About approval of Rules of transportation of dangerous goods by road transport and the list of the dangerous goods allowed to transportation by vehicles in the territory of the Republic of Kazakhstan
According to subitems 23-7) and 23-12) of article 13 of the Law of the Republic of Kazakhstan of July 4, 2003 "About road transport", the subitem 1) article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services", PRIKAZYVAYU:
1. Approve:
1) Rules of transportation of dangerous goods by road transport according to appendix 1 to this order.
2) the list of the dangerous goods allowed to transportation by vehicles in the territory of the Republic of Kazakhstan according to appendix 2 to this order.
2. To committee of transport of the Ministry for Investments and Development of the Republic of Kazakhstan (Asavbayev A. A.) provide:
1) in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan, the direction it the copy on official publication in periodic printed publicity materials and information system of law of Ad_let;
3) placement of this order on Internet resource of the Ministry for Investments and Development of the Republic of Kazakhstan and on the intranet portal of state bodies;
4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry for Investments and Development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of Item 2 of this order.
3. To impose control of execution of this order on the supervising vice-minister of investments and development of the Republic of Kazakhstan.
4. This order becomes effective after twenty one calendar days after day of its first official publication.

Rules of transportation of dangerous goods by road transport
Chapter 1. General provisions
1. These rules of transportation of dangerous goods by road transport (further - Rules), are developed according to subitem 23-7) of article 13 of the Law of the Republic of Kazakhstan of July 4, 2003 "About road transport" (further - the Law) and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan of April 15, 2013 "About the state services" and determine procedure for transportation of dangerous goods by road transport, issues of the special authority for the move of dangerous goods of classes 1, 6 and 7 and approval certificates of the vehicle to transportation of dangerous goods in the international message, and also procedure for rendering the state services "Issue of the Special Authority for the Move of Dangerous Goods of Classes 1, 6 and 7" and "Issue of the approval certificate of the vehicle to transportation of dangerous goods in the international message.
2. Action of Rules extends on the physical persons and legal entity connected with transportation of dangerous goods on the territory of the Republic of Kazakhstan.
International carriages of dangerous goods vehicles are performed with observance of requirements of the European agreement on the international road delivery of dangerous goods (DOPOG), international treaties of the Republic of Kazakhstan.
3. Dangerous goods any substances, materials, products, waste of productive and other activity which owing to properties inherent in them can in transit, production of handling works and storage to serve as cause of explosion, the fire or damage of technical means, devices, buildings and constructions, and also death, injuring and disease of people, animal, to do harm to the surrounding environment are recognized.
4. The basic concepts used in Rules:
1) the automotive vehicle (further - the vehicle) - unit of railway vehicles of the road transport including buses, minibuses, passenger and cargo vehicles, trolleybuses, automobile trailers, semitrailer trucks to truck tractors and also the specialized cars (intended for transportation of certain types of loads) and the special equipment vehicles (intended for accomplishment of different mainly not transport works);
2) automobile carrier (further - carrier) - the physical person or legal entity owning vehicles, except for passenger, on the property right or on other legal causes, performing business activity on public conveyance, baggage, loads and mailings;
3) number of the UN - four-digit identification number of substance or product;
4) the consignee - the physical person or legal entity authorized on receipt of load based on the agreement of motor transportation of load or on other legal causes;
5) the consignor - physical person or legal entity on behalf of which shipment is drawn up.
6) the special authority for the move of dangerous goods of classes 1, 6 and 7 - the allowing electronic document issued by authorized body granting the right to transportation of dangerous goods of classes 1, 6 and 7.
5. In transit dangerous goods classification of dangerous goods according to operating standards of the European agreement on the international road delivery of dangerous goods (DOPOG) and GOST 19433.1-2010 "Dangerous goods is applied. Classification", GOST 19433.2-2010 "Dangerous goods. Test methods" and GOST 19433.3-2010 "Dangerous goods. Marking", and also the list of the dangerous goods allowed to transportations by vehicles in the territory of the Republic of Kazakhstan, approved by authorized body in the field of road transport.
