Chapter 1. General provisions

Article 1. Purpose of this Law

The purpose of this Law is regulation of the relations in the field of use of atomic energy in the peace purposes (further - use of atomic energy).

Article 2. Legislation on use of atomic energy

The legislation on use of atomic energy consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about use of atomic energy then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

atomic energy - the energy containing in atomic kernels and which is marked out in case of nuclear reactions and radioactive decay;

nuclear power - the power industry which is engaged in production of electrical and heat energy by transformation of atomic energy;

complete "vital" cycle of subject to use of atomic energy - research, placement, design, designing, production, construction (including installation, commissioning, commissioning), operation, reconstruction, repair, survey of technical devices, buildings and constructions, conclusion from operation (closing), transportation (transportation), storage, conversion and burial of the corresponding subjects to use of atomic energy;

spent nuclear fuel - the nuclear material which is finally removed from active zone of the nuclear reactor and on technical characteristics not held for use in nuclear installation;

radiation sources - the complexes which are not relating to nuclear installations, installations, devices, the equipment and products which contain radioactive materials or ionizing radiation is generated;

radioactive materials - the substances which are not relating to nuclear materials emitting ionizing radiation;

radioactive waste - materials and substances in any aggregate state, not the held for use, containing radionuclides with the activity level exceeding maximum permissible values;

storage Items - the stationary objects and constructions which are not relating to nuclear installations and intended for storage of nuclear materials and radioactive materials, storage or burial of radioactive waste;

nuclear fuel - the nuclear material intended for receipt of heat energy and (or) flows of radiation in nuclear installation due to implementation of controlled nuclear reaction of division;

nuclear materials - the materials containing or capable to reproduce the sharing (split) nuclear substances;

the heat-generating assembly of the nuclear reactor - the product containing nuclear materials and intended for receipt of heat energy in the nuclear reactor due to implementation of controlled nuclear reaction;

nuclear installations - nuclear power plants, constructions and complexes with research nuclear reactors, critical and subcritical nuclear stands, installations for use and transportation of nuclear fuel and nuclear materials.

Article 4. Basic principles of use of atomic energy

The basic principles of use of atomic energy are:

priority of protection of life and health of citizens, property of physical persons and legal entities, and also environmental protections;

safety;

availability of information;

prohibition on production of nuclear weapon and other nuclear destructive devices.

Article 5. Subjects to use of atomic energy

Treat subjects to use of atomic energy:

nuclear installations;

storage Items;

nuclear materials;

radiation sources;

radioactive materials;

nuclear fuel;

the heat-generating assemblies of nuclear reactors;

spent nuclear fuel;

radioactive waste.

Article 6. Property right to subjects to use of atomic energy

Subjects to use of atomic energy can be in state-owned property or in property of the legal entities determined by the President of the Republic of Uzbekistan. The list of subjects to use of atomic energy which can be in state-owned property or property of legal entities affirms the President of the Republic of Uzbekistan.

Owners of subjects to use of atomic energy ensure their safety and use according to their appointment.

Transactions of legal entities of the Republic of Uzbekistan about transfer of property on nuclear materials, and also spent nuclear fuel, to foreign state or the legal entity of foreign state, consist in coordination with the President of the Republic of Uzbekistan.

Transactions about transfer of subjects to use of atomic energy to property of the legal entities who are not included in the list provided by part one of this article, and also transaction of legal entities of the Republic of Uzbekistan about transfer of property on the nuclear materials, spent nuclear fuel to foreign state or the legal entity of foreign state concluded with violation of requirements of part three of this Article are insignificant.

Article 7. Types of activity in the field of use of atomic energy

In the field of use of atomic energy treat types of activity:

research, placement, design, construction, operation and conclusion from operation of nuclear installations and (or) Items of storage;

construction, operation and conclusion from operation of radiation sources;

designing and production of the equipment for nuclear installations and (or) Items of storage;

conducting examination of reasons for safety of subjects to use of atomic energy and (or) activities in the field;

treatment of radioactive materials, nuclear materials and radioactive waste;

providing nuclear, radiation, industrial, fire and ecological safety of subjects to use of atomic energy;

carrying out scientific research in the field;

ensuring physical protection of subjects to use of atomic energy;

implementation of the state supervision and control in the field;

import and export of nuclear materials, the equipment and technologies for nuclear installations and (or) Items of storage;

rendering services in the field;

monitoring of radiation situation;

preparation, retraining and advanced training of personnel in the field.

Other types of activity also can be carried to types of activity in the field of use of atomic energy.
