About approval of the Payment procedure of monetary compensation of cost of sanatorium treatment to some categories of citizens

Cabinet of Ministers of Ukraine decides:

1. Approve the Payment procedure of monetary compensation of cost of sanatorium treatment to some categories of citizens it (is applied).

2. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of April 3, 1995 No. 236 "About the Procedure for provision and the sizes of monetary compensations of cost of sanatorium treatment to some categories of citizens" (the joint venture of Ukraine, 1995, No. 7, the Art. 161);

the resolution of the Cabinet of Ministers of Ukraine of September 12, 1996 No. 1114 "About modification of the Procedure for provision and the sizes of monetary compensations of cost of sanatorium treatment to some categories of citizens" (the joint venture of Ukraine, 1996, No. 18, the Art. 493).

Payment procedure of monetary compensation of cost of sanatorium treatment to some categories of citizens

1. This Procedure determines the payment mechanism of monetary compensation instead of the sanatorium permit (further - monetary compensation) and compensations of cost of independent sanatorium treatment provided by the Laws of Ukraine "About the status of veterans of war, guarantees of their social protection", "About the victims of Nazi prosecutions" and "About the basic principles of social protection of veterans of work and other citizens of old age in Ukraine".

2. The monetary compensation is paid to persons with disability owing to war and to persons with disability which are marked out in article 6-2 of the Law of Ukraine "About the victims of Nazi prosecutions" in the place of their accounting from the date of the address with the statement for allocation of the permit or payment of monetary compensation at will every two years if these persons within two years did not receive free sanatorium permits, irrespective of availability of the medical certificate about need of sanatorium treatment or medical contraindications.

The monetary compensation is paid in the following sizes (rounded to one hryvnia):

to persons with disability of I and II groups - 100 percent of average cost of the permit;

to persons with disability of III group - 75 percent of average cost of the permit.

In case of change of group of disability for the period of stay of person with disability on accounting the monetary compensation is paid in the amount of according to group of the disability established by it on payment date.

After obtaining by persons with disability owing to war and persons with disability specified in article 6-2 of the Law of Ukraine "About the victims of Nazi prosecutions" of monetary compensation the next period of their stay on accounting for providing with sanatorium treatment or receipt of the following monetary compensation is estimated from the date of submission by them of the statement and other documents.

3. The basis for payment of monetary compensation are the following documents:

statement for payment of monetary compensation;

the identity certificate (in particular, the electronic certificate of the veteran) which confirms its belonging to category of the citizens specified in Item 2 of this Procedure;

accounting data on receipt of permits and monetary compensation.

4. Compensation of cost of independent sanatorium treatment "About the basic principles of social protection of veterans of work and other citizens of old age in Ukraine" is paid to combatants, participants of war, members of families of the died (died) veterans of war, members of families of the died (died) Defenders and Defenders of Ukraine, persons which are marked out in articles 6-1, 6-3 and 6-4 of the Law of Ukraine "About the victims of Nazi prosecutions" and veterans of work according to the Law of Ukraine at will in the amount of the cost of independent sanatorium treatment for the period of carrying out improvement, but it is no more than average the cost of the sanatorium permit determined according to Item 7 of this Procedure.

4-1. After receipt of compensation of cost of independent sanatorium treatment by persons who are marked out in item 4 of this Procedure the period of the following their stay on accounting for providing with sanatorium treatment or for receipt of the following compensation of cost of independent sanatorium treatment is calculated from the date of submission by them of the statement and necessary documents.

5. The basis for payment of compensation of cost of independent sanatorium treatment are the following documents:

statement for compensation payment;

about payment of all-in cost of the sanatorium permit, about confirmation of passing of sanatorium treatment or the return coupon of the sanatorium permit of sanatorium treatment at least 18 days;

the identity certificate (in particular, the electronic certificate of the veteran) which confirms belonging to category of the citizens specified in item 4 of this Procedure.

6. The monetary compensation is paid to persons in two years after the address with the statement for allocation of the permit or payment of monetary compensation if they during this period did not receive free of charge sanatorium permit.

For persons who are not on accounting for sanatorium treatment for the first time the monetary compensation is paid in case of the address with the statement in two years after entry into force of the Law of Ukraine "About introduction of amendments to article 13 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection".

The entitlement to compensation of cost of independent sanatorium treatment comes from the date of the address with the statement for its payment every two years (taking into account year of passing of independent sanatorium treatment).

In case of change of the status of person the period of its stay on accounting for receipt of monetary compensation is calculated from the date of finding of the new status.

7. Average cost of the permit for payment of monetary compensation and compensation of cost of independent sanatorium treatment is estimated at the rate of 35 percent (with rounding to one hryvnia) the size of one subsistence minimum which is annually established by the law for January 1 of the corresponding year for persons who lost working capacity.
