About establishment of the large size of drugs, psychotropic substances or their precursors or analogs

Based on part of 4 notes to article 327 of the Criminal code of the Republic of Belarus the Council of Ministers of the Republic of Belarus DECIDES:

1. Establish the large size of drugs, psychotropic substances and their precursors according to appendix.

2. Determine that:

2.1. if in appendix for specific drug, psychotropic substance value of the large size is not established, the value of the large size established in appendix for group of substances to which drug, psychotropic substance according to the Republican list of the drugs, psychotropic substances and their precursors which are subject to the state control in the Republic of Belarus belongs is applied;

2.2. in the presence in substance of two and more drugs, psychotropic substances value of the large size of drug or psychotropic substance for which more severe measure of the state control is established is applied.

Substance is understood as substance or mix of substances of synthetic or natural origin, including part of plants, mushrooms;

2.3. for the ready dosed medicines which are in not opened primary original packings and containing in the structure especially dangerous drugs and psychotropic substances permitted to controlled turnover, specified in the list 2 appendices, and (or) the dangerous psychotropic substances permitted to controlled turnover, specified in the list 3 appendices irrespective of their quantitative content (concentration) by the large size the quantity exceeding 90 units of the dosed dosage form is.

Are understood as units of quantity of the dosed dosage forms:

tablets, dragee, capsules, pills, plasters transdermalny, suppositories;

one-dose packagings (ampoules, bottles, packets sachets, the syringe tubes, the syringe ampoule, the cartridges) containing medicines in firm, soft or liquid dosage form;

2.4. the size of drugs, psychotropic substances (except for medicines in the certain dosage forms specified in subitem 2.3 of this Item) is determined by the lump of substance which part they are, irrespective of their quantitative content (concentration) from which for:

drugs, psychotropic substances of plant origin (except for hashish) and substances of plant origin (part of the plants, mushrooms) containing drugs, psychotropic substances, the size in the structure it is determined after their drying up to the permanent weight at temperature of 110-115 °C;

estimates of the size of drugs, psychotropic substances of plant origin withdrawn from illicit trafficking before entry into force of this resolution, the mass of the substance which is dried up up to the permanent weight at temperature of 110-115 °C is calculated on difference of initial mass of substance and mass of the water containing in it. At the same time the mass of the water containing in substance is determined as the work of initial mass of substance on its humidity (expressed as a percentage) divided on 100;

substances in mazeobrazny and liquid state (except for the substances made with use of dairy products, and the substances containing alkaline component in the structure) the size is determined after their drying up to the permanent weight at temperature of 70-115 °C;

the medicines in dosage form of syrup containing in the structure especially dangerous drugs and psychotropic substances permitted to controlled turnover, specified in the list 2 appendices, and (or) the dangerous psychotropic substances permitted to controlled turnover, specified in the list 3 appendices and also for the substances in liquid state made with use of dairy products, and the substances containing alkaline component in the structure, the size is determined by the mass of their extract (extraction) received with use of water and (or) organic solvents, which is dried up up to the permanent weight at temperature of 70-115 °C;

the substances prepared for the use by drawing on the paper or other basis (except vegetable) which is not intended for the direct use, the size is determined by the mass of their extract (extraction) received with use of water and (or) organic solvents, which is dried up up to the permanent weight at temperature of 70-115 °C;

the substances prepared for injection introduction and containing in the structure impurity of biological material (blood), the size is determined by the mass of their extract (extraction) received with use of water and (or) organic solvents, which is dried up up to the permanent weight at temperature of 70-115 °C;

2.5. in case of extraction and (or) drying of the substances which are in liquid state, for the purpose of ensuring the most complete extraction and minimization of natural wastage containing in them drugs, psychotropic substances use of alkalis (bases) and acids is allowed;

2.6. determination of the size of drugs, psychotropic substances by calculation method based on the results received for representative (representative) test of the corresponding substance is allowed;

2.7. the decision on need of use of the acceptances and methods specified in subitems 2.5 and 2.6 of this Item is accepted by person having special knowledge of area of research of drugs, psychotropic substances, their precursors and analogs in the course of conducting the corresponding examination proceeding from properties and characteristics of the researched object;

2.8. the large sizes of analogs, isomers, simple and esters, salts (including salts of isomers, simple and esters) drugs, psychotropic substances and procedure for their determination correspond to the large amount and procedure for their determination established by this resolution for drugs, psychotropic substances, analogs, isomers, simple and esters, salts (including salts of isomers, simple and esters) which they are.

3. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of November 24, 2000 No. 1785 "About approval of the List of drugs, psychotropic substances, their analogs found in illicit trafficking with their quantitative estimates";

the resolution of Council of Ministers of the Republic of Belarus of March 31, 2011 No. 419 "About modification and amendments in the List of the drugs and psychotropic substances found in illicit trafficking with their quantitative estimates";

subitem 1.1 of Item 1 of the resolution of Council of Ministers of the Republic of Belarus of October 18, 2012 No. 947 "About change and recognition voided some orders of the Government of the Republic of Belarus".
