About approval of the Regulations on vising of documents of international trade

Based on the Law on Chamber of Commerce and Industry No. 393-XIV of May 13, 1999, the Charter of Chamber of Commerce and Industry of the Republic of Moldova, the Executive bureau of Chamber of Commerce and Industry DECIDES:

1. Approve Regulations on vising of documents of international trade, according to appendix.

2. Consider invalid the Regulations about vising of documents of international trade approved by the Decision of Executive bureau of Chamber of Commerce and Industry No. 39/5 of 18.11.2016 (The official monitor of the Republic of Moldova No. 19-23 of 20:01. 2017, ст.№69).

3. This decision to publish on the web page of Chamber of Commerce and Industry www.chamber.md.

4. Control over the implementation of provisions of this decision to assign to Mrs. Natalya Kalenik, the vice-president of Chamber of Commerce and Industry.

Regulations on vising of documents of international trade

I. General provisions

1. This Provision is developed for the purpose of execution of requirements of the item 1) of Art. 4 of the Law No. 393-XIV of May 13, 1999. "About Chamber of Commerce and Industry", item 10 of Art. 8 of the Charter of Chamber of Commerce and Industry also regulates the procedure of vising of documents of international trade.

2. In this Provision the following basic concepts are used in value:

a) vising – the procedure of assurance of reliability of the seals and signatures which are put down on documents of international trade;

b) documents of international trade – the contract, invoice, the phytosanitary certificate, the veterinary certificate, the hygienic certificate, the certificate of free trade (certificate of free sale), the pack list, exporter registry form, letter of authorization, the declaration of the producer, other documents of international trade;

c) the applicant – physical person or legal entity which addresses for vising of documents of international trade.

3. The Chamber of Commerce and Industry appoints the internal order of persons, representatives to vise documents of international trade.

4. Specimen signatures of persons given the right to vise documents of international trade, samples of seals of Chamber of Commerce and Industry, and also information on changes in the relevant data on Chamber of Commerce and Industry go to competent authorities of the Republic of Moldova in view of informing other states with which at the Republic of Moldova trade relations are had.

II. Procedure of vising of documents of international trade

5. The basis for vising of documents of international trade is the application form which is filled in by the applicant, according to sample from appendix No. 1 to this Provision, certified by the signature of the applicant. The application form can be filled in by the applicant, with use of the standard document forms electronically published on the web page of Chamber of Commerce and Industry - www.chamber.md. The application form which is filled in in electronic form with necessary appendices, go by e-mail to Chamber of Commerce and Industry, to e-mail: certificate@chamber.md is also signed by the applicant in the original at the time of issue of visaed documents.

6. The following documents are enclosed to the application:

a) the statement from the State Register of the companies and organizations (the copy certified by the signature of the applicant);

b) identity documents of the physical person – the applicant;

c) the power of attorney issued to the applicant's representative, confirming powers on representation of its interests in Chamber of Commerce and Industry in case of filing of application through the authorized person (in the original);

d) the document of the legal entity who issued the documents shown for vising, confirming samples of the signatures which are put down on them (in the original);

e) documents of international trade for which vising is requested (in the original and the copy, the witnessed signature).

The documents provided in Items and) - d) are provided in case of request of the first vised document (except for modification in these documents, in this case the applicant bears responsibility for provision in Chamber of Commerce and Industry of these changes supported by the documents and at the same time for the effects caused by non-presentation of the specified changes). Documents are stored in separate folders for each economic agent.

7. If necessary the Chamber of Commerce and Industry can request with the corresponding reasons and other documents necessary for consideration of the application on vising of documents.

8. The applicant bears responsibility for reliability of documents and the data specified in them provided on vising to Chamber of Commerce and Industry.

9. The Chamber of Commerce and Industry has the right to refuse vising of documents of international trade if all documents and necessary data were not provided or if they contain strong indications of counterfeit.

10. Vising of documents of international trade is performed till 5 working days from the date of filing of application, all documents and necessary data.

11. Authorized persons of Chamber of Commerce and Industry put down the sign and seal of Chamber of Commerce and Industry on the vised documents.

12. Payment for vising of documents of international trade is performed according to the rates approved by Chamber of Commerce and Industry Executive bureau.

13. The Chamber of Commerce and Industry confirms authenticity of the seals which are put down on documents, stamps and signatures and does not vise in any form contents of the documents shown for vising.

III. Accounting of documents of international trade

14. Authorized persons of Chamber of Commerce and Industry provide accounting of visaed documents of international trade in the register of the established form.

15. The statement, copies of visaed documents of international trade and documents submitted by the applicant based on which they were vised are stored in Chamber of Commerce and Industry archive at least five years.
