1. Approve enclosed:

1) Regulations on the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan;

2) changes and additions which are made to some decisions of the Government of the Republic of Kazakhstan.

2. Reorganize the Management committee land resources of the Ministry of Agriculture of the Republic of Kazakhstan by allocation of Committee of geodesy from it and cartography of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan.

3. Rename:

1) republican public institution "Space committee of the Ministry of digital development, the defense and aerospace industry of the Republic of Kazakhstan" in republican public institution "Space committee of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan";

2) republican public institution "Committee on information security of the Ministry of digital development, the defense and aerospace industry of the Republic of Kazakhstan" in republican public institution "Committee on information security of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan";

3) republican public institution "Committee of telecommunications of the Ministry of digital development, defense and aerospace industry of the Republic of Kazakhstan" in republican public institution "Committee of telecommunications of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan";

6) republican public institution "Research institution of micrography" of the Ministry of digital development, the defense and aerospace industry of the Republic of Kazakhstan in republican public institution "Research institution of micrography" of the Ministry of national economy of the Republic of Kazakhstan;

7) the republican state companies according to appendix 2 to this resolution.

4. Determine:

1) the Ministry of the industry and infrastructure development of the Republic of Kazakhstan by authorized body in management of the corresponding industry (sphere) of public administration concerning the republican legal entity specified in Item 1 of appendix 2 to this resolution;

2) the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan authorized body on management of the corresponding industry (sphere) of public administration concerning the republican legal entity specified in Item 2 of appendix 2 to this resolution;

3) Space committee of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan authorized body on management of the corresponding industry (sphere) of public administration concerning the republican legal entities specified in Items 3-4 of appendix 2 to this resolution;

4) Committee of geodesy and cartography of the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan authorized body on management of the corresponding industry (sphere) of public administration concerning the republican legal entities specified in Items 5-6 of appendix 2 to this resolution;

5) Committee on the state material reserves of the Ministry of national economy of the Republic of Kazakhstan authorized body on management of the corresponding industry (sphere) of public administration concerning the republican legal entity specified in Item 7 of appendix 2 to this resolution.

5. To transfer to committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation:

1) to the Ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan and to its departments of right of possession and uses of the state blocks of shares and shares of participation of legal entities according to appendix 3 to this resolution;

2) to the Ministry of the industry and infrastructure development of the Republic of Kazakhstan of right of possession and uses of the state blocks of shares and shares of participation of legal entities according to appendix 4 to this resolution.

6. To the ministries of digital development, innovations and aerospace industry, national economy, industry and infrastructure development, agricultural industry of the Republic of Kazakhstan together with Committee of state-owned property and privatization of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to take other measures following from this resolution.

7. Recognize invalid the subitem 2) of Item 1 of the order of the Government of the Republic of Kazakhstan of March 26, 2019 as No. 142 "About some questions of the Ministry of information and social development of the Republic of Kazakhstan and the Ministry of digital development, the defense and aerospace industry of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan 2019, Art. No. 5-6, 64).

8. This resolution becomes effective from the date of its signing.

Regulations on the Ministry of digital development, innovations and aerospace industry of the Republic of Kazakhstan

Chapter 1. General provisions

1. The ministry of digital development, innovations and the aerospace industry of the Republic of Kazakhstan (further - the Ministry) is the state body of the Republic of Kazakhstan performing management and cross-industry coordination in spheres of the aerospace and electronic industry in the field of innovative activities, scientific and technical development of the country, geodesy, cartography and spatial data, ensuring information security in spheres of informatization, "the electronic government", personal data and their protection, digital assets, project management, and also in the field of communication, development of state policy in the sphere of rendering the state services and in data management (further - regulated spheres).

2. The ministry has departments:

1) republican public institution "Space committee";

2) republican public institution "Committee on information security";

3) republican public institution "Committee of telecommunications";

4) No. 342 is excluded according to the Order of the Government of the Republic of Kazakhstan of 27.04.2024

5) republican public institution "Committee of the state services";

6) republican public institution "Committee of artificial intelligence and development of innovations".

