About the organization and functioning of some public, theatrical and concert institutions

Based on Item e) parts (1) article 6 of the Law No. 121/2007 on management of public property and its privatization (The official monitor of the Republic of Moldova, 2007, Art. No. 90-93, 401), parts (1) article 10 of the Law No. 1421/2002 on theaters, circuses and the concert organizations (The official monitor of the Republic of Moldova, 2002, Art. No. 174-176, 1331), article 32 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537) and article 12 of the Law No. 246/2017 on the state and municipal companies (The official monitor of the Republic of Moldova, 2017, Art. No. 441-450, 750) DECIDES: the Government

1. Reorganize by transformation:

1) State company "National Opera and Ballet Theatre of Maria Biyeshu", мун. Chisinau, in Public institution "National opera and ballet theater of Maria Biyeshu", мун. Chisinau;

2) State company "National Theatre of Mihai Eminesku", мун. Chisinau in Public institution "National theater of Mihai Eminesku", мун. Chisinau;

3) State company "Republican theater "Luceafarul", мун. Chisinau, in Public institution "Republican theater "Luceafarul", мун. Chisinau;

4) State company "National theater "Eugene Ionesco", мун. Chisinau in Public institution "National theater "Eugene Ionesco", мун. Chisinau;

5) State company "State Russian drama theater of A. P. Chekhov", мун. Chisinau, in Public institution "State Russian drama theater of A. P. Chekhov", мун. Chisinau;

12) the State company "National Philharmonic Hall of Sergey Lunkevich" in Public institution "National philharmonic hall of Sergey Lunkevich";

13) the State company "Organ Hall" in Public institution "Organ hall";

14) the State company "National academic ensemble of the national dances "JOC" in Public institution "National academic ensemble of the national dances "JOC".

2. Function of the founder of the organizations specified in Item 1, is performed by the Ministry of Education, culture and researches.

3. The created public institutions are successors of the rights and obligations of the state companies reorganized by transformation.

4. Before appointment as the Ministry of Education, culture and researches of directors of the public institutions specified in Item 1, the Minister of Education, culture and scientific research will appoint persons who will temporarily fulfill these duties.

5. The property of the state companies which are subject to reorganization by transformation will be transferred to the created public institutions according to requirements of the Regulations on procedure for transfer of objects of public property approved by the Order of the Government No. 901/2015, except for of the lands which are in public property of the state.

6. Release of workers in connection with reorganization in the way of transformation of the state companies to public institutions will be performed according to the existing labor law in case their transfer is impossible. The expenses connected with release of workers in connection with reorganization of the companies will become covered at the expense of own income of these companies.

7. To the Ministry of Education, culture and researches:

1) within 5 days from the date of entry into force of this resolution to create the commission on reorganization which will provide reorganization by transformation of the state companies specified in Item 1, in public institutions;

To perform 2) by means of the commission on reorganization cession of property to the created public institutions, except for the lands which are in public property of the state;

3) to approve the charter, structure and extreme number of the created public institutions;

4) in 3-month time from the date of entry into force of this resolution to develop and submit to the Government for approval methodology of calculation of rates, the list of services and the sizes of rates for the services provided by the public theatrical and concert institutions.

8. Approve changes which are made to some orders of the Government, according to appendix.

9. The salary to personnel of the theaters, circuses and concert organizations founded by the state, functioning in the mode of financial and economic self-government will be charged since December, 2018, according to provisions of this resolution.

10. To provide to the agency of the state services upon the demand of the owner modification of constituent acts.

11. This resolution becomes effective from the date of publication.

Changes which are made to some orders of the Government

1. In the Regulations on theaters, circuses and the concert organizations approved by the Order of the Government No. 1242/2003 (Official monitor of the Republic of Moldova, 2003, Art. No. 218-220, 1293), to make the following changes:

1) in all text of the Provision of the word Ministry of Culture in any case shall be replaced with words "The Ministry of Education, cultures and researches" in the corresponding case;
