1. Approve the enclosed Provision of republican public institution "Committee on information security of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan".

Recognize invalid the order of the acting minister of digital development, the defense and aerospace industry of the Republic of Kazakhstan of the Republic of Kazakhstan of April 10, 2019 as No. 33/Tax Code "About approval of the Provision of republican public institution "Committee on information security of the Ministry of digital development, the defense and aerospace industry of the Republic of Kazakhstan" (it is published on July 9, 2019 in Reference control bank of regulatory legal acts of the Republic of Kazakhstan).

3. To provide to committee on information security of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan:

1) within ten calendar days from the date of signing of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan;

3) to take other measures following from this order.

4. To impose control of execution of this order on the supervising vice-minister of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

5. This order becomes effective from the date of its signing.

Regulations on republican public institution "Committee on information security of the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan"

Chapter 1. General provisions

1. The republican public institution "Committee on information security of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan" (further – Committee) is the department of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan (further – the Ministry) performing regulating, realizable and control functions, participating in accomplishment of strategic functions of the Ministry in the field of ensuring information security in the sphere of informatization, in the sphere of personal data and their protection, and also the electronic document and the digital signature regarding compliance with law of the Republic of Kazakhstan about the electronic document and the digital signature.

2. The committee performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

3. The committee is legal entity in form of business of public institution, has seals and stamps with the name in state language, forms of the established sample, according to the legislation of the Republic of Kazakhstan of the account in bodies of treasury.

4. The committee enters the civil relations from own name.

5. The committee has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation.

6. The committee on questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the Chairman of Committee and other acts, stipulated by the legislation the Republic of Kazakhstan.

Chapter 2. Tasks, rights and obligations of Committee

13. Tasks:

1) realization of state policy in information security field in the sphere of informatization, in the sphere of personal data and their protection, and also the electronic document and the digital signature regarding compliance with law of the Republic of Kazakhstan about the electronic document and the digital signature;

2) carrying out monitoring of ensuring information security of state bodies, physical persons and legal entities;

3) the prevention and rapid response to incidents of information security, including in the conditions of emergency situations of social, natural and technogenic nature, introduction of emergency or warlike situation;

4) providing, within the competence, control of compliance with law of the Republic of Kazakhstan;

5) implementation of other tasks assigned to Committee within the competence.

14. Rights and obligations:

1) issues orders within the competence;

3) makes suggestions for improvement of the legislation of the Republic of Kazakhstan;
