About procurement (purchase) at legal entities of the Republic of Belarus of scrap and waste of ferrous and non-ferrous metals, their conversion and delivery

For the purpose of growth in volumes of scrap and waste of the ferrous and non-ferrous metals involved in economic circulation I decide:

1. Conduct from May 1 to December 31, 2006 experiment on involvement of the organizations which are part of the Belarusian concern on material resources (further - the organizations of concern of Belresursa), to activities for procurement (purchase) at legal entities of the Republic of Belarus of scrap and waste of ferrous and non-ferrous metals, their conversion and delivery.

During experiment to the organizations of concern of Belresursa to perform:

procurement (purchase) of scrap and waste of the ferrous and non-ferrous metals which are formed in the course of productive activity at legal entities of the Republic of Belarus including at those which for 2006 establishes amounts of their delivery (procurement, delivery) for republican state needs, - over the finished amounts in the presence at the organizations of concern of Belresursa of special permissions (licenses) for this type of activity issued to them in accordance with the established procedure;

conversion and delivery of scrap and waste of ferrous and non-ferrous metals to procurement organizations of the Belarusian national association on procurement, conversion and delivery of scrap and waste of ferrous and non-ferrous metals or shipment according to their job specifications to legal entities of the Republic of Belarus for use in own production.

2. Determine that during the experiment provided in part one of Item 1 of this Decree and to the legal entities of the Republic of Belarus delivering them scrap and waste of ferrous and non-ferrous metals under the relevant agreements the restrictions set in part one of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of August 15, 2005 No. 373 "About some questions of the conclusion of agreements and obligation fulfillments in the territory of the Republic of Belarus" (The national register of legal acts of the Republic of Belarus, 2005, No. 128, 1/6698), concerning discharge of delivery agreements (procurement, delivery) of scrap and waste of ferrous and non-ferrous metals without receipt in accordance with the established procedure of money are not applied to the organizations of concern of Belresursa.

In case of not introduction of concern of Belresursa by the organizations and legal entities of the Republic of Belarus delivering them scrap and waste of ferrous and non-ferrous metals, the current payments in the budget (including in the state trust budget funds, Social Security Fund of the population of the Ministry of Labour and Social Protection) and in state non-budgetary funds of provision of part one of this Item are not applied since the 1st following after month of failure to provide of the current payments in the budget and in the called funds before complete repayment of the arisen debt on these payments then action of this part is resumed.

3. To Council of Ministers of the Republic of Belarus:

provide reduction of acts of the legislation in compliance with this Decree;

following the results of experiment till February 15, 2007 to make offers on feasibility of further participation of the organizations of concern of Belresursa in activities for procurement (purchase) at legal entities of the Republic of Belarus of scrap and waste of ferrous and non-ferrous metals, their conversion and delivery.

4. To impose control of implementation of this Decree on the State Control Committee.

5. This Decree becomes effective from the date of its signing.
