About approval of Aviation rules of Ukraine "Maintenance of the flight validity of air vehicles and aviation products, components and the equipment and approval of the organizations and personnel involved in accomplishment of these tasks" (Extraction)

According to Article 11, parts three of article 42 of the Air code of Ukraine, to the Law of Ukraine "About the Nation-wide program of adaptation of the legislation of Ukraine to the European Union law" and for the purpose of implementation of Regulations of the European Commission of November 26, 2014 (EU) No. 1321/2014 (with corrections, considering Regulations of the European Commission of September 16, 2015 (EU) No. 2015/1536) of PRIKAZYVAYU:

1. Approve Aviation rules "Maintenance of the flight validity of air vehicles and aviation products, components and the equipment and approval of the organizations and personnel involved in accomplishment of these tasks" (further - Aviation rules) which are applied.

2. (Ovchinnikov V. M.) in the procedure established by the legislation to provide to department of the flight validity:

submission of this order on state registration in the Ministry of Justice of Ukraine;

promulgation of this order on the official site;

development till June 30, 2019 of all necessary procedures connected with introduction of Aviation rules.

3. Determine that:

1) the certificates of review of the flight validity issued according to the Rules on maintenance of the flight validity (Part-M) approved by the order of the Ministry of infrastructure of Ukraine of February 10, 2012 No. 85, registered in the Ministry of Justice of Ukraine on February 28, 2012 for No. 333/20646 (with changes) (further - Rules on maintenance of the flight validity (Part-M)), remain in force during the effective period established in them;

2) certificates of approval of the organizations for management of maintenance of the flight validity and certificates of approval of the organizations for maintenance issued according to Rules on maintenance of the flight validity (Part-M) remain acting before issue of new certificates according to requirements of Aviation rules;

3) the certificates of approval of the organizations for preparation for maintenance and examination issued according to Rules of approval of the organizations for preparation for maintenance (Part-147) approved by the order of the Ministry of infrastructure of Ukraine of July 27, 2011 No. 237, registered in the Ministry of Justice of Ukraine on August 18, 2011 for No. 986/19724, remain acting before issue of new certificates according to requirements of Aviation rules;

4) the certificates of personnel on maintenance of air vehicles granted according to Rules of issue of certificates to personnel on maintenance of air vehicles (Part-66) approved by the order of the Ministry of infrastructure of Ukraine of July 27, 2011 No. 238, registered in the Ministry of Justice of Ukraine on August 18, 2011 for No. 987/19725, remain in force during the effective period established in them;

5) the certificates of approval of the organizations for maintenance issued according to Rules of approval of the organizations for maintenance (Part-145) approved by the order of the Ministry of Transport and Communications of Ukraine of April 20, 2010 No. 209, registered in the Ministry of Justice of Ukraine on August 2, 2010 for No. 591/17886 (with changes), remain acting before issue of new certificates according to requirements of Aviation rules;

6) before the date of receipt by the organizations for management of maintenance of the flight validity of privileges according to M.A.711 (b) of appendix 1 (Part-M) to Aviation rules review of the flight validity is performed by authorized body concerning civil aviation in case of satisfactory results of estimation of the recommendation issued by the organization for management of maintenance of the flight validity approved properly according to Podchasti's requirements G Sections A of appendix 1 (Part-M) to Aviation rules.

Before the date of receipt by the organizations for management of maintenance of the flight validity of privileges according to M.A.711 (b) of appendix 1 (Part-M) to Aviation rules the organization for management of maintenance of the flight validity is approved on the provision right to authorized body concerning civil aviation of the recommendation concerning review of the flight validity according to the provisions M.A.711 (b) 2 of appendix 1 (Part-M) to Aviation rules.

4. Recognize invalid:

1) the order of the Ministry of Transport and Communications of Ukraine of April 20, 2010 No. 209 "About approval of Rules of approval of the organizations for maintenance (Part-145) and approval of Changes in Rules of certification of the organizations for maintenance of aviation engineering", registered in the Ministry of Justice of Ukraine on August 2, 2010 for No. 591/17886 (with changes);

2) the order of the Ministry of infrastructure of Ukraine of July 27, 2011 No. 237 "About approval of Rules of approval of the organizations for preparation for maintenance (Part-147)", registered in the Ministry of Justice of Ukraine on August 18, 2011 for No. 986/19724;

3) the order of the Ministry of infrastructure of Ukraine of July 27, 2011 No. 238 "About approval of Rules of issue of certificates to personnel on maintenance of air vehicles (Part-66)", registered in the Ministry of Justice of Ukraine on August 18, 2011 for No. 987/19725;

4) the order of the Ministry of infrastructure of Ukraine of February 10, 2012 No. 85 "About approval of Rules on maintenance of the flight validity (Part-M)", registered in the Ministry of Justice of Ukraine on February 28, 2012 for No. 333/20646 (with changes).

5. This order becomes effective since June 30, 2019, but not earlier than day of its official publication, except subitems 2, 3 items 4 of this order and appendices 3 - 5 to Aviation rules which become effective since June 30, 2020.
