1. Approve the enclosed Rules of forming of the delivery plan of oil products.

2. To provide to development department of the oil industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days from the date of state registration of this order the direction it in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

3) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of forming of the delivery plan of oil products"

Chapter 1. General provisions

1. These rules of forming of the delivery plan of oil products (further – Rules) are developed according to subitem 21-7) of article 7 of the Law of the Republic of Kazakhstan "About state regulation of production and turnover of separate types of oil products" (further – the Law) and determine procedure for forming of the Delivery plan of oil products.

2. In Rules the following basic concepts are applied:

1) the oil supplier – the physical person or legal entity delivering to producer of oil products, and also the oil refineries located outside the Republic of Kazakhstan, the crude oil and (or) gas condensate which is independently extracted, received by the Republic of Kazakhstan as the taxes paid in natural form according to the tax legislation of the Republic of Kazakhstan, imported or acquired directly at the subsoil user on the conditions established by the Law;

2) the delivery plan of oil products – amount of monthly needs of areas, cities of republican value and the capital in the oil products made in the Republic of Kazakhstan (further – the Plan);

3) authorized body in the field of production of oil products – the central executive body performing management in the field of state regulation of production of oil products (further – authorized body);

4) producer of oil products – the legal entity having oil refinery on the property right and (or) other legal causes and performing production of oil products according to the passport of production, and also realization of the made own oil products and (or) transfer of the oil products which are raw materials supplied by the customer conversion product;

5) authorized body in the field of turnover of oil products – the central executive body performing management in the field of state regulation of turnover of oil products.

Other concepts and terms used in these rules are applied according to the Law.

Chapter 2. Procedure for forming of the Delivery plan of oil products

3. The plan is created monthly for the purpose of ensuring requirements satisfaction of the domestic market of the Republic of Kazakhstan in oil products.

4. For forming of the Plan monthly till the twenty second previous reporting producers of oil products represent to oil suppliers and to authorized body production volume of oil products for the planned month.

Oil suppliers monthly to the twenty third preceding reporting submit to authorized body the supply requisition of oil products in form, according to appendix to these rules.

5. The authorized body no later than the twenty fifth preceding planned approves in time the Plan according to article 23 of the Law, and also based on production volume of oil products for the planned month and requests of oil suppliers and publishes on the Internet resource.

6. According to Item 7 of article 18 of the Law in the Plan it is specified:

1) list of oil suppliers and producers of oil products, except for producers of oil products of low power;

2) amounts of each type of oil products which each oil supplier and producer of oil products, except for producers of oil products of low power, will deliver on the domestic market of the Republic of Kazakhstan in the forthcoming calendar month:

within the direct deliveries;

through commodity exchanges according to the legislation of the Republic of Kazakhstan on commodity exchanges;

3) amounts of each type of oil products which each oil supplier and producer of oil products, except for producers of oil products of low power, on the conditions established by the Law implements at discretion in the territory of the Republic of Kazakhstan or out of its limits in the forthcoming calendar month.

7. Amounts of each type of oil product which each oil supplier and producer of oil products, except for producers of oil products of low power, delivers on the domestic market it is determined in proportion to amounts of their conversion.

8. The plan within one working day after approval goes to oil suppliers, producer of oil products, and also to authorized body in the field of turnover of oil products.
