According to subitem 8-1) of Item 1 of article 29 of the Law of the Republic of Kazakhstan of December 30, 1998 "About the state control of turnover of separate types of weapon" I ORDER:

1. Approve the enclosed Criteria for the organizations performing preparation and retraining of owners and users of civil and office weapon.

2. To provide to committee of administrative police of the Ministry of Internal Affairs of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Ministry of Internal Affairs of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of Internal Affairs of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising deputy minister of internal affairs of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Criteria for the organizations performing preparation and retraining of owners and users of civil and office weapon

Chapter 1. General provisions

1. Preparation and retraining of owners and users of civil and office weapon, and also persons of the permissions to acquisition, storage, storage and carrying civil and office weapon applying for obtaining is carried out in the Centers of special preparation and retraining of owners and users of civil and office weapon, and also in Specialized training centers on preparation and advanced training of the workers holding position of the head and security guard in the private security organization and the sports organizations as a part of accredited Republican federation for shooting sports (bullet, bench, practical), according to the carried-out authorized tasks in the field of physical culture and sport (further - the Center).

Chapter 2. Criteria for the organizations performing preparation and retraining of owners and users of civil and office weapon

2. The centers perform preparation and retraining of owners and users of civil and office weapon in case of compliance to the following criteria:

1) availability of shooting shooting gallery for teaching fire preparation, for legal entities on the property right or leases;

2) availability of rooms on the property right or leases, for training;

3) availability of civil and office weapon and cartridges to it acquired according to the arms regulations established by authorized body on control of turnover of civil and office weapon for carrying out practical training on fire preparation;

4) availability in property or leases of specially equipped room (the weapon room) for storage of civil and office weapon and cartridges to it, with the permission to storage of the weapon received in territorial authority of police;

5) the teachers having the higher education, having the corresponding theoretical, practical knowledge and skills of teaching in the field of the professional competence and specialists (instructors) having work experience in the field of turnover of civil and office weapon are involved in training process;

6) availability of training programs and plans for preparation and retraining of the owners and users of civil and office weapon approved by authorized body on control of turnover of civil and office weapon;

7) availability of the computer equipment with the automated electronic database of persons (applicants, owners and users) who were trained with possibility of data transmission in the mode of "real time" in divisions on control of turnover of civil and office weapon of police agencies.

3. The persons which are not conforming to requirements of article 19 of the Law of the Republic of Kazakhstan "About the state control of turnover of separate types of weapon", having medical contraindications to ownership of weapon are not allowed to teaching fire preparation.

4. In cases not compliance to requirements of Items 2 and 3 of these criteria the question of the termination of activities of the Centers is performed according to Article 49 of the Civil code of the Republic of Kazakhstan.
