AGREEMENT

About exchange of information about the goods and vehicles of international delivery moved through customs borders of the Eurasian Economic Union and People's Republic of China

The Republic of Armenia, the Republic of Belarus, the Republic of Kazakhstan, the Kyrgyz Republic and the Russian Federation which are members of the Eurasian Economic Union (further - state members of the Eurasian Economic Union), both the Eurasian Economic Union, on the one hand, and the People's Republic of China (PRC), on the other hand, further referred to as with the Parties,

understanding need of holding joint actions for assistance to trade and simplification of procedures of trade, to safety, protection of economic interests of the Eurasian Economic Union and the People's Republic of China, strengthening of cooperation in the field of exchange of customs information,

aiming by means of regular exchange of information about the goods and vehicles of international delivery moved through customs borders of the Eurasian Economic Union and the People's Republic of China to prevent, reveal and stop violations of the international treaties and acts entering the right of the Eurasian Economic Union, the legislation of state members of the Eurasian Economic Union and the legislation of the People's Republic of China regulating customs legal relationship

intending to simplify customs procedures, to promote acceleration of making of customs transactions and carrying out customs control of the moved goods and vehicles of international delivery,

supporting efforts on mutual interface of the Eurasian Economic Union and initiative "One belt, One way", on creation of the international logistical channels between the People's Republic of China, the Eurasian Economic Union and Europe,

being guided by the conventional principles and rules of international law,

agreed as follows:

Article 1 of Determination

For the purposes of this agreement concepts which mean the following are used:

"the legislation of the Parties" - the international agreements, legislative and regulatory legal acts of state members of the Eurasian Economic Union and the People's Republic of China, and also the international agreements and acts constituting the right of the Eurasian Economic Union;

"information" - the data on goods and vehicles of international delivery transferred in electronic form according to this agreement;

"country of destination" - the country (region) of execution of customs papers on commodity importation;

"the country of departure" - the country (region) of execution of customs papers on commodity exportation;

"transit country" - the country (region) of execution of customs papers on transit transportation of goods;

"customs area of the Eurasian Economic Union" - the territories of state members of the Eurasian Economic Union, and also artificial islands which are beyond their limits, constructions, installations and other objects concerning which state members of the Eurasian Economic Union have the exclusive jurisdiction;

"customs area of the People's Republic of China" - the territory in which the customs legislation People's Republic of China is applied;

"goods" - any goods determined according to the customs legislation of the Parties and moved through customs borders of the Eurasian Economic Union and the People's Republic of China;

"vehicles of international delivery" - different types of vessel, land vehicles, including rail vehicles, aircrafts performing movement of goods through customs borders of the Eurasian Economic Union and the People's Republic of China.

Article 2 Agreement Purpose

The purpose of this agreement is the organization of cooperation for the exchange of information about the goods and vehicles of international delivery moved through customs borders of the Eurasian Economic Union and the People's Republic of China allowing to provide:

acceleration of making of customs transactions concerning the goods imported on customs areas of the Eurasian Economic Union and the People's Republic of China, and also the goods moved with transit;

use of data on the goods and vehicles of international delivery received during exchange of information for increase in efficiency in the field of risk management and enhancement of forms of customs control;

decrease in the risks connected with import to customs areas of the Eurasian Economic Union and the People's Republic of China potentially dangerous, prohibited and limited to movement goods with evasion from customs control, and other risks infringing on interests of the Parties in the field of safety.

Article 3 Subject of the agreement

1. Within implementation of this agreement of the Party perform exchange of information about the goods moved through customs borders of the Eurasian Economic Union and the People's Republic of China on automobile, railway, air, water (sea and river) modes of transport, and vehicles of international delivery.

2. Exchange of information is performed step by step in process of achievement of technical readiness by the Parties according to the separate protocols signed between the central customs authorities of state members of the Eurasian Economic Union performing based on the legislation of the states of function on realization of state policy, regulations in the field of customs affairs, and also function on control and supervision in the field of customs affairs and the Head customs authority of the People's Republic of China taking into account provisions of this agreement. The first of the specified protocols shall be signed not later than after 18 months from the date of the introduction of this agreement in force.

3. By the protocols specified in Item 2 of this Article the amount and the scope of information about goods and vehicles of international delivery concerning which exchange of information will be performed, taking into account Items 5 - the 7th this Article, appendix No. 1 to this agreement and criteria determined by the Parties, including the directions of movement of goods and methods of their transportation, commodity codes, check points, and also specifications of exchange of information shall be determined (structure and format of data, the used qualifiers and reference books, procedure and the regulations of exchange, exchange methods, the scheme of the organization of information exchange, the requirement to safety in case of exchange of information).

The structure and format of the transferred data are determined taking into account international standards, and also recommendations in the field of electronic data exchange of World Customs Organization and the United Nations Economic Commission for Europe.

4. The parties will aim at expansion of amount and the scope of information which are subject to exchange taking into account Items 5 - the 7th this Article and appendix No. 2 to this agreement.

5. State members of the Eurasian Economic Union provide to the People's Republic of China information on goods and vehicles of international delivery which are exported from state members of the Eurasian Economic Union:

in the People's Republic of China;
