About transportation of foreign goods from the place of arrival to the place of temporary storage

Based on part two of Item 3 of article 76 of the Law of the Republic of Belarus of January 10, 2014 No. 129-Z "About customs regulation in the Republic of Belarus" and subitem 10.7 of Item 10 of the Regulations on the State Customs Committee of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of April 21, 2008 No. 228, the State Customs Committee of the Republic of Belarus DECIDES:

1.6. the term of transportation of foreign goods from the place of arrival to the place of temporary storage without room under customs procedure of customs transit (further - transportation term) is established by customs authority when making the customs transactions connected with the placement of such goods on temporary storage;

1.7. the term of transportation is established at the rate of 300 kilometers in one calendar day, except for the case specified in subitem 1.8 of this Item, but no more:

three calendar days - concerning the goods transported by railway transport;

two calendar days - concerning the goods transported by other modes of transport;

1.8. if the distance from the place of arrival to the place of temporary storage does not exceed 30 kilometers and is transported goods by road transport, the customs authority establishes the three-hour term of transportation;

1.9. data on the term of transportation are entered by the official of customs authority into information system of customs authority;

1.10. in case of accident, force majeure or emergence of other circumstances in case of which goods cannot be transported to the place of temporary storage of transportation in time:

the carrier takes measures for ensuring safety of goods and the vehicle;

the carrier or the other person having powers concerning goods without delay informs on the arisen circumstances the customs authority which established transportation term by the direction of the adequate notice (further - the notification) in written or electronic form;

1.11. notification:

in writing goes the courier (courier) or by mail, or on fax connection:

electronically goes to the e-mail address;

1.12. in the notification data shall be specified:

about person which directed the notification (for the legal entity - the name of the legal entity and his location, for physical person - surname, own name, middle name (if that is available), the residence (the place of stay), the e-mail address and phone number;

about carrier (for the legal entity - the name of the legal entity and his location, for physical person - surname, own name, middle name (if that is available), the residence (the place of stay), the e-mail address and phone number, except for case, the direction of the notification carrier;

about registration document number, provided for goods placement on temporary storage;

about circumstances under which goods cannot be transported to the place of temporary storage of transportation, about the place and time of emergence of such circumstances in time;

about the location of goods and the vehicle;

about need or lack of need of unloading, overload (transfer) or making of other cargo operations with the transported goods, and also about the place in which making of such transactions is supposed;

the expected term during which goods can be transported to the place of temporary storage, with reasons for such term.

2. This resolution becomes effective in the following procedure:

subitems 1.5-1.12 of Item 1 - since January 1, 2020;

other provisions of this resolution - after its official publication.
