About approval of requirements to fish-protecting devices of water intaking and waste constructions

1. Approve the enclosed requirements to fish-protecting devices of water intaking and waste constructions.

2. Declare invalid the order of the Minister of Agriculture of the Republic of Kazakhstan of January 19, 2015 No. 18-05/22 "About approval of requirements to fish-protecting devices of water intaking constructions" (it is registered in the Register of state registration of regulatory legal acts at No. 10292, it is published on February 27, 2015 in information system of law of Ad_let).

3. To provide to committee of forestry and fauna of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within 10 (ten) calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) within 10 (ten) calendar days after state registration of this order the direction it the copy on official publication in periodic printing editions;

4) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication;

5) within 10 (ten) working days after state registration of this order submission to Department of legal service of the Ministry of Agriculture of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2), 3) and 4) of this Item.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after 10 (ten) calendar days after day of its first official publication.

Requirements to fish-protecting devices of water intaking and waste constructions

Chapter 1. General provisions

1. These requirements to fish-protecting devices of water intaking and waste constructions (further - Requirements) are developed according to the subitem 20) of Item 1 of article 9 of the Law of the Republic of Kazakhstan of July 9, 2004 "About protection, reproduction and use of fauna" and determine requirements to fish-protecting devices of water intaking and waste constructions.

2. The basic concepts used in these Requirements:

1) waste construction - the water throughput construction intended for dumping (omission) of water from water storage basin for prevention of its overflow and also for useful omissions of water in the lower byef;

2) the fish-protecting device (further - RZU) - the device for prevention of hit of fish resources and other water animals in water intaking and waste constructions;

3) water intaking construction - complex of constructions and devices for water intake from water objects.

3. Commissioning of water intaking and waste constructions without RZU according to the subitem 2) of article 88 of the Water Code of the Republic of Kazakhstan of July 9, 2003 is not allowed.

Chapter 2. Requirements to RZU

4. In case of operation of RZU of water intaking and waste constructions the effectiveness ratio of RZU is determined according to the calculation of efficiency of RZU given in appendix 1 to these Requirements.

5. RZU depending on settlement expense of water intake and dumping are established according to appendix 2 to these Requirements.

6. In case of operation of RZU of water intaking constructions diameters of cells of the RZU mesh rybozagraditelny screens depending on the sizes of fish resources and other water animals are established according to appendix 3 to these Requirements.

7. In case of operation of RZU of waste constructions the following requirements are established:

1) the speed of approach of water to RZU shall not exceed the taking-down speed for juveniles of fish resources and other water animals;

2) RZU shall not interfere with the omission of water, at the same time to be protected from impact of snags and freeze-up.

8. Designing of RZU is carried out on the basis of scientific research and design and exploration work in which are determined:

1) specific and dimensional structure with indication of the minimum size of the protected fish resources and other water animals;

2) period of their concentration and migration;

3) vertical and horizontal distribution and places of concentration of fish resources and other water animals;

4) locations of spawning areas, zimovalny holes, fodder sites and areas active pokatny migrations of juveniles of fish resources and other water animals;

5) the taking-down current speed for juveniles of the protected fish resources and other water animals.

9. In case of application of motionless networks and lattices the following requirements are established:

1) the sizes of cells, current speed, zasoryaemost and possibility of cleaning, navigation condition are considered;

2) also the directions it to entrance openings of fish-passing constructions are established in both byefa of water-engineering systems for blockage of way of approach of fish resources and other water animals to undesirable places;

3) the network is produced from galvanized wire or from capron and suspended on floats or on pile support;

4) the lattice is produced from metal rods, gleams between cores are accepted depending on purpose of lattice and the sizes of fish resources and other water animals.

10. In case of application of elektrozagraditel the following requirements are established:

1) length of the electrodes located in alignment of zagraditel are established depending on water depth taking into account that electrodes on 0,1-0,3 of meter will not reach bottom of reservoir and its surface;

2) the effective size of electric field strength and distance between electrodes are established according to the sizes of fish resources and other water animals;
