About approval of Requirements to development or adjustment of the conclusion of the central authorized body on state planning for provision of the state guarantees on export support

1. Approve the enclosed Requirements to development or adjustment of the conclusion of the central authorized body on state planning for provision of the state guarantees on export support.

2. To provide to department of investment policy in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of national economy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of national economy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Requirements to development or adjustment of the conclusion of the central authorized body on state planning for provision of the state guarantees on export support

Chapter 1. General provisions

1. These Requirements to development or adjustment of the conclusion of the central authorized body on state planning on export support (further – Requirements) are developed for provision of the state guarantees according to item 4 of Article 225-1 of the Budget code of the Republic of Kazakhstan (further – the Code) and determine requirements to development or adjustment of the conclusion of the central authorized body by state planning for provision of the state guarantees on export support.

2. In these Requirements the following concepts are used:

1) the state guarantee of the Republic of Kazakhstan on export support – the obligation of the Government of the Republic of Kazakhstan to Export credit agency of Kazakhstan in accordance with the terms of the agreement of guarantee on export support, fully or partially to repay its debt on insurance and warranty payments;

2) the conclusion of the central authorized body on state planning for provision state guarantees on export support (further – the conclusion) – the conclusion of the central authorized body on state planning regarding feasibility of provision of the state guarantee on export support (its influence on national economy and the compliance to strategic and (or) program documents prepared based on the positive industry conclusion of authorized body in the field of the state support of industrial and innovative activities) to Export credit agency of Kazakhstan;

3) the industry conclusion of authorized body in the field of regulation of foreign trade activity – the conclusion of authorized body in the field of regulation of foreign trade activity regarding compliance to priorities of development of industry by means of provision of the state guarantee on export support, the relevant Export credit agency of Kazakhstan.

Chapter 2. Requirements to development or adjustment of the conclusion of the central authorized body on state planning for provision of the state guarantees on export support

3. The conclusion is developed based on the following documents submitted by Export credit agency of Kazakhstan to authorized body on state planning on paper and electronic carriers with appendix:

1) information on the state guarantee which contains the amount of the state guarantee, the term of its action, the institutional scheme of use of the state guarantee (information on all participants of process, their interaction);

2) information on Export credit agency of Kazakhstan which contains copies of constituent documents, and also documents confirming the status of Export credit agency of Kazakhstan, the development strategy of the company, the rating report;

3) the positive conclusion of authorized body in the field of regulation of foreign trade activity according to the subitem 2) article 225-3 of the Code.

4. The central authorized body on state planning considers the documents specified in Item 3 of these Requirements.

5. Following the results of consideration of the documents specified in Item 3 of these Requirements, the central authorized body on state planning in time no later than 30 (thirty) working days from the date of their submission by Export credit agency of Kazakhstan to authorized body on state planning prepares the conclusion in form according to appendix to these Requirements.

6. If within 3 (three) years after provision of the conclusion by the central authorized body on state planning the state guarantee is not issued by Export credit agency of Kazakhstan, this conclusion is subject to adjustment.

7. In case of adjustment of the conclusion the Export credit agency of Kazakhstan submits to authorized body on state planning documents according to Item 3 of these Requirements.
