government of the Kyrgyz Republic "About questions of compensation of employees of cultural institutions, arts and information" of May 31, 2011 No. 268" of January 31, 2012 No. 66;

-  the order of the Government of the Kyrgyz Republic "About entering of amendment and change into some decisions of the Government of the Kyrgyz Republic" of August 17, 2012 No. 572;

-  the order of the Government of the Kyrgyz Republic "About entering of amendment and changes into  the order of the Government of the Kyrgyz Republic "About questions of compensation of employees of cultural institutions, arts and information" of May 31, 2011 No. 268" of February 1, 2016 No. 42;

4. To the Ministry of Culture, information and tourism of the Kyrgyz Republic:

- bring the decisions into accord with this resolution;

- take the adequate measures following from this resolution.

5. To impose control of execution of this resolution on department of education, culture and sport of Government office of the Kyrgyz Republic.

6. This resolution becomes effective after seven days from the date of official publication.

Appendix 1

to the Order of the Government of the Kyrgyz Republic of August 27, 2019 No. 429

Regulations on payment terms of work of employees of cultural institutions, arts and information

Chapter 1. General provisions

1. This Regulations on payment terms of work of employees of cultural institutions, arts and information (further - the Provision) establish bases of legal regulation of the relations arising in the sphere of compensation of employees of cultural institutions, arts and information.

2. In this Provision the following concepts are applied:

the official pay rate is the fixed amount of compensation of workers for execution of job responsibilities of certain complexity for calendar month, without the compensatory, stimulating and social payments;

the salary is remuneration for work depending on qualification of the worker, complexity, quantity, quality and conditions of the performed work;

compensation payments are payments for compensation to workers of the additional expenses connected with execution of labor or job responsibilities;

the stimulating payments are the payments directed to stimulation of the worker to high-quality and timely result of work. Payments of the stimulating nature are established to workers taking into account the criteria allowing to estimate effectiveness and quality of their work;

accord compensation - kind of price-work form of the salary of workers, is paid for completely performed work which amount is in advance stipulated in the agreement;

standard states are limit rate of streamlining of the number of staff of organizations.

3. The sizes of official pay rates of employees of cultural institutions, arts and information are established by the decision of the Government of the Kyrgyz Republic.

4. The salary of employees of cultural institutions, arts and information is estimated taking into account accomplishment of regulation of working hours. The size of the salary is determined proceeding from official pay rates, taking into account payments of the compensatory and stimulating nature. All payments specified in this Provision are estimated in the established sizes only from official pay rate, without other increases and payments (except for surcharges which are provided by the labor law of the Kyrgyz Republic).

5. The sizes and procedure for application of district coefficients for work in the mountain and remote areas, and also other payments to cultural workers, the arts and information which are not specified in this Provision are established according to the legislation of the Kyrgyz Republic on guarantees and compensations for the persons living and working in the conditions of highlands and the remote remote zones and the labor law.

6. Heads of cultural institutions, arts and information, if necessary, can apply contractual form of hiring of workers within the salary fund.

7. The head of the National film studio Kyrgyzfilm of T. Okeev can apply accord payment method of work within salary fund of workers to whom it is applied.

8. Responsibility for timely and proper establishment of the sizes of the salary of employees of cultural institutions, arts and information is assigned:

- on the organizations financed from the republican budget - on heads of cultural institutions, arts and information, and on the organizations served by centralized accounts department - on the main manager of the credits with the right of the first signature;

- on the organizations financed from the local budget - on district finance divisions of local government bodies.

9. This Provision does not extend to the government civil and local government officers and employees of other governing bodies in system of culture, art and information for which regulatory legal acts of the Kyrgyz Republic determine other procedure for salary accrual.

Chapter 2. Compensation payments to official pay rates of employees of cultural institutions, arts and information

10. In system of culture, art and information compensation payments to official pay rates of workers, taking into account conditions, specifics of work in the separate organizations, divisions are established.

11. Allowances belong to compensation payments for:

- work in the mountain, remote and remote zones of the Kyrgyz Republic;

- work in special conditions;

- work outside the normal duration of working hours (combining jobs or overtime work).

12. Allowances for work in the mountain, remote and remote zones, and also in special conditions are paid for work according to the legislation on guarantees and compensations for the persons living and working in the conditions of highlands and the remote remote zones.

13. Allowances outside the normal duration of working hours (combining jobs or overtime work) are paid for work according to the labor law of the Kyrgyz Republic.

Chapter 3. The stimulating payments to official pay rates of employees of the organizations of culture, art and information

14. In system of culture, art and information the stimulating payments to official pay rates of workers for the purpose of performance improvement of work, professional and qualitative indexes are established.

15. Allowances belong to the stimulating payments for:

- length of service;

- academic degree;

- honorary title "National" or "Deserved";

- status "national" or honorary title "academic" organizations and organizations;

- high-quality results of work taking into account effectiveness stimulation coefficients.
