Chapter 1. General provisions

Article 1. Purpose of this Law

This Law governs the relations connected with traffic in weapons and ammunition to it and is directed to protection of life and health of citizens, property and ensuring public safety.

Article 2. Legislation on weapon

The legislation on weapon consists of this Law and other acts of the legislation.

If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about weapon then are applied rules of the international treaty.

Article 3. Basic concepts

In this Law the following basic concepts are applied:

gas weapon - the weapon intended for temporary defeat of the live purpose by use of the tear or irritating substances;

short-barreled weapon - weapon which length of trunk does not exceed three hundred millimeters and which total length does not exceed six hundred millimeters;

pneumatic weapon - the weapon intended for defeat of the purpose at distance by the shell receiving directed movement due to energy of the compressed, liquefied or cured gaseous substance;

alarm weapon - the weapon which is structurally intended only for giving of light, smoke or sound signals;

cold weapon - the weapon intended for defeat of the purpose by means of physical force of the person in case of direct contact with object of defeat;

objects which can be used as cold weapon - the bladed, cutting objects made in the industrial or self-made way (knives, probes and others with the undermined edge the pricking, cutting objects), objects which in case of use of physical force can do harm (baseball bats, bits for playing softball), held for use in professional, productive or sports activity or the economic and household purposes;

throwing weapon - the weapon intended for defeat of the purpose at distance by the shell receiving directed movement by means of physical force of the person or the mechanical device;

ammunition - the objects of arms and metayemy equipment to weapon intended for defeat of live or other purpose and containing explosive, powder, throwing, pyrotechnic or vyshibny charges or their combination;

firearms - the weapon intended for mechanical defeat of the purpose at distance by the shell receiving directed movement due to energy of powder or other charge;

the main parts of firearms - trunk, lock, shop (drum), frame, receiver;

weapon - the devices and objects which are structurally intended for defeat of live or other purpose, giving of signals. The products, structurally similar to weapon, certified in product quality of economic and household and production appointment and also the apparatuses structurally similar to weapon do not belong to weapon;

traffic in weapons - production, repair, realization, acquisition, accounting, storage, carrying, transportation, collecting, exhibiting, use, withdrawal, destruction, import of weapon and ammunition to it, the main parts of firearms on the territory of the Republic of Uzbekistan and export them from the territory of the Republic of Uzbekistan, and also their transit through the territory of the Republic of Uzbekistan;

the owner of weapon - physical person or legal entity in which ownership there is weapon acquired according to requirements of this Law.

Article 4. The basic principles of traffic in weapons and ammunition to it

The basic principles of traffic in weapons and ammunition to it are:

legality;

priority of protection and preserving life and health of citizens, their rights and freedoms;

conscientiousness of accomplishment of the international obligations of the Republic of Uzbekistan in the field of traffic in weapons and ammunition to it,

publicity and availability of information on questions of traffic in weapons and ammunition to it.

Chapter 2. Classification of weapon

Article 5. Types of weapon

Weapon on purpose and key parameters and characteristics is subdivided on civil, office and fighting.

Article 6. Civil weapon

The weapon intended for occupations by hunting and sport and also for use for the purpose of self-defense belongs to civil weapon.

Civil weapon is subdivided on:

1) hunting weapon:

firearms with rifle barrel;

fire smooth-bore weapon, including with length of cut part no more than hundred forty millimeters;

the fire combined weapon (with rifle barrel and smooth-bore), including with replaceable and supplementary rifle barrels;

pneumatic weapon;

cold bladed weapon (hunting knives, hunting stilettos and daggers);

alarm weapon;

2) sports weapon:

firearms with rifle barrel;

fire smooth-bore weapon;

cold bladed weapon (rapiers, swords and sabers);

throwing weapon (onions, arbalests and spear);

pneumatic weapon;

alarm weapon;

3) self-defense weapon:

gas weapon - the gas sprays, mechanical sprays, aerosol and other devices equipped with the tear or irritating substances;

electroconvulsive devices, spark rated sportsmen and other devices which striking operation is based on use of electrical energy.

The civil firearms shall exclude firing by queues and have reservoir of shop (drum) no more than ten cartridges.

Article 7. Office weapon

Weapon, held for use workers of legal entities belongs to office weapon in case of accomplishment of tasks on protection of life and health of citizens, property, conservation and natural resources, valuable and dangerous goods, special correspondence (further - legal entities with special office tasks), and also officials of state bodies for the purpose of ensuring personal security.

Office weapon shall exclude firing by queues, have reservoir of shop (drum) no more than ten cartridges, caliber no more than twenty five millimeters for smooth-bore and nine millimeters for short-barreled weapon with rifle barrel with dulny energy to three hundred fifty joules.

The list of legal entities with special office tasks and officials of the state bodies having the right to storage, carrying, use of office weapon is established by the Cabinet of Ministers of the Republic of Uzbekistan.

Article 8. Military weapon

The weapon intended for conducting combat operations and accomplishment of office tasks which is taken advantage belongs to military weapon or it is intended to acceptance on arms of the Ministry of Defence, Ministry of Internal Affairs, Service of state security of the Republic of Uzbekistan, Public service of safety of the President of the Republic of Uzbekistan, National guard, the State Customs Committee, Center of development of electronic technologies of the Republic of Uzbekistan, military forming of the Ministry of Emergency Situations, Ministry of development of information technologies and communications of the Republic of Uzbekistan (further - special bodies and military forming).

Acquisition, storage and use of military weapon and ammunition to it are performed by exclusively special bodies and military forming, and also legal entities with the special office tasks provided by part seven of article 12 of this Law.

The procedure for turnover of military weapon and ammunition to it is established by the President of the Republic of Uzbekistan.

Chapter 3. Traffic in weapons and ammunition to it

Article 9. The restrictions set on turnover of civil and office weapon and ammunition to it

In the territory of the Republic of Uzbekistan it is forbidden:

1) turnover as civil and office weapon and ammunition to it:

fire long-barreled weapon with reservoir of the shop (drum) more than ten cartridges having trunk length with receiver less than five hundred millimeters and total length of weapon less than eight hundred millimeters, and also having design which allows to put it to shift or sort to length less than eight hundred millimeters without loss of possibility of production of shot;

firearms which have the form imitating other objects;

the fire smooth-bore weapon made under cartridges to firearms with rifle barrel;

fire besstvolny weapon (weapon in which as trunk the boss's sleeve is used);

the firearms from polymeric and composite materials which are unpacked on the 3D-printer;

the electroconvulsive devices, spark rated sportsmen and other devices having the output parameters which are not meeting the standards established by the Cabinet of Ministers of the Republic of Uzbekistan;

the gas weapon equipped with the nervnoparalitichesky, poisoning and other strong substances which are not allowed for use by the Cabinet of Ministers of the Republic of Uzbekistan;

weapon which striking action is based on use of radioactive radiation, chemical and biological (bacteriological) factors;

weapon and other objects which striking action is based on use of electromagnetic, light, thermal, infrasonic or ultrasonic radiation;
