About Rules of evaluating activities of the government employee of the Republic of Tajikistan

1. Approve Rules of evaluating activities of the government employee of the Republic of Tajikistan (are applied).
2. To provide to heads of state bodies and self-government institutions of settlements and dekhot execution of requirements of these rules.
3. Declare invalid the presidential decree of the Republic of Tajikistan of February 18, 2011, No. 1018 "About approval of Rules of evaluating activities of the government employee of the Republic of Tajikistan".

1. Rules of evaluating activities of the government employee of the Republic of Tajikistan (further - Rules) determine procedure for evaluating activities of the administrative government employee (further - the government employee).
2. Assessment of activities of the government employee (further - activities assessment) is not applied to the political government employees, administrative government employees of the highest category, government employees who reached age limit of stay in public service and the government employee who worked in state body less months.
3. Assessment of activities of the government employee is carried out for the purpose of determination of results of work of the government employee within calendar year in the form of interview.
4. Assessment of activities consists of the following tasks:
- ensuring efficiency of accomplishment of job responsibilities of the government employee;
- encouragement of the government employee in connection with positive results of activities;
- taking measures in connection with negative results of assessment of activities, including determination of needs for advanced training for the purpose of enhancement of professional qualities and business capabilities of the government employee.
5. The basic principles of assessment of activities are:
- assessment of functional obligations according to the job description of the government employee;
- transparency of assessment of activities;
- office promotion of government employees on the basis of capabilities, talent, professional training and qualification requirements;
- accountability of the government employee.
6. Assessment of activities is carried out annually in December according to the schedule approved by the head of state body.
7. The government employee who worked in this state body more than 6 months (irrespective of change of positions), is subject to activities assessment. The government employee who was not participating in assessment of activities for etiology, stays on labor leave, official journey after arrival for work during not later than 15 working days is covered by activities assessment according to requirements of these rules.
8. Assessment of activities is carried out directly by the head of the structural unit where the government employee works. Assessment of activities of the head of the structural unit is carried out by his direct head.
9. If the head of the structural unit (the direct head) worked in state body less than 6 months, his deputy also takes part in activities assessment (or the corresponding deputy manager of state body).
10. Assessment of activities consists of the following stages:
- preparatory stage;
- stage of evaluating activities;
- implementation phase of results of assessment of activities.
11. The head of the structural unit (the direct head) bears the personal responsibility for objective assessment of activities and its transparent carrying out and:
- reports to the government employee about time and the venue of assessment of activities no later than 15 working days;
- according to the job description determines tasks which were carried out more than it was planned, the tasks reached partially or unachieved in general;
- objectively considers professional qualities and business capabilities of the government employee;
- by results of interview fills Items 1-7 of the Questionnaire of assessment of activities of the government employee (further - the Questionnaire of assessment) which are applied to these rules.
12. The interview of the head of the structural unit (the direct head) and the government employee is held with use of the annual statement of the government employee which is provided to the head of the structural unit (the direct head) no later than 10 working days before evaluating activities.
13. During interview the head of the structural unit (the direct head) and the government employee discuss results of activities of the government employee in reporting year and its subsequent tasks.
14. The head of the structural unit (the direct head) in the Questionnaire of assessment puts down the following marks:
- "the objectives are achieved with benefit" or are equal to assessment "5" (perfectly);
- "the objectives are achieved" or are equal to assessment "4" (well);
- "the objectives are achieved partially" or are equal to assessment "3" (well);
- "the objectives are not achieved" or are equal to assessment "2" (unsatisfactorily).
15. The head of the structural unit (the direct head) shall prove the assessment and if are exposed assessment "5" (perfectly) and "2" (unsatisfactorily) in the Questionnaire of assessment to specify realization of incentive measures (for assessment "5" (perfectly) and need for advanced training for the purpose of enhancement of professional qualities and business capabilities of the government employee (for assessment "2" (unsatisfactorily).
16. The government employee gets acquainted with the completed Questionnaire of assessment, and in case of consent with the conclusion of the head of the structural unit (the direct head) is signed. If the government employee does not agree with assessment of the direct head, he can specify disagreement basis in the corresponding Item of the Questionnaire of assessment. After completion of assessment of activities the Questionnaire of assessment is transferred to personnel service.
17. The head of state body by results of assessment of activities can accept concerning the government employee no later than 5 working days, the following decisions:
- inclusion in reserve of the managerial personnel;
