About customs declaration of goods for private use

According to Item 5 of Article 105, Item 5 of Article 109, Items 1 and 6 of Article 112, the paragraph the second Item 3 of Article 260 and Item 2 of Article 263 of the Customs code of the Eurasian Economic Union the Board of the Eurasian economic commission solved:

1. Approve enclosed:

form of the passenger customs declaration;

Procedure for filling of the passenger customs declaration and making of the customs transactions connected with change (amendment) of the data declared in the passenger customs declaration.

2. Determine that:

a) customs declaration of goods for private use, placed under customs procedure of customs transit, in the presence of other goods for private use which are subject to customs declaring is performed by filling of the separate form of the passenger customs declaration;

b) in case of customs declaring of temporarily imported vehicle for private use for the purpose of export from customs area of the Eurasian Economic Union (further – the Union) the passenger customs declaration in document type on paper which is drawn up by customs authority in case of temporary import on customs area of the Union of such vehicle can be used. After release of temporarily imported vehicle for private use for export from customs area of the Union such passenger customs declaration returns to the customs applicant. In the presence of other goods for private use which are subject to customs declaring, their customs declaring for the purpose of export is performed by filling of the separate form of the passenger customs declaration;

c) data on goods for private use of the physical persons which did not reach 16-year age are specified together with data on goods for private use of person accompanying specified persons in one passenger customs declaration;

d) submission of the passenger customs declaration on paper is not followed by representation of its electronic type to customs authority (including in case of use of the passenger customs declaration in case of customs declaration of goods for private use, placed under customs procedure of customs transit);

e) change (amendment) of the data declared in the passenger customs declaration after release of goods for private use is made if it is necessary to change (to add) data on the goods for private use which are subject to accounting (registration) in the relevant authorized state bodies of state members of the Union and (or) the data relating to such goods for private use.

3. Recognize invalid:

The decision of the Commission of the Customs union of June 18, 2010 No. 287 "About approval of form of the passenger customs declaration and procedure for filling of the passenger customs declaration";

Item of 1 changes made to decisions of the Commission of the Customs union (appendix to the Decision of Board of the Eurasian economic commission of January 21, 2014 No. 7);

Item of 1 changes made to decisions of the Commission of the Customs union concerning customs declaration of goods for private use in case of their room under customs procedure of customs transit (appendix to the Decision of Board of the Eurasian economic commission of July 18, 2014 No. 115);

paragraph two of Item 2 of the Decision of Board of the Eurasian economic commission of April 27, 2015 No. 38 "About modification of some decisions of the Commission of the Customs union and Board of the Eurasian economic commission" and Item of 3 changes made to decisions of the Commission of the Customs union and Board of the Eurasian economic commission (appendix to the specified Decision);

Item of 3 changes made to decisions of the Commission of the Customs union and Board of the Eurasian economic commission (appendix to the Decision of Board of the Eurasian economic commission of October 6, 2015 No. 129);

Item of 1 changes made to decisions of the Commission of the Customs union (appendix to the Decision of Board of the Eurasian economic commission of November 14, 2017 No. 148).

4. This Decision becomes effective since February 1, 2020, except for Items 41-57, 59 and 61 of the Procedure approved by this Decision.

Items 41 – 57, 59 and 61 Procedures, approved by this Decision, become effective since April 1, 2021.

Procedure for filling of the passenger customs declaration and making of the customs transactions connected with change (amendment) of the data declared in the passenger customs declaration

I. General provisions

1. This Procedure determines rules of filling of the passenger customs declaration in case of customs declaration of goods for private use (further - goods), including in case of use of the passenger customs declaration when placing goods under customs procedure of customs transit, in the form of the electronic document and in document type on paper, and also rules of making of the customs transactions connected with change (amendment) of the data declared in the passenger customs declaration.

2. The passenger customs declaration in the form of the electronic document is filled in according to the structure determined by the Eurasian economic commission (further - the Commission).

The passenger customs declaration in document type is on paper filled in in the form approved by the Decision of Board of the Eurasian economic commission of July 23, 2019 No. 124.

3. When filling the passenger customs declaration in the form of the electronic document the reference books and qualifiers which are part of resources of single system of normative reference information of the Eurasian Economic Union (further - the Union), and also the reference books and qualifiers used for the customs purposes, created and which are subject to application according to the legislation of state members of the Union are applied (further - state members).

4. For the purposes of this Procedure the column is understood as detail (details) of structure of the passenger customs declaration in the form of the electronic document or structural unit of form of the passenger customs declaration in document type on paper which can include subsections, columns (columns), elements, fields. According to this Procedure in one column the data combined on one sign are specified.

5. The passenger customs declaration in the form of the electronic document may contain the data of technical nature necessary for its automated processing. Such data are created by information system. The structure of the specified data is determined in structure of the passenger customs declaration in the form of the electronic document.
