About information exchange of the automated system of enforcement proceeding and the State register of acts of civil status of citizens

1. Approve the Procedure for information exchange of the automated system of enforcement proceeding and the State register of acts of civil status of citizens which is applied.

2. To the administrator of the automated system of enforcement proceeding and the State register of acts of civil status of citizens:

take the measures necessary for implementation of technical capability of realization of the Procedure for information exchange of the automated system of the enforcement proceeding and the State register of acts of civil status of citizens approved by this order within four months from the effective date of this order;

before introduction of information exchange of the automated system of enforcement proceeding and the State register of acts of civil status of citizens according to the procedure, provided by this order to provide contractors in case of execution of judgments and decisions of other bodies (officials) of statements from the State register of acts of civil status of citizens by direct access based on the agreement signed with the administrator of the State register of acts of civil status of citizens.

3. To department of private law () submit A.N. Ferens this order on state registration according to the Presidential decree of Ukraine of October 3, 1992 to No. 493 "About state registration of regulatory legal acts of the ministries and other executive bodies".

Procedure for information exchange of the automated system of enforcement proceeding and the State register of acts of civil status of citizens

1. This Procedure determines the procedure of information exchange of the automated system of enforcement proceeding (further - System) and the State register of acts of civil status of citizens (further - the Register) by access to data of the Register on scrap, annulment of marriage, change of name, the death of debtors - physical persons (further - information exchange) during execution of the state and private contractors (further - contractors) judgments and decisions of other bodies (officials).

2. Information exchange is performed with use of data of System and the Register in real time in electronic form information and telecommunication means using means of technical and cryptographic information security according to the Law of Ukraine "About information security in information and communication systems".

3. Information exchange provides the state company which belongs to the sphere of management of the Ministry of Justice of Ukraine which is determined by the administrator Sistemy and the Register (further - the Administrator).

4. For personal data protection of physical person which are transferred and accepted according to the procedure of information exchange the organizational and technical actions providing protection of confidential information take root.

5. The information access about the debtor - physical person, provided in Item of 1 this Procedure, is provided by forming by the contractor in System of search query in the Register according to the following data:

surname, name and middle name (in the presence) the debtor - physical person;

birth date of the debtor - physical person.

6. Technical support of transfer of data is provided with the Administrator.

7. The administrator provides timely transfer and acceptance of data which list and amount are determined in the protocol signed by it and approved by the Ministry of Justice of Ukraine.

8. The type and structure of electronic data which are transferred and accepted, procedures of interaction of System and the Register and change to them form of registers of requests and answers are determined in appendices to the protocol, stipulated in Item 7 it About.

9. Electronic data shall contain information from the Register, urgent for date and time of transfer of the answer to search query.

10. Information which is transferred from the Register according to the procedure of information exchange is used with observance of requirements of the Laws of Ukraine "About information", "About personal data protection" during implementation by contractors of the powers provided by the Law of Ukraine "About enforcement proceeding" and cannot be transferred to the third party if other is not provided by the law.