Chapter 2. Procedure for the organization of transportations of dangerous goods by road transport
6. The transport drivers transporting dangerous goods on the territories of the Republic of Kazakhstan, and the vehicles used for transportation of dangerous goods conform to the requirements specified in Chapters 3 and 4 of these rules.
7. Transportation of dangerous goods of classes 1, 6 and 7 on the territory of the Republic of Kazakhstan is performed by the specialized car or other vehicles which are specially re-equiped for these purposes based on the special authority for the move of dangerous goods of classes 1, 6 and 7 in form, according to appendix 1 to these rules.
8. Between the consignor (consignee) and carrier the contract for implementation of transportations of dangerous goods, according to Rules of carriage of goods by road transport, approved by the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 546 is signed (further - Rules of carriage of goods by road transport) (it is registered in the Register of state registration of regulatory legal acts for No. 12463).
The transportation agreement of dangerous goods, owing to specific features, also shall contain data:
1) about actions for special processing of vehicles;
2) about the organization of maintenance (in case of need);
3) about procedure for providing with individual protection equipment of drivers;
4) about procedure for providing with elements of system of information on danger and neutralization of dangerous goods;
5) in transit dangerous goods of class 7 - about procedure for mutual informing the consignor (consignee) and carrier about the exact name and quantity of loads, and also departure time (assumed delivery date) and data retrievals of loads.
9. In case of non receipt of load, detection of its shortage or discrepancy of the name, the consignee within 3 calendar days informs the consignor and the authorized body which issued the authority for the move of dangerous goods for taking measures of rapid response.
10. No. 64 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 31.01.2023
11. Data for filling of commodity-transport delivery note, procedure for its creation and application are determined by the Rules of carriages of goods by road transport approved by the order of the Minister of investments and development of the Republic of Kazakhstan of April 30, 2015 No. 546 (it is registered in the Register of state registration of regulatory legal acts at No. 12463).
12. The consignor together with the signed transportation agreement of dangerous goods provides to carrier:
1) identification sign "Dangerous goods" on each vehicle;
2) the instruction for the driver according to appendix 2 to these rules on each type of dangerous goods.
13. On transportation of dangerous goods of classes 1, 6 and 7 according to the list of the dangerous goods allowed to transportations by vehicles in the territory of the Republic of Kazakhstan according to the Law the carrier develops route of transportation of dangerous goods.
In case of development of route of transportation the carrier is guided by the following main requirements:
1) near route there shall not be large industrial facilities;
The route shall not pass 2) through large settlements.
In case of need transportations of dangerous goods in large settlements, the route shall not pass near entertaining, cultural and educational, educational, preschool and medical institutions;
3) on route of transportation places of parking of vehicles shall be provided.
14. In transit the pyrotechnic products having subclass of transport danger 1.4 according to Classification of the dangerous goods containing pyrotechnic products of the Technical regulation of the Customs union "About safety of pyrotechnic products" of the custom union approved by the solution of the Commission of August 16, 2011 No. 770, execution of the authority for the move is not required.
15. In case of restriction of visibility to 300 meters (fog, rain, snowfall) transportation of dangerous goods of classes 1, 6 and 7 is not allowed about what it is specified in special conditions of action of special permission.
