About approval of requirements to concepts of creation of special economic and industrial zones

According to the subitem 7) article 11 of the Law of the Republic of Kazakhstan of April 3, 2019 "About special economic and industrial zones in the Republic of Kazakhstan" PRIKAZYVAYU:

1. Approve:

1) Requirements to the concept of creation of special economic zone, according to appendix 1 to this order;

2) Requirements to the concept of creation of industrial zone, according to appendix 2 to this order.

2. Declare invalid the order of the Minister of investments and development of the Republic of Kazakhstan of February 27, 2015 No. 222 "About approval of requirements to execution of the concept of creation of special economic zone" (it is registered on April 10, 2015 No. 10692, is published in the Register of state registration of regulatory legal acts in the Information system of law of Ad_let on April 20, 2015).

3. To provide to committee of industrial development and industrial safety of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

4. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Requirements to the concept of creation of special economic zone

Chapter 1. General provisions

1. These Requirements to the concept of creation of special economic zone are developed according to the subitem 7) of article 11 of the Law of the Republic of Kazakhstan of April 3, 2019 "About special economic and industrial zones in the Republic of Kazakhstan" and establish requirements in case of development of concepts of creation of special economic zone by the central or local executive bodies, the legal entities interested in creation of special economic zone.

Chapter 2. Structure of the concept

2. The concept of creation of special economic zone contains the following Sections:

In the Section "Introduction" are described existing political, social and economic, climatic, geographical, engineering-geological and conditions in which realization of special economic zone is supposed, including indicators of the existing and predicted population level of living, security with infrastructure, the investment climate and socio-economic indexes characterizing expected location and area of influence of special economic zone are specified.

Also, in this Section problems which partial or complete solution by means of creation of special economic zone are specified.

4. In the Section "Geographical Placement of Special Economic Zone" the area, location and cartographic schemes characterizing provision of the parcels of land on which creation of special economic zone, in scale 1:20000 and 1:100000.2 is planned are reflected.

In the Section "Purposes and Tasks of Creation of Special Economic Zone" the purposes and tasks of the created special economic zone coordinated to geographical location of special economic zone, available natural and manpower, possible interests of foreign investors and necessary for development of special economic zone by economic, social and geographical factors are reflected.

6. In the Section "Analysis of the Current Economic Situation of the Region and World Economy" are reflected:

1) the main social and economic features of the region in which creation of special economic zone is supposed;

2) security with infrastructure, the investment components and indicators characterizing expected location of special economic zone;

3) the analysis of current status of industries of the region on priority types of activity;

4) the analysis of current status of world economy with coordination to priority types of activity of the created special economic zone;

5) main premises of placement of special economic zone both competitive geographical and economic advantages of the region.

7. In the Section "Priority Types of Activity of Special Economic Zone" the core activities answering to the purposes of creation of special economic zone which will be performed in the territory of special economic zone are specified.

Specific reasons for feasibility of implementation of activities in the territory of special economic zone are given in this Section.

8. In the Section "Potential Participants of Special Economic Zone" the forms of business of the organization applying for implementation of activities in the territory of special economic zone and also self-produced availability, work experience on priority types of activity are specified.

9. In the Section "Positive Effect on Regional Economy of Creation of Special Economic Zone" expected results of functioning of special economic zone are stated.
