According to part two of article 5 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity" the Cabinet of Ministers of Ukraine decides:

1. Approve criteria by which the risk degree from implementation of economic activity in the field of urban electric transportation is evaluated (the tram, the trolleybus) and frequency of holding planned actions of the state supervision (control) by Public service for safety on transport which are applied is determined.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the list which is attached.

Criteria by which the risk degree from implementation of economic activity in the field of urban electric transportation is evaluated (the tram, the trolleybus) and frequency of holding planned actions of the state supervision (control) by Public service for safety on transport is determined

1. Criteria by which the risk degree from implementation of economic activity in the field of urban electric transportation is evaluated (the tram, the trolleybus) are:

the number of people who died in the road accidents because of the subject of managing within the last two years preceding planning period;

the number of people to whom the mutilation, bodily harms or any other harm to health in the road accidents because of the subject of managing within the last two years preceding planning period is caused;

quantity of units of the managing of railway vehicles of urban electric transportation (the tram, the trolleybus) which is available for the subject as of any date within the last two years preceding planning period;

total length of the tramroads which are in use of the subject of managing as of any date within the last two years preceding planning period;

total length of the contact network which is in use of the subject of managing as of any date within the last two years preceding planning period;

the number of the unplanned events of the state supervision (control) held concerning the subject of managing within the last two years preceding planning period on the bases provided by paragraphs third - the fifth, seventh - the ninth part one of article 6 of the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity";

the number of violations of requirements of the legislation in the field of urban electric transportation (the tram, the trolleybus) which were revealed by results of the held events of the state supervision (control) within the last two years preceding planning period;

the number of violations of requirements of the legislation on the rights of persons with disability which were revealed by results of the held events of the state supervision (control) within the last two years preceding planning period;

the number of the road accidents which happened because of the subject of managing within the last two years preceding planning period.

2. Risks of approach of negative effects from implementation of economic activity in the field of urban electric transportation (the tram, the trolleybus) are determined in appendix 1.

3. The list of criteria by which the risk degree from implementation of economic activity in the field of urban electric transportation is evaluated (the tram, the trolleybus), their indicators and the number of points is determined by each indicator in appendix 2.

4. Reference of the subject of managing to high, average or insignificant risk degree is performed taking into account score, added by all criteria determined in appendix 2, by the following scale:

from 41 to 100 points - to high risk;

from 21 to 40 points - to average risk degree;

from 0 to 20 points - to insignificant risk degree.

5. Planned actions of the state supervision (control) in the field of urban electric transportation (the tram, the trolleybus) of activities of subjects of managing are held by Ukrtransbezopasnosti with such frequency:

with high risk - is not more often than once in two years;

with average risk degree - is not more often than once in three years;

with insignificant risk degree - is not more often than once in five years.
