1. Approve the enclosed Rules of subsidizing of aviation fuel for priority international aviaroutes.

2. This resolution becomes effective since January 1, 2020.

Rules of subsidizing of aviation fuel for priority international aviaroutes

Chapter 1. General provisions

1. These rules of subsidizing of aviation fuel (further - Rules) are developed for priority international aviaroutes according to subitem 60-3) of article 13 of the Law of the Republic of Kazakhstan "About use of airspace of the Republic of Kazakhstan and activities of aircraft" and determine procedure for subsidizing of aviation fuel (further - aviation fuel) for priority international aviaroutes.

2. The priority international aviaroutes performed based on decisions of the Government of the Republic of Kazakhstan, which are not providing the income level necessary for effective functioning of aviaroute are subject to subsidizing at the expense of budgetary funds.

3. Expenses on aviation fuel in the presence of general negative difference between income gained from public conveyance, loads, mail and baggage and the amount of the operating expenses which are created in case of air transportation along new priority international aviaroutes for one year, within the annual amount of the allocated budget subsidies along each aviaroute which is not exceeding 10% of the cost of expenses on aviation fuel are subject to subsidizing.

Chapter 2. Procedure for subsidizing of aviation fuel for priority international aviaroutes

4. The priority international aviaroutes offered to subsidizing from the republican budget in the procedure established by the legislation join in the budget request authorized body in the field of civil aviation submitted to authorized body on budgetary planning when forming the republican budget for the corresponding financial year.

5. Budget subsidies are provided within the amounts determined by the law on the republican budget for the corresponding financial year.

6. For receipt of budget subsidies between the administrator of the appropriate budget program and the airline having the existing certificate on subsidized aviaroute the agreement of budget subsidizing of aviation fuel for priority international aviaroutes (further - the agreement) in form according to appendix 1 to these rules is signed.

7. After the conclusion of the Agreement the airline monthly till the 20th following reporting submits the following documents certified by the head, the chief accountant to authorized body:

- the report on subsidized priority international aviaroutes of airline according to appendix 2 to these rules;

- the report on aviation fuel expenses on subsidized priority international aviaroutes according to appendix 3 to these rules.

8. Between airline and authorized body in the field of civil aviation after adoption of the monthly report on subsidized priority international aviaroutes the statement of the rendered services in form according to appendix 4 to these rules is drawn up.

9. Payment of budget subsidies is performed monthly in amounts of allocated funds according to funding plan of the approved budget program.

Payment of budget subsidies for month under report is performed no later than the 30th following reporting in time.

10. Payment of budget subsidies for the last calendar month of year is performed on the basis of the preparatory act of the rendered services in subsidized aviaroutes provided on not later December 20, constituted according to forecast data with the subsequent submission of the report constituted according to actual data in time no later than the 20th day of the next month.

Following the results of financial year the airline and authorized body in the field of civil aviation carry out reconciliation of settlement with creation of reconciliation statements of the performed works.

11. To the airlines which did not execute in use aviaroute of contract clauses and also in case of withdrawal of the certificate on aviaroute according to the Rules of carrying out tender on subsidized aviaroutes and issues of certificates on subsidized aviaroutes for rendering services in public conveyance, baggage, loads and mailings approved by the order of the acting minister of transport of the Republic of Kazakhstan of November 24, 2023 No. 95, payment of subsidies it is not made.
