About interaction in the field of fight against the customs offenses connected with movement of goods by air transport

The State Customs Committee of the Republic of Belarus and the Public fiscal service of Ukraine which are referred to as further "Party"

on the basis and being guided by regulations of the Agreement between the Government of the Republic of Belarus and the Cabinet of Ministers of Ukraine on cooperation and mutual aid in customs affairs of September 22, 2000 (further - the Agreement),

aiming at development of bilateral cooperation,

considering that violations of the customs legislation cause damage to economic, social and cultural interests of the states of the Parties,

for the purpose of protection of economic safety of the Republic of Belarus and Ukraine, increase in efficiency of fight against smuggling and other offenses carried to competence of customs authorities of the states of the Parties by exchange of information between the Parties,

agreed as follows:

Article 1

Action of the this Protocol extends to exchange of information, specified in Article 2 this Protocols, according to the Agreement for the purpose of fight against the customs offenses connected with movement of goods by air transport.

Article 2

The parties, according to the national legal system of the states of the Parties and the Agreement, are determined by authorized subordinates of division who communicate in process of its receipt relatively:

1) persons who, according to the available data, prepare are committed or committed the offenses or crimes connected with illicit movement of goods air transport between the territories of the states of the Parties through the airports specified in the appendix No. 1 to the this Protocol which is its integral part;

2) the goods and objects moved with physical persons or legal entities air transport between the territories of the states of the Parties with violation of the customs legislation of the state of the either party.

Article 3

Exchange of information within the this Protocol is performed by transfer of the message completed in Russian in the form specified in the appendix No. 2 to the this Protocol which is its integral part.

Article 4

The notification on results of verification of information obtained within the this Protocol is performed without delay by transfer of the message completed in Russian in the form specified in the appendix No. 3 to the this Protocol which is its integral part.

Article 5

Exchange of information and results of its check within the this Protocol is performed on the communication channels established by the Parties and between responsible persons of authorized subordinates of divisions of the Parties.

The parties within 15 days after entry into force of the this Protocol in writing direct each other lists of responsible persons of authorized subordinates of divisions of the Parties and further without delay inform each other on all changes in these lists.

Article 6

Any disagreements between the Parties concerning application of the this Protocol will be solved by negotiations and consultations.

Article 7

By mutual consent of the Parties in the this Protocol changes and additions which are drawn up by the protocols which are becoming effective according to the procedure, stipulated in Clause the 9th this Protocol can be made.

Article 8

The parties can terminate the this Protocol, in 6 (six) months from the date of receipt of one of the Parties of the written notice of other Party of the intention to terminate this Protocol.

Article 9

The this Protocol becomes effective from the date of its signing and consists for operation of the Agreement.

It is made in Brussels on June 28, 2019 in two authentic copies, everyone in the Russian and Ukrainian languages, and all texts are equally authentic.