3. The ministry performs the activities according to the Constitution and the laws of the Republic of Kazakhstan, acts of the President and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also this Provision.

4. The ministry is legal entity in form of business of public institution, has seals with the image of the State Emblem of the Republic of Kazakhstan and stamps with the name in Kazakh, forms of the established sample, accounts in bodies of treasury according to the legislation of the Republic of Kazakhstan.

5. The ministry enters the civil relations from own name.

6. The ministry has the right to act as the party of the civil relations on behalf of the state if it is authorized on it according to the legislation of the Republic of Kazakhstan.

7. The ministry of questions of the competence of the procedure established by the legislation makes the decisions which are drawn up by orders of the head of the Ministry.

8. The structure and limit of the number of staff of the Ministry affirm according to the current legislation of the Republic of Kazakhstan.

Chapter 2. Tasks and powers of state body

13. Tasks:

1) forming and carrying out effective state policy in regulated spheres, and also development of the competitive aerospace industry and ensuring information security in the sphere of informatization, realization of state policy in the field of space activities, in the sphere of personal data and their protection, in the field of communication, including distribution and use of national resource in the field of communication, and also participation in limits of the competence in technical regulation, ensuring unity of measurements and the sphere of standardization in the field of communication and ensuring its realization, forming and ensuring development of information and communication infrastructure, geodesy, cartography and spatial data, the sphere of the state support of innovative activities, development of intra country value in the sphere of innovative activities, scientific and technical development of the country, effective development and functioning of the market of communication services;

2) implementation of management and cross-industry coordination of state bodies in the field of activity carried to competence of the Ministry;

3) public administration and the state control in regulated spheres;

4) providing, within the competence, control of compliance with law of the Republic of Kazakhstan;

5) forming and development of space industry of the Republic of Kazakhstan;

6) creation of conditions for market grouping of space technologies and services;

7) creation legislative and the contractual legal base of space activities in the Republic of Kazakhstan;

8) coordination of works within the competence on lease of the Baikonur complex by the Russian Federation;

9) coordination in the field of mail and communication, and also regulation of activities in the field of mail in the territory of the Republic of Kazakhstan and the activities of persons providing services in the field of communication or using them;

10) implementation of management and cross-industry coordination in the sphere of informatization and "the electronic government";

10-1) implementation of cross-industry coordination on data management;

10-2) ensuring realization of state policy of data management;

10-3) implementation of cross-industry coordination of digital transformation of public administration;

11) forming and realization of state policy in the sphere of rendering the state services;

12) forming implementation, development and providing communications infrastructure of the Republic of Kazakhstan;

12-1) forming and realization of state policy in the field of distribution of radio-frequency range, and also effective use of radio frequencies and orbital line items of communication satellites;

13) international cooperation in regulated spheres within the competence according to the legislation of the Republic of Kazakhstan;

14) forming of state policy in spheres of information and communication technologies, communication and rendering the state services;

15) implementation of management of the corresponding industry (sphere) of public administration;

16) realization of state policy in the sphere of geodesy, cartography and spatial data;

17) planning, monitoring, stimulation, development of innovative system;

18) participation in realization of state policy in the sphere of personal data and their protection;

19) participation in forming and realization of state policy in the field of the state support of innovative activities;

19-1) forming and realization of the state technological policy;

20) implementation of state policy in the field of communication for effective functioning of the market of communication services;

21) implementation of state regulation and control of activities in the field of communication within the competence;

22) forming and implementation of state policy in the sphere of project management;

23) forming and implementation of state policy in the sphere of artificial intelligence.

14. Powers:

1) rights:

adopts regulatory legal acts, obligatory for execution, within the competence;

requests and receives in the procedure established by the legislation from state bodies, the organizations, their officials necessary information and materials;

brings to the President and the Government of the Republic of Kazakhstan suggestions for improvement of activities in the spheres regulated by the Ministry;