Chapter 3. Requirements to the vehicles transporting dangerous goods
16. The vehicles transporting dangerous goods conform to the following requirements:
1) compliance to constructive technical characteristics of manufacturing plant and to regulating documents on standardization of the Republic of Kazakhstan to design, the equipment and technical condition of the vehicles transporting dangerous goods;
2) compliance to data of registration documents;
3) compliance to the conditions established by the European agreement on the international road delivery of dangerous goods (DOPOG) on transportations of specific dangerous substances and products;
4) compliance to Sanitary regulations "Sanitary and epidemiologic requirements to vehicles for public conveyance and loads", approved by the order of the Minister of Health of the Republic of Kazakhstan of January 11, 2021 No. KR DSM-5 (it is registered in the Register of state registration of regulatory legal acts at No. 22066);
5) compliance to Traffic regulations, Basic provisions according to the admission of vehicles to operation, the list of field and special services which transport is subject to the equipment special luminous and sound signals and coloring according to the special tsvetografichesky schemes approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of June 30, 2023 No. 534 (it is registered in the Register of state registration of regulatory legal acts for No. 33003) (further - Traffic regulations);
6) equipment control devices of registration of work-rest schedule of drivers (tachographs);
7) the equipment identification signs according to Traffic regulations and the European agreement on the international road delivery of dangerous goods (DOPOG);
8) completeness the operational tool and the equipment according to the existing regulating documents on standardization of the Republic of Kazakhstan;
9) in necessary cases picking by means of neutralization of the transported dangerous substance and individual protection equipment of the driver and attendant of personnel;
10) the equipment the local warning system of the population on cases of uncontrolled flood, emission of dangerous goods.
The vehicles transporting dangerous goods of classes 1, 6 and 7, are in addition equipped with devices of continuous product transmission in real time about the speed, observance of traffic route.
The transport units transporting dangerous goods shall have two rectangular plates of orange color located in the vertical plane, in form, according to appendix 2-1 to these rules. One plate to fasten in front, and another behind transport unit.
The plates of orange color which are not relating to the transported dangerous goods or their remaining balance shall be removed or covered. If plates are covered, then the covering shall be continuous and shall remain effective after stay in fire within 15 minutes.
17. No. 64 is excluded according to the Order of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of 31.01.2023
17-1. Installation on the vehicle for transportation of dangerous goods of the auxiliary fuel tanks which are not provided by the manufacturer of the vehicle is not allowed.
Application in driver's cab of fuel heating devices (including, using gaseous fuel) and their placement in cargo compartments of the vehicle is not allowed.
17-2. The vehicle for transportation of dangerous goods is completed:
1) at least than two anti-recoil emphasis on each vehicle (road train link) which sizes correspond to diameter of wheels;
2) two breakdown triangles;
3) means of neutralization of the transported dangerous goods;
4) set of hand tool for damage repair of the vehicle;
5) two lamps of self-contained supply with the blinking or fixed lights of orange color;
6) shovel and inventory of sand for fire suppression;
7) clothes of bright color for each crew member;
8) pocket lamps for each crew member;
9) according to instructions of the emergency card and conditions on transportation – means of neutralization of the transported dangerous goods, individual protection of crew members and the personnel accompanying load;
10) the special means for safety control specified in the emergency card.
Chapter 4. Requirements to the drivers transporting dangerous goods vehicles
18. The drivers transporting dangerous goods the vehicle conform to the following requirements:
1) availability of the car driver license of the corresponding category;
2) availability of years of service of continuous work as the transport driver of this category at least three years;
3) passing of general medical examination and pretrip and posttrip medical examination for professional drivers with mark in the route sheet according to appendix 1 to Rules of carriages of goods by road transport;
4) availability of the competency certificate of the driver to transportation of dangerous goods on the territory of the Republic of Kazakhstan in form, according to appendix 3 to these rules.
Chapter 5. Procedure for driving through the territory of the Republic of Kazakhstan of the vehicles transporting dangerous goods
19. The driver transporting prior to the beginning of trip needs to undergo pretrip instructing in transportation of dangerous goods and to have in case of itself the following accompanying documents:
1) registration documents on the vehicle;
2) the route sheet with indication of transportation route according to requirements of these rules, with the mark "Dangerous goods", the management of transport documents except for registered in single system;
3) the instruction for the driver;
4) the competency certificate of the driver to transportation of dangerous goods on the territory of the Republic of Kazakhstan in form;
5) the form of route of transportation of dangerous goods of classes 1, 6 and 7, according to the list of the dangerous goods allowed to transportations by vehicles in the territory of the Republic of Kazakhstan in form according to appendix 4 to these rules;
6) commodity-transport delivery note, except for registered in single system of management of transport documents;
7) the action plan in emergency situation developed by the consignor;
8) addresses and phones of carrier, the consignor, consignee, authorized bodies on control of ensuring safe operation of transport, traffic safety, in the field of civil to protection, located on traffic route.
