Cabinet of Ministers of Ukraine decides:

1. Form the working group on rekodifikation (updating) of the civil legislation of Ukraine in structure according to appendix.

2. Approve Regulations on the working group on rekodifikation (updating) of the civil legislation of Ukraine which are applied.

Regulations on the working group on rekodifikation (updating) of the civil legislation of Ukraine

1. The working group on rekodifikation (updating) of the civil legislation of Ukraine (further - working group) is temporary advisory advisory body of the Cabinet of Ministers of Ukraine.

2. The working group in the activities is guided by the Constitution and the laws of Ukraine, and also the presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine accepted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine and this Provision.

3. The main objectives of working group are:

1) carrying out the complex analysis of the existing civil legislation of Ukraine and determination of spheres of the private-law relations which require reduction in compliance with world tendencies of development of private law;

2) studying of experiment of the European countries on rekodifikation (updating) of the civil legislation of Ukraine;

3) preparation of offers on rekodifikation (updating) of the civil legislation of Ukraine.

4. Working group according to the tasks assigned to it:

1) is carried out by the analysis of the state of affairs in the sphere of private-law regulation;

2) is performed by search of optimum precepts of law the, namely European and universal international documents necessary for settlement of spheres of the private-law relations in Ukraine;

3) participates in project development of regulatory legal acts on the questions which are within its competence;

4) submits to the Cabinet of Ministers of Ukraine the offers developed by results of the work.

5. The working group has the right:

To receive 1) in accordance with the established procedure from central and local executive bodies, local government bodies, the companies, organizations and the organizations information necessary for accomplishment of the tasks assigned to it;

2) to recruit in the work representatives central and local executive bodies, local government bodies, the companies, organizations and the organizations (in coordination with their heads);

3) to organize holding of conferences, seminars, meetings and other actions for the questions which are within its competence.

6. The working group during accomplishment of the tasks assigned to it interacts with state bodies, local government bodies, the companies, organizations and the organizations.

7. The official structure of the working group affirms the Cabinet of Ministers of Ukraine.

8. The working group is formed as a part of the chairman, the vice-chairman, the secretary and her members.

The chairman of working group approves its members and brings, in case of need, in it changes.

9. Form of work of working group are meetings which are held according to the decision of its chairman.

Meetings of working group are conducted by the chairman, and in case of its absence - the vice-chairman.

Preparation of materials for consideration at meetings of working group is provided by her secretary.

The meeting of working group is considered competent if at it there are more than a half of her members.

10. At the meetings the working group develops offers on the questions which are within its competence.

Offers are considered approved if more than a half of the workgroup members who are present at meeting voted for them.

In case of equal distribution of voices the chairman's voice at meeting is decisive.

Offers are drawn up by the minutes which are signed by the chairman at meeting and the secretary and goes to all workgroup members and the Cabinet of Ministers of Ukraine.

The workgroup member who does not support the offer can state in writing the special opinion which is applied to the minutes.

11. Proposals of the working group can be realized by adoption by the Cabinet of Ministers of Ukraine of the decision which draft is introduced by executive body according to the powers.

12. Organizational, information, material logistics of activities of working group performs Ministry of Justice.
