Chapter 1. General provisions

Article 1. Subject of regulation of this Law

1. Subject of regulation of this Law are the public relations arising in connection with realization by physical persons and legal entities of the right to consolidation for participation in prevention and suppression of the fires including in connection with creation and organization activity of voluntary fire protection.

2. This Law establishes the legal basis of creation and organization activity of voluntary fire protection, the status of voluntary firefighters.

3. Features of creation and organization activity of voluntary fire protection, the status of voluntary firefighters are determined by the legislation of the State Party of the Commonwealth of Independent States.

Article 2. The basic concepts used in this Law

For the purposes of this Law the following basic concepts are used:

voluntary fire protection - the organization created at the initiative of physical persons and (or) legal entities on voluntary basis according to requirements of this Law for participation in prevention and suppression of the fires which can consist of territorial and object subdivisions - voluntary fire brigades (teams, groups, calculations);

the voluntary firefighter - the physical person who is organization member of voluntary fire protection and taking part in prevention and suppression of the fires;

the status of the voluntary firefighter - set of the rights and freedoms guaranteed by the state, obligations and responsibility of the voluntary firefighters established by articles of organization of voluntary fire protection on the basis of regulations of the legislation of the state;

participation in prevention of the fires - activities of voluntary firefighters for realization of the preventive measures directed to exception of possibility of the fires and restriction of their effects;

participation in suppression of the fires - activities of voluntary firefighters for prevention of possibility of further spread of fire, dangerous factors of the fire and creation of conditions for their liquidation by the available forces and means.

Article 3. Basic principles of creation and organization activity of voluntary fire protection

Creation and organization activity of voluntary fire protection are performed according to the principles:

1) legality of activities of voluntary fire protection;

2) voluntariness of activities of voluntary fire protection;

3) equalities of the organizations of voluntary fire protection before the law;

4) freedoms in determination of internal structure of the organizations of voluntary fire protection;

5) publicity and general availability of information on activities of voluntary fire protection;

6) readiness of divisions of the organizations of voluntary fire protection and voluntary firefighters to participation in prevention and suppression of the fires;

7) priority of rescuing of people and first-aid treatment by the victim in case of suppression of the fires;

8) reasonable risk and safety of voluntary firefighters in case of suppression of the fires.

Chapter 2. Organization activity of voluntary fire protection

Article 4. Interaction of public authorities and local government bodies (local authorities, regional authorities) with the organizations of voluntary fire protection

Public authorities and local government bodies (local authorities, regional authorities) of the state render assistance in creation and organization activity of voluntary fire protection, including ensuring compliance with the rights and legitimate interests of the organizations of voluntary fire protection and voluntary firefighters, and also provide system of measures of legal and social protection of voluntary firefighters.

Article 5. Organizations of voluntary fire protection

1. Voluntary fire protection is created in the form of public organization, the main authorized objective or one of the authorized purposes of which is participation in prevention and suppression of the fires, first-aid treatment by the victim in case of the fire.

Voluntary fire protection can be created in other form of business according to the legislation of the state.

2. The organization of voluntary fire protection is subject to additional registration in authorized body of the government of the state.

3. Physical persons, and also the legal entities formed according to the legislation of the state can be organization members of voluntary fire protection.

Article 6. Tasks of the organizations of voluntary fire protection

The main objectives of the organizations of voluntary fire protection are:

1) participation in prevention of the fires;

2) participation in suppression of the fires;

3) rescuing of people and property in case of the fires and first-aid treatment by the victim.

Article 7. Staff of the organizations of voluntary fire protection

1. The staff of the organizations of voluntary fire protection includes employees of these organizations consisting on positions which are provided by the staff list, and voluntary firefighters.

2. Physical persons which conform to requirements imposed to candidates for the positions provided by the staff list can be employees of the organization of voluntary fire protection. Employment contracts according to requirements of the legislation of the state are signed with the specified workers.

3. Voluntary firefighters are members of the organizations of voluntary fire protection - the physical persons which received the status of the voluntary firefighter confirmed with the certificate (membership card) of the established sample.

4. The physical persons which reached age of 18 years capable for health reasons to fulfill duties which are connected with participation in prevention and suppression of the fires, and shown willingness to become the voluntary firefighter can be voluntary firefighters.

Requirements to the state of health of voluntary firefighters are determined by the legislation of the state.

5. The voluntary firefighter is allowed to the works connected with participation in prevention and suppression of the fires after training, including special preparation, and passings an examination.

The organization of training, including special preparation, voluntary firefighters and acceptance of examinations at persons which underwent the corresponding training are performed by authorized body of the government of the state. By results of examination to the voluntary firefighter the certificate which shall be stored in its personal record in the organization of voluntary fire protection is granted.

6. For staff of voluntary fire protection the uniform can be entered, and for voluntary firefighters distinctions can be also established.