20. The driver follows the established route of transportation of dangerous goods and places of parking.
Does not follow the driver under control of the vehicle with dangerous goods:
To touch 1) the vehicle from the place is sharp;
It is sharp to brake 2);
3) to move with the switched-off coupling and the engine;
To smoke 4) in the vehicle during movement (it is allowed to smoke during stops not closer, than in 50 meters from motor transport stall);
5) to use open flame (in exceptional cases for cooking fire can be dissolved at distance not closer than 200 meters from car parking facilities);
6) to leave the vehicle without supervision.
21. Movement on the territory of the Republic of Kazakhstan of the vehicles transporting dangerous goods is performed according to Traffic regulations and these rules.
22. The vehicle transporting dangerous goods shall not have more than one trail car (or semitrailer truck).
23. The speed limit of movement of vehicles, in transit dangerous goods, is established according to Traffic regulations.
In case of movement posted speed limit in transit of dangerous goods on the vehicle the identification sign with indication of admissible speed shall be established.
24. In transit dangerous goods the column consisting of 5 and more vehicles in its structure availability of the reserve empty vehicle intended for transportation of this type of cargo is obligatory. The reserve vehicle shall follow at the end of column.
25. In transit dangerous goods column of vehicles availability of the car (cars) of maintenance which, (which) is allocated with carrier or the consignor (consignee) is possible.
The "folow me" truck needs to move ahead of the accompanied vehicles.
The "folow me" truck is equipped with the flashing indicator of orange color which turns on in transportation time.
26. Support of authorized body by the squad car on safety control of traffic is performed if in the course of movement there is need of holding additional actions for regulation of traffic for the purpose of journey safety control.
27. In transit especially dangerous goods of the parking for rest of drivers in settlements is not allowed.
Parking are permitted in the places located not closer than in 200 meters from residential buildings and places of accumulation of people or in places specially allotted for this purpose.
In case of stop or the parking of the vehicle the parking brake shall be switched surely on, and on bias the anti-recoil emphasis is in addition established.
Places of stops and parking of the vehicles transporting dangerous goods are specified in route of transportation of dangerous goods.
28. The vehicles transporting dangerous goods are provided with fuel on all travel line, without refill at gas stations public.
In case of need filling at gas stations public is made on the site located at distance at least 25 meters from the territory of gas station, the fuel received at the station in jerricans or from the portable fuel stations which are specially provided for these purposes.
29. In case of the road accident the driver:
1) does not allow strangers to occurrence location;
2) provides first aid by the victim and causes if necessary emergency medical service;
3) reports the happened accident in authorized body in the field of civil protection, and also other interested bodies;
4) according to specifying in the instruction for the driver and the action plan in emergency situation takes measures for liquidation of emergency situation;
5) informs the representatives of the authorized bodies listed in the subitem 8) of Item 19 of these rules who arrived to occurrence location on danger and the taken measures.
30. Participants of transportation of dangerous goods take the corresponding organizational and technical safety precautions, for the purpose of prevention of drawing damage to health and life of people, the environment.
Consignors and (or) carriers of dangerous goods which main or additional activities include transportation of dangerous goods or the related materials handling operations incorporate workers responsible for safety of transportation process.
From all existing routes for transportation of dangerous goods, carrier the least dangerous route for the purpose of prevention of drawing damage to health and life of people, the environment is chosen.
