Approved by the Decision of CIS Economic Council on the Procedure for document distribution on interstate standardization of June 21, 2019
1. This Procedure is developed for the purpose of implementation of the Distribution agreement of documents on interstate standardization of June 1, 2018 (further - the Agreement) and determines distribution terms of documents by interstate standardization and protection against their unauthorized distribution.
2. This Procedure is directed to achievement of the widest dissemination of documents on interstate standardization taking into account protection of the specified documents and unity of the principles of their distribution.
3. The disputes between the State Parties of the Agreement connected with interpretation and (or) application of this Procedure are permitted by negotiations and consultations according to article 8 of the Agreement.
4. Documents on interstate standardization are the interstate standards accepted by Interstate council on standardization, metrology and certification (MGS), rules and recommendations about interstate standardization, interstate qualifiers of technical and economic and social information and change to them, and also their transfers and projects.
5. National authority on standardization - the body for standardization recognized at the national level which has the right to represent the interests of the state in the field of standardization in the relevant international or regional standardization organization.
6. Authorized organization - the organization registered in the territory of the respective State Party of the Agreement and given national authority on standardization by the authority provided by the Agreement.
7. The document distribution on interstate standardization is understood as reproduction, copying, transfer of documents on interstate standardization for the purpose of their sale or provision by different way, in printing or electronic form, including as a part of collections, bases and databanks, other information resources, including the information resources which are posted online.
8. The State Parties of the Agreement can translate documents on interstate standardization into the state languages, and also into other languages in case of their acceptance as the national.
9. Documents on interstate standardization or their part shall not be provided to the third parties free of charge, irrespective of method of application or their acceptance as national, and also availability of references to these documents in legal acts of the State Parties of the Agreement if other is not established by this Procedure.
10. The State Parties of the Agreement distribute documents on interstate standardization in the territories of other State Parties of the Agreement, including the direction of promotional materials in the territory of other State Parties of the Agreement, only in the presence of the written permission from the specified State Parties of the Agreement to making of such actions including if documents on interstate standardization are not accepted by the specified State Parties of the Agreement as the national.
11. If process of standardization includes stage of public discussion when draft documents on interstate standardization become available to all interested persons to commenting, such projects are provided free of charge in case of observance of the rights to them. By provision of the specified access registration of participants of public discussion can be provided. The draft documents provided for public discussion on interstate standardization are posted online in the format which is not allowing to perform their loading.
12. The exclusive right on document distribution on interstate standardization is reserved for national authorities on standardization or the organizations authorized by them. In each State Party of the Agreement there can be only one authorized organization. National authorities notify Bureau according to the MGS standards on appointment of authorized organizations them. The list of authorized organizations is posted by Bureau according to the MGS standards on the official site of MGS on the Internet.
13. The bureau according to the MGS standards does not distribute documents on interstate standardization.
