About the government public assistance to persons with disability since the childhood and to children with disability

Article 1. Right to the government public assistance

Persons with disability since the childhood and children with disability aged to 18 years have the right to the government public assistance.

The central executive body providing forming of state policy in spheres of employment relationships of social protection of the population concerning family and children organizes work concerning appointment and payment of the government public assistance to persons with disability since the childhood and to children with disability.

The reason, group of disability, term for which disability is established are determined by body of medico-social examination according to the legislation of Ukraine with simultaneous explanation to persons with disability since the childhood of their right to the government public assistance.

The list of the medical indications granting the right to the government public assistance on children with disability aged to 18 years is determined according to the procedure, established by the Cabinet of Ministers of Ukraine.

To persons with disability since the childhood and to children with disability who have at the same time the right to the government public assistance according to this Law on pension and on the government public assistance according to the Law of Ukraine "About the government public assistance to persons who do not have pension entitlements and to persons with disability", the government public assistance according to this Law or pension or the government public assistance according to the Law of Ukraine "About the government public assistance to persons who do not have pension entitlements and to persons with disability" is appointed at the choice of persons with disability since the childhood (legal representatives of persons with disability since the childhood recognized incapacitated and children with disability). Article 2. Extent of the government public assistance

The government public assistance is appointed in the following sizes:

to persons with disability since the childhood of the I group - 100 percent of subsistence minimum for persons which lost working capacity;

to persons with disability since the childhood of the II group - 80 percent of subsistence minimum for persons which lost working capacity;

to persons with disability since the childhood of III group - 60 percent of subsistence minimum for persons which lost working capacity;

on children with disability aged to 18 years - 70 percent of subsistence minimum for persons which lost working capacity.

The extent of the government public assistance on children with disability aged to 18 years which disability is connected with wound or other damage of health from explosive objects taking into account all allowances, increases and other surcharges including provided by the Cabinet of Ministers of Ukraine increases by 50 percent of the extent of the government public assistance on children with disability aged to 18 years based on the documents determined by the Cabinet of Ministers of Ukraine. Communication of disability with the wound or other injury of health from explosive objects received by the child with disability to 18 years is established by the medical and advisory commissions of healthcare institutions according to the procedure, determined by the Cabinet of Ministers of Ukraine.

The subsistence minimum is determined according to the Law of Ukraine "About subsistence minimum" and annually affirms the Verkhovna Rada of Ukraine on representation of the Cabinet of Ministers of Ukraine and is periodically reviewed according to growth of consumer price index together with refining of indicators of the Government budget of Ukraine.

The extent of the government public assistance increases in connection with increase in subsistence minimum.

The government public assistance is established in new size from the date of entry into force of the law on increase in the size of subsistence minimum.

Article 3. The allowance on leaving

To persons with disability since the childhood of the I group the allowance on care of them is established in the amount of:

to the faces with disability since the childhood carried to subgroup And the I groups - 200 percent of subsistence minimum for persons who lost working capacity;

to the faces with disability since the childhood carried to subgroup of B of the I group - 100 percent of subsistence minimum for persons which lost working capacity.

To lonely persons with disability since the childhood II and III groups which according to the conclusion of the medical and advisory commission of treatment and prevention facility need permanent foreign care the allowance on care of them in the amount of 75 percent of subsistence minimum for persons which lost working capacity is established.

The allowance on child care with disability of subgroup And is established in the amount of:

on the child with disability of subgroup And age to 6 years - 200 percent of subsistence minimum for children up to 6 years;

on the child with disability of subgroup And age from 6 to 18 years - 200 percent of subsistence minimum for children aged from 6 up to 18 years".

The allowance on child care with disability of subgroup And is established in the amount of:

on the child with disability of subgroup And aged up to 6 years - subsistence minimum for children under 6 years;

on the child with disability of subgroup And aged from 6 up to 18 years - subsistence minimum for children aged from 6 up to 18 years.

The allowance on care of other child with disability is established in the amount of:

on the child with disability aged to 6 years - 50 percent of subsistence minimum for children under 6 years;