Chapter 6. Procedure for issue of the special authority for the move of dangerous goods of classes 1, 6 and 7
31. The state service "Issue of the Special Authority for the Move of Dangerous Goods of Classes 1, 6 and 7" appears territorial subdivisions of Committee of road transport and transport control of the Ministry of transport of the Republic of Kazakhstan (further – the service provider) to physical persons or legal entities (further – uslugopoluchatel) by means of the direction of the statement in form according to appendix 5 to these rules to the service provider through the web portal of "the electronic government" (further – the portal) with appendix of the certificate on training of the transport driver transporting dangerous goods (the competency certificate of the driver to transportation of dangerous goods by vehicles).
32. The list of the main requirements to rendering the state service "Issue of the Special Authority for the Move of Dangerous Goods of Classes 1, 6 and 7" including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service "Issue of the Special Authority for the Move of Dangerous Goods of Classes 1, 6 and 7" it is provided in appendix 6 to these rules in the List of the main requirements to rendering the state service (further – the List of the main requirements).
33. Uslugopoluchatel agrees to use of the data which are the secret protected by the law, containing in information systems when rendering the state services if other is not provided by the laws of the Republic of Kazakhstan.
34. In case of the address through the portal to uslugopoluchatel the status about acceptance of request for the state service "Issue of the Special Authority for the Move of Dangerous Goods of Classes 1, 6 and 7" goes to "personal account".
35. Data of identity documents, about state registration (re-registration) of the individual entrepreneur or legal entity, data on vehicle registration the service provider receives from the corresponding state information systems through lock of "the electronic government".
36. In case of receipt of the statement to the service provider its registration and verification of the data containing in it regarding completeness of provided information, the certificate on training of the transport driver transporting dangerous goods is made. By results of consideration of the submitted documents, one of the following results goes to office of uslugopoluchatel in electronic form, the authorized person of the service provider certified by the EDS:
1) the special authority for the move of dangerous goods of classes 1, 6 and 7 in form, according to appendix 1 to these rules;
2) motivated refusal in further review of documents;
3) the motivated answer about refusal in rendering the state service.
37. The bases for refusal in rendering the state service:
1) establishment of unauthenticity of the documents submitted by uslugopoluchatel for receipt of the state service, and (or) these (data) containing in them;
2) discrepancy of uslugopoluchatel and (or) the provided materials, objects, supplied and the information necessary for rendering the state service, to the requirements established by these rules.
3) concerning uslugopoluchatel there is decision (sentence) of court on prohibition of activities or the separate types of activity requiring receipt of this state service which took legal effect.
38. In case of factual determination not of submission of the document which arrived through the portal the service provider in time two working days directs motivated refusal in any form of further review of the statement, in electronic form to "personal account" of uslugopoluchatel.
39. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization.
When rendering the state service by means of the state information system of permissions and notifications, data on stage of its rendering arrive in automatic mode in information system of monitoring of rendering the state services.
Authorized body in the field of transport within three working days from approval date or change of the subordinate regulatory legal act determining procedure for rendering the state service staticize information on procedure for its rendering and send to Single contact center.
40. Special authorities for the move of dangerous goods of classes 1, 6 and 7 it is issued on one or several identical transportations, and also on batch of the dangerous goods transported along certain route for the term of 1 year.
41. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the service employee, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).
The claim is submitted to the service provider and (or) the service employee whose decision, action (failure to act) are appealed.
The service provider, the service employee, whose decision, action (failure to act) are appealed, no later than 3 (three) working days from the date of receipt of the claim send it and administrative case to the body considering the claim.
At the same time the service provider, the service employee, whose decision, action (failure to act) are appealed, does not send the claim to the body considering the claim if he within 3 (three) working days makes the decision or other administrative action which are completely meeting the requirements specified in the claim.
The claim of uslugopoluchatel which arrived to the service provider according to Item 2 of article 25 of the Law of the Republic of Kazakhstan "About the state services" is subject to consideration within 5 (five) working days from the date of its registration.
