About cooperation in the field of environmental protection
The Ministry of Natural Resources and Environmental Protection of the Republic of Belarus and the State committee of the Republic of Uzbekistan on ecology and environmental protection which are hereinafter referred to as by "Parties"
based on the principles of the state sovereignty,
realizing requirement of sustainable development,
highly appreciating the friendly relations between the Republic of Belarus and the Republic of Uzbekistan,
considering general interest of the Parties in cooperation for environmental protection and sustainable development, in increase in human potential for the management of natural resources and the environment based on the principles of equality and mutual advantage
recognizing that many environmental problems can be solved by interaction, mutual support and cooperation,
being convinced that the cooperation in the field of environmental protection and sustainable development promotes development of the further relations between the states of the Parties,
agreed as follows:
Main objective of this agreement is expansion and development of cooperation between the Parties for the decision and the corresponding response to environmental challenges at the national, regional and global levels with common efforts for the benefit of the states of the Parties.
1. The parties will support cooperation on implementation of multi-lateral international nature protection agreements and initiatives which party are their states, on the following spheres according to the powers determined by the national legal system of their states:
a) enhancement of the state control and supervision in the field of environmental protection and rational environmental management, economic regulation and economic instruments of environmental protection;
b) preserving biological diversity, including preserving and recovery of populations of the rare and being under the threat of disappearance animal species and plants, development of system of especially protected natural territories;
c) climate change and adaptation to its effects;
d) development of alternative energy sources;
e) integrated management of waste;
e) monitoring of the environment;
g) protection of atmospheric air, rational use and improvement of quality of water resources, including in cross-border context;
h) studying and the solution of global and regional problems on environmental improvement in zones of ecological catastrophe;
i) any other spheres which the Parties will consider possible according to the first paragraph of this Article.
2. For this purpose the Parties will make efforts in realization of the following tasks:
a) exchange of new advanced practicians, experience and technologies;
b) enhancement of the national legal system of the Parties;
c) development of policy and management system by the environment;
d) increase in potential, including strengthening of technical, technological and personnel capacity of the Parties;
e) implementation of the international multi-lateral nature protection treaties;
e) any other tasks which the Parties will consider necessary.
The cooperation in realization of tasks on the spheres specified in Article 2 of this agreement is performed in the following forms:
a) experience exchange, scientific and technical information in the field of environmental protection, and also new technologies;
b) development and implementation of joint programs and projects of technical assistance;
c) holding joint meetings, trainings, seminars and conferences;
d) exchange of visits of experts and scientists, including creation of conditions for advanced training of specialists;
e) any other forms of cooperation which can be jointly realized by the Parties.
For coordination and realization of cooperation within this Agreement of the Party within 30 days from the date of the signature of this agreement in writing notify each other on responsible persons.
In case of replacement of the corresponding responsible persons of the Party inform each other on replacement and new responsible persons within 30 days.
The results of cooperation received during implementation of this agreement can be transferred to the third states, their legal entities or physical persons only from the prior written consent of the Parties.
The data constituting the state secrets of the Republic of Belarus and the state mystery of the Republic of Uzbekistan are not subject to transfer within this agreement.
The expenses connected with implementation of provisions of this agreement make a reservation and approved by the Parties in each case separately.
Any disputes which can arise between the Parties connected using and interpretation of this agreement, are solved by consultations and negotiations.
This agreement is applied without prejudice to the rights and obligations of the Parties following from other international treaties which participants are their states and is implemented according to regulations of the legislation of the states parties.
As agreed by the parties changes and additions which are drawn up by separate protocols can be made to this agreement and are integral part of this agreement.
This agreement becomes effective from the date of its signing, is effective within five years and is automatically prolonged for the subsequent five-year periods if any of the Parties at least in six months prior to the end of the initial or next period does not notify other Party through official diplomatic channels on the intention to stop its action.
Cancellation of this agreement does not involve the termination of implementation of the projects and programs which are carried out within this agreement and are not completed by the time of the termination of its action.
It is made in Minsk on August 1, 2019 in duplicate, everyone in the Russian and Uzbek languages.
In case of discrepancy in interpretation of provisions of this agreement of the Party will be guided by the text in Russian.