The claim of uslugopoluchatel which arrived to authorized body by assessment and control of quality of rendering the state services is subject to consideration within 15 (fifteen) working days from the date of its registration.
If other is not provided by the laws of the Republic of Kazakhstan, appeal to the court is allowed after appeal in pre-judicial procedure, according to Item 5 of Article 91 of the Administrative procedural Procedure Code of the Republic of Kazakhstan.

Chapter 7. Procedure for issue of the approval certificate of the vehicle to transportation of dangerous goods in the international message
45. The service provider through the portal renders the state service "Issue of the Approval Certificate of the Vehicle to Transportation of Dangerous Goods in the International Message" to uslugopoluchatel by means of the direction of the statement in form according to appendix 7 to these rules, based on the diagnostic card of technical inspection in which the term of passing of the following obligatory technical inspection according to the established frequency of passing of obligatory technical inspection is specified.
46. The list of the main requirements to rendering the state service "Issue of the Approval Certificate of the Vehicle to Transportation of Dangerous Goods in the International Message" including characteristics of process, form, content and result of rendering, and also other data taking into account features of provision of the state service "Issue of the Approval Certificate of the Vehicle to Transportation of Dangerous Goods in the International Message" it is provided in appendix 8 to these rules in the List of the main requirements to rendering the state service (further - the List of the main requirements).
47. In case of the address through the portal to uslugopoluchatel the status about acceptance of request for the state service "Issue of the Approval Certificate of the Vehicle to Transportation of Dangerous Goods in the International Message" goes to "personal account".
48. The service provider in day of receipt of documents performs registration and designates the service employee for its execution.
49. About state registration (re-registration) of the individual entrepreneur or legal entity, data on vehicle registration, the service provider receives data of identity documents from the corresponding state information systems through lock of "the electronic government", data on the diagnostic card from unified information system of obligatory technical inspection of mechanical conveyor means and trail cars to them.
50. The service employee performs verification of the submitted application on compliance to requirements of these rules.
51. In the presence of the diagnostic card of technical inspection and its reality, according to the established frequency of passing of obligatory technical inspection, the service provider in time two working days checks for the compliance of uslugopoluchatel, the data specified in them necessary for rendering the state service according to requirements of these rules and draws up the approval certificate of the vehicle to transportation of dangerous goods in the international message, in form according to appendix 9 to these rules, or the motivated answer about refusal in rendering the state service in cases and on the bases, the main requirements specified in Item 9 the List which goes in electronic form to "personal account" of uslugopoluchatel.
52. Giving by uslugopoluchatel of the statement on receipt of the state service "Issue of the Approval Certificate of the Vehicle to Transportation of Dangerous Goods in the International Message" is performed in the presence of the diagnostic card in unified information system of obligatory technical inspection.
53. Issue of the approval certificate of the vehicle to transportation of dangerous goods in the international message is performed through the non-commercial The Government for Citizens State corporation joint-stock company (further - the State corporation).
54. In case of factual determination of incompleteness of the submitted documents or the invalidity of frequency of passing of obligatory technical inspection which arrived through the portal the service provider in time two working days directs motivated refusal in any form of further review of the statement, in electronic form to "personal account" of uslugopoluchatel.
55. The service provider provides entering of data on stage of rendering the state service into information system of monitoring of rendering the state services according to the procedure, established by authorized body in the field of informatization.
When rendering the state service by means of the state information system of permissions and notifications, data on stage of its rendering arrive in automatic mode in information system of monitoring of rendering the state services.
Authorized body in the field of transport within three working days from approval date or change of the subordinate regulatory legal act determining procedure for rendering the state service staticize information on procedure for its rendering and send to Single contact center".
56. The approval certificate is granted on effective period of the diagnostic card of technical inspection.
57. Consideration of the claim concerning rendering the state services is made by higher administrative authority, the service employee, authorized body by assessment and control of quality of rendering the state services (further – the body considering the claim).
